Minutes o~ the pity Council of Laurel
April 6, 1977
A postponed meeting of the City Council of the City of Laurel, Montana, was
held in the Council Chambers, and was called to orde~_sksy E. H. Ebersviller, Sr., President
of the Council, in the absence of the Mayor on Wednesday, at 7:60 o`clock, P.M., on April
6, 1977.
Upon taking roll call, the following aldermen answered present:
Tom Kilpatrick E. H. Ebersviller Chuck Rodgers Susan Carter
Herman Michael Ervin Metzger
Everyone having received a copy of the minutes of the last council meeting, motion was made by Kilpatrick and seconded by Michael that the minutes be approved as
written. Motion carried.
City Clerk presented a letter and brochure she received from Sterling Codifiers,
along with a copy of the Ordinances as presented by the company. .These were handed to
the City Attorney who took the material with him, and reported briefly on this.

The following Organizations would request that there be a public hearing held on Resolution No. 1597. Notice of intent to establish the rules governing the Laurel Park
and Recreation Committee.

Minutes o~ the City council of Laurel
Presentation was made of Ordinance No. 640 es~al~lishing the rules and regula~ians for ~I
the Park Commission. During the discussion following, Kilpatrick said that he felt this
should go before the new council. Ebersviller said to postpone until a€ter the meeting
with Loyd Shay. Kilpatrick wanted to make the motion to postpone this matter until the
first meeting in May. Seconded by Rodgers. City Attorney said to re-advertise for the
public hearing to be held the first meeting in May.
Letter from R.W. McKamy was read as follows:
To: The Honorable Mayor and City Council of Laurel, Montana ~I
Re: Building permit fee for 36` x 268' T-Hanger building to be constructed as Laurel Airport.

Due to esculating excavation and. site preparation costs involving this T-Hanger building I
that is to be built on City of Laurel property, I am asking that the $204.Ob building permit-
fee be waived.
This is a $50,000.00 plus steel building a,nd site development that is a significant improve- I~ ment to the Laurel Airport. One that the City of Laurel will be able to point to with pride.
It is however, an operation that is a financial break-even or less proposition and I do I
have limited money to work with.
Therefore, I would appreciate your ~ivingthe $204.00 1?uildn~ permit fee. I

Kilpatrick spoke on this. Kilpatrick made the motion seconded by darter that the permit
fee be waived subject to Federal Government law. City Attorney spoke on this.. Upon
taking the vote, there was not a clear vote, and Ebersviller asked for a roll call. .Carter, Kilpatrick and Michael voted "yes" and Metzger and Rodgers voted "no". Motion carried.
This being the time and place for the opening of the bids for the swimming pool
change house, City Clerk was asked to open the bids. Ken Beven introduced Jim Bauer re-
garding the signed bid on the pool. Total bid amounted to $53,870.Q2. He reported on
this. Kilpatrick made the motion to take this matter under advisement. Seconded by Michel. Motion carried. Metzger stated that the council could possibly call a special meeting.
Kilpatrick approved.

Motion was made by Metzger and seconded by Badgers that the claims be allowed. Motion carried.
Jim Murphy appeared before the Council regarding S.I.D, No. 96 for the water
line on Cedar Avenue. He reported letting the contract to Gray Construction. No one had
bid an the bonds. The Attorney reported that the bonds had been sold privately to Mr.
George Sukin, 2327 Virginia Lane, Billings, Montana, for the sum of $20,000.00 at 8~.
Motion was made by Metzger and seconded by Michael to accept the sale of these bonds as
bid. Motion carried. In this connection the following resolution was presented:
RESOLUTION NO. 1598
A RESOLUTION ACCEPTING BID ON BONDS FOR SPECIAL IMPRQVEMENT DISTRICT NO. 96.
Motion was made by Rodgers and seconded by Michael to adopt Resolution No. 1598. Motion
carried.
Kilpatrick reported on the Life Safety Cade.
RESOLUTION NQ. 1599
RESOLUTION GIVING NOTICE OF` INTENT TO P,IZOPT THE "LIFE SAFETY CODE" 1976 EDITION
AND NEW EDITIONS MADE THERETQ was presented by Kilpatrick. He then made the motion to adopt.
Seconded by Carter. Motion carried.
Kilpatrick reported on the Burlington Northern water line. He announced a meeting
on April. lath, to discuss the question of getting water to the Sewage Disposal Plant.

Kilpatrick reported on the water rules and regulations. Kilpatrick made a
motion to have the City Attorney draw up a Resolution of Intent to accept the new water-
rules. Seconded by Metzger. Motion carried.
The subject of the purchase of anew Police Car was discussed. Motion was made
by Metzger and seconded by Michael to advertise far bids an a Police car. Motion carried. I

Murr Isaacs reported an drainage fay S.I.D. Na. 95, and a proposed change order
for this drainage. He recommended that this change order be disapproved. Bab Sanderson I~~,
of the firm of Sanderson, Stewart and Mueller Engineering reported on this matter. There was much discussion on this subject, and it was the decision of the council after a motion
had been made and seconded and then withdrawn to accept the recommendation of Mr. Isaacs,
and that a study be made to find a suitable alternative.
Dave Powers, Fire Chief presented a list of the officers of the Fire Dept. and i
Firemen's Relief Association, Trustees, etcetera far approval. It was the opinion of the council that this should wait far the new Mayor ana new aldermen. Powers also recommended
that members of the Fire Department be asked to live inside the City limits, or at least
not more than one "road-mile" out, and then they must be able to have a private telephone
line. Motion was made by Rodgers and seconded by Metzger to accept the recommendation of
the Fire Chief. Motion carried.
A Mrs. Helen Schlenz reported that the. City had poured cement and closed. the drain by her home, and water stands there all the time. Metzger reported on this, stating
that it would cost in the neighborhood of $2,SOp.00 ~o fix this up. Isaacs reported on
this. Ebersviller suggested that this be turned over to the Street and Alley Committee.
Dick Metzger reported on needing a back-up unit for the Garbage truck. Rodgers
reported on putting the diesel unit up for sale.
The last four items on the agenda having been postponed for a short time, and
the Mayor not being present to comment, motion was duly made and seconded that the meeting
be adjourned. Motion carried.
