A regular meeting of the City Council of the City of Laurel, Montana,
was held in the Council chambers, and called to order by President of the Council,
E. H. Ebersviller, Sr., in the absence of the Mayor, at 7:00 o'c].ack, P.M., on
Tuesday, April 19, 1977.
Upon taking roll ca11, the fc~ll~wing aldermen answered present.: I

The minutes were not read since everyone had received their copy. The

Enclosed herewith, for your information, is our standard Proposal which outlines our methods of procedure,'together
with the Agreement form containing the costs for this irn- ~I

Minutes of the City Council of Laurel
Kilpatrick asked that the following sentence "Ebersviller said to postpone until
after the meeting with Loyd Shay" be stricken from the minutes. ~I
I
Concerning the drainage on 5.i.D, Na. g5, Kilpatrick stated that the motion was made by Kilpatrick and seconded by Metzger. Also the study was to be
made by the people making S.I.D. No. 95, nat the city.

Kilpatrick staffed ~Ehat it was not the opinion of the council, but that
of the City clerk, to wait for the new Mayor and Council £or approval of the
officers of the Fire Dept. and Firemen's Relief Association.
Kilpatrick also asked that the Last four items on the agenda that were
postponed be'"listed, Laurel Rod & Gun CYub, Laurel Rifle Club, Jaycees and the ~I
American Legion Club. With these car:rections, motion was made by Kilpatrick and
seconded'}sy"i~~~.zger that the rninut~s`be approved. Motion carried.
Certain reports of the City of Laurel, Montana, were presented for approval as follows: City C3.erk s Cash Report, City Clerk s Trial Balance and
the City T~e~surex`:s.E~~nanc:~a~~Statement. Motion was made by Metzq~r and seconded
by Michael tha~E the reports be approved. Motion carried.

Motion was made by Kilpatrick and seconded by Hard that the election returns
be approved as read. Motian carriEd.
Leiter was read from Herman Hauck requesting annexation of Block 2, Casa Linda Subdivision. Letter was also read from Robert Sanderson, from the
£irm of Sanderson, Stewart and Mueller Engineering along with copies of an
Exhibit May and annexation report for Block 2, Casa Linda Subdivision. Muir
Isaacs reported that the 7th Ave. sewer line is already full and would discourage
any further annexation in that area until something is done to alleviate the
problem. Bob Graham stated that he would protest this because his subdivision
was approved by the council in 1972 and yet the city still allowed Cherry Hills Subdivision and Dave Murray's land to use the 7th Avenue sewer. Graham suggested
that possibly the $200.00 sewer surcharge rnaney be used for extending the lateral
line. After much discussion, motion was made by Kilpatrick and seconded by
Rodgers that this matter be ~~~~rr~d t~;~~~~{~~cnr~:~<~ cormt :~~ee arid.- brought up after
the first of May. Motion carried.
Minutes of the pity Council of Laurel
Dave Powers presented the council. members with a copy of the fire
report for the year 1~J76. Motion was made by Kilpatrick and seconded by
Metzger that this report be ~gproved. Motion carried.

Dick Metzger re~arted that the sprinkling system at the Cemetery needs some major repairs. these repairs would cost approximately $1,200.00.
Michael stated that this was budgeted for last June but realizes there is no 'i
money. We could pay for it after the first of July. Ebersviller suggested
turning it over to the new administration. It was also suggested that possibly
we could use Revenue Sharing money. Madan was made by Rodgers and seconded by
Michael that this matter be turned over to the finance committee with authority to purchase when funds are feasable. Motion carried.
Dick Metzger reported on a Bowmac Compactor. He stated that the cat I~
we now have is not getting maximum compaction. Western Equipment would like to
take four men to Missoula to look at this machine. Western Equipment would pay I~
all expenses. Dick also said there were federal funds available. Motion was made by Kilpatrick and seconded by Carter that Dick Metzger, Jim Redman and 2
aldermen go look at this machine. Motion carried. (Ervin said they could look
but not buy).

Dick Metzger reported that there was afire in the garbage truck last
week. He a~t~~d t~a~: a letter be written to Wayne Eost commending hirn for his
i quick thinking and keeping the garbage truck from burning up. Motion was made by Kilpatrick and seconded by Michael that a letter be written to Wayne and also
to Dick. Motion carried. Copy of the letter to be placed in their personnel file.
Dick Metzger stated that if there is going to be people working up- i,
stairs there should be some serious consideration given to fixing the air con- I
ditioner.
Dr. Smith asked for approval of the 2 airport leases. He stated that 'I
there ha's'~~en"a few minor changes in the lease with Fitchett. City Attorney I
stated that we could not change the material provisions in the lease but could i
change the new provisions to meet with the F.A.A. Motion was made by Kilpatrick
and seconded by Carter to accept both Leases with the initial 10 year provision.
Motion carried.
Dick Metzger reported on the Swi:rnming Pool Change House. The initial
bid has been cut from $53,800.00 to $36,100.00. This does not include the -
$4,500.00 architectural fee. The money available is $47,091.75. Motion was
made by Kilpatrick and seconded by Carter to accept the bid and get started on
the change house. Motion carried.
City Attorney, Frank Richter, presented a Resolution on the refunding
of the Development Project for Boise Cascade. Resolution No. 1600 was read in
its entirety. Since there were no protestors present, motion was made by
Kilpatrick and seconded by Michael that Resolution No. 1600 be signed by President
of the Council, E. H. Ebersviller, 5r., in the absence of the Mayor.. Motion carried with Kilpatrick, Rodgers, Carter, Michael and Metzger voting in favor
of this Resolution. Tom Hard and Gay Easton were absent.
City Attorney reported on the letter from Sterling Codifiers. He stated
that they demand payment of $1,000.Oq immediately before starting. He also
suggested that we rr~~: the codes before final payment is made. Kilpatrick
suggested that this matter be brought up at the first meeting in May. This is

see it put off any longer.
Kilpatrick stated that he was going to hate to see ~bersvil].er leave
the Council after so many years of service. The council owes him a great deal
of debt. Ebersviller stated that he has sewed the city under S Mayors and has
enjoyed every minute of it. He said he would da it over again and hopes that he
has not made any enemies. Ebersviller received a standing ovation.
Lenhardt invited the council and the people in the audience to stay
after the meeting for cake, coffee and ice cream in appreciation of the outgoing
Mayor and aldermen. Ebersviller was the only one of the outgoing members present.
