Motion by Alderman Burns: To pass Resol.utian No. 1641 and that the Mayor be authorized to sign and execute said agreement. Seconded by Alderman Kilpatrick. harried. A1T aldermen to re- ceive acopy of the working agreement. UNITED STATES ENVIRONMEN'T`AL PROTECTION AGENCY: Mayor stated that the city has been served a notice of violation of the E.P.A. standards. The City of Laurel has failed to comply with the E.P.A. Standards at the Water Treatment Plant. That matter referred to the City Attorney and Public Utila~ies Committee. ORDINANCE N0.-647 I~ BEING AN ORDINANCE ADOPTING THE MOBILE fIOME STANDARDS F'OR THE CITY OF LAUREL-, MONTANA. Motion by-Alderman Meyers: That Ordinance Na. 647 be presented for its first reading with final adoption at the next regular council meeting. Seconded by Alderman Ehrlick, Carried. STREET AND ALLEY CONIlUIITT~E REPORT: i Discussion of sidewalks on the west side of the south side of town along the highway. Street and Alley Commi~.tee to work with the City Attorney ~ on this matter. Carried. ~i STREET LIGHTS - LAUREL GARDENS: ~~I I Discussion regarding street lights in the vicinity of Laurel Gardens. OPENING OF SOUTH 5TH STREET: I Discussion regarding the opening of South 5th St. Property belongs ~'i to Mr. Olson. Suggested possibly having it condemned. This matter referred 'I to the street and alley committee. I I SIDEWALKS -FOOD FARM & KWIK-WAY: ~ Discussion. 'i i Motion by Alderman Burns: That the Street and Alley Committee be ~I, given the authority to write a letter to the property owners to see if they would be willing to put sidewalks in voluntarily, by 5.I.D.'s j ar some other method. Seconded by Alderman Ehrlick. Carried., BIDS t?N GARBAGE TRUCK: Alderman Ehrlick reported that the Garbage Committee woul.c2 like to I~, recommend the bid from Government Innovators for the gruncher truck in the amount of $38,983.00 The money has been budgeted for from the sale of the old truck in the amount of $26,600. An additional $12,000.OQ would be needed. Possibly from Revenue Sharing. This matter referred to the Finance Committee to determine if an Emergency budget is necessary. All action delayed until the next meeting. S.M.F. PARTNERSHIP - RECONSIDERATION OE ZONE CHANGP REQ~~3ST. LOTS 9-L7 WHITFIELD SUBDIVISION. FROM R-1 INTERIM TO R-3. The Mayor stated that proper notice has been given and return receipts are on file. I Protestors appearing: Clarence Eastlick Frank Dassinger ~i 1102 Mont. Aye. 1107 Mont. Ave. Laurel, Mont. Laurel, Mont. James Redman. Jerry Klein. 110 E. Maryland Ln. 1111 Mont. Ave. Laurel, Mont. Laurel, Mont. The possibility of deed restrictions was suggested. Neither party I seemed interested. Jim Smith and Pat Mu1].aney spoke on this matter. II City Attorney e~lained that a reconsideration would take 3/4 vote of the council to overturn the denial. The City County Planning Board recommends approval of R-3. Alderman Burns called for the question. Upon taking roll call vote, Alderman Metzger, Massey, Carter, Meyers, Kilpatrick and Ehrlick voted "Yes" and Alderman Burns voted "No". Motion carried 6 to 1 and zone change was granted upon annexation. SHANNON ROAD - RAILROAD STREET i Discussion as to the official name of this road. Mayor Herman to I, discuss this matter with the County Commissioners. BOILER AND O5HA REGULATIONS: Ili Discussion regarding boiler repairs at City Hall. The cost factor has j not yet been determined. Public Bldg. - ~r ~e~ty Committee to take this problem under advisement and set up an emergency,-u~~~ttittee to also look into Osha reg- ulations that need corrected at city hall. i 'i I I I I I II Minutes of the pity Council of Laurel HORSHOE CLUB: Alderman Carter reported that the Horseshoe Club has applied for B.O.R. funds and would like the city to be a sponsor. 'i, i RESOLUTION N0. 1643 BEING A RESOLUTION SPONSORING THE ~iORSESHOE CLUB OF` 2'HE CITY OF LAUI~EL~ MaNTAI~TA IN THEIR APPLICATION FOR B.O.R. FUNDS. Motion by Alderman Carter: That the City of Laurel participate in the application for state grants for renovating the horseshoe pits II at Riverside Park. Seconded by Alderman Metzger. Carried. i JOHN MCMARTIN - CITY COUNTY PLANNING: I i I John McMartin invited the council to attend the regular meeting of the City Co. Planning Board held the 2nd Thursday of each month. i PARK & RECREATION COMMITTEE: I Alderman Carter announced a change of time in her committee meeting I', from 7:00 to 7:30. CLOSED SESSION - PERSONNEL MATTERS: I Benefits to Supervisors who worked during the strike. 'i Motion by Alderman Burns: That the supervisors who worked the strike receive an additional months pay plus 10 days comp. time. Seconded by Alderman Ehrlick. Carried. I Motion by Alderman Metzger: That all other permanent full-time III employees not covered by the contract receive the 6.6~ plus their I step increment. Seconded by Alderman Dzassey. Discussion. Amendment by Alderman Massey:. To exclude the Police Judge, City ~i ~ttarney, City Clerk, City Treasurer, the Aldermen and the Mayor. Seconded by Alderman Kilpatrick. Question called on the amendment. Amendment carried unanimously. Question called on the original motion as amended. Carried. I I Motion by Alderman Metzger: To exclude the aldermen-and Mayor from ~i any raise. Seconded by Alderman Ehrlick. Carried. Motion by Alderman Carter: That the Police Judge, City Attorney, City Clerk and City Treasurer receive 6.6~ of their present sa]:ary. Seconded by Alderman Meyers. Discussion. Amendment by Alderman Carter: That these four people be given the 2~ also, making their total raise 8.6~. Seconded by Alderman Meyers. Vote on original motion as amended carried with Aldermen Massey and Burns voting "No". Motion by Alderman Meyers: That the minutes be-typed up and copies given to the aldermen 2 days after the meeting. Seconded by Alderman Kilpatrick. Carried. COMPTJ'I`ER SYSTEM: Some question about a contract between the City of Laurel and Lewis Crow regarding implementing a computer system. Nothing has been done on this matter and there was no money budgeted for this year. If we owe Crow some money he should submit a bill so we can get this thing straightened out. Motion by Alderman Massey: To authorize the City Attorney to contact Crow to see if a solution can be worked out. Seconded by Alderman Ehrlick. Carried. CITY AUDIT - MAYOR Motion by Alderman Massey: To authorize the Mayor to contact the state regarding an audit and to send out b~;c~ forms. MT-0000906; ) ~1ND ORDER CITY OF LAUREL, MONTANA j (33 U.S.C. 1319(a)) [MATER TREATMENT PLANT FINDINGS OF-FACT Pursuant to the above-referenced statutory authority, which has been delegated ~o me by the Administrator, I hereby make the following findings of fact: 1. Based upon information submitted to this Agency pursuant to the self-monitoring requirements of the above-referenced NPDES permit, the City of Laurel (hereinafter the City) is in violation of said permit.. .The City's permit tivas issued pursuant to the provisions of 33 UeS.C. 1342 and regulations promulgated there- under (40 CFR Part 124). ' 2. The finding of violation is specifically based upon a self-monitoring report covering the period July 1, 1977, through August 31, 1877, the submittal of said report on a quarterly basis being a requirement of the Special Conditions of tYie City's permit. The quality of the effluent discharged by the City is subject to regulation under the Effluent Limitations Section of its permit. The City has additionally failed to commence and complete the construction of needed facility improvements which were to have been completed and in operation as of July 1, 1977. ORDER . Based upon the foregoing Findings of Fact, and pursuant to the provisions of 33 U.S.C. 1319(a)(3), I hereby Order: 1. That the City effect those measures necessary to achieve compliance with the effluent limitations of its NPDES permit 2, That the City develop a specific plan and schedule imple- menting the steps to be taken to achieve the compliance called for 3n Paragraph 1, above, and that this plan and schedule be submitted to this Agency for approval no later than thirty (30) days from the Cityfs receipt of this Notice and Order; 3. That within five (5) days of its receipt of this Notice and Order, the City give written notice to this Agency of its intent to comply with the requirements of this Order.
