1Vlinutes of the City Council of Laurel
March 1, 1977
A regular meeting of the City Council of the City of Laurel, Montana,
was held in the Council Chambers, and was called to order by Mayor Louie M.
Yovetich, at 7:00>,o'clock, P.M., on Tuesday, March L, i5~~.
The pledge of allegiance to the flag was given as usual, but was lead by Girl Scout Troop 84. Mrs. Glenda Northcutt, leader, introduced the Scouts as
Debbie Anderson, Andrea Northcutt, Wendy Peterson, Kim Holzheimer, Kim Pletcher
and Ryanna DeFlavis.
Upon taking roll call, all aldermen answered present except Charles
Rodgers. i
The minutes of the previous meeting ,were discussed, but not read since
every one had received his or her copy. After discussion, motion was made by
Metzger and seconded by Kilpatrick that the minutes be approved. Motion carried.
Ebersviller mentioned that since there was a quorum present after a committee meeting, he called a special meeting to discuss whether or not the
question of the proposed site for the new post office should be put on the ballot
for the people to vote on. After discussion of the sample ballot sent to the
meeting for inspection, motion was made by Kilpatrick ,and seconded by Michael that
this matter be placed on the April 5th election ballot. Motion carded. Present
were Kilpatrick, Michael, Hard, Ebersvller and Carter.

BEING AN ORDINANCE RE-AFFIRMING THE "UNIFORM BUILDING CODE" AS THE BUILDING CODE OF THE CITY OF LAUREL. Motion was made by Ebersviller and seconded
by Hard that this ordinance be declared passed and approved. Upon taking roll call
vote, all aldermen present voted "aye". Motion carried.

DANGEROUS BUILDINGS," 1976 EDITION AS THE ABATENI~NT OF DANGEROUS CODE OF THE CITY
OF LAUREL. Motion was made by Hard and seconded by Ebersviller that this ordinance
be declared passed and adopted. Upon taking roll call vote, motion carried.

AS THE SWIMMING POOL CODE OF THE CITY OF LAUREL. Motion was made by Ebersviller and seconded by Hard that this ordinance be declared passed and adopted. Upon taking

that this ordinance be declared passed and approved. Upan taking roll call vote,

that the city does not have the money to do this. He suggested the possibility
of coal impact funds to expand our water facilities. In this connection the
Mayor introduced a Rusty Rokita to speak on this mater. Rusty stated that
there was approximately 11 or 12 million dollars available in grants to coal
impact communities. He stated that you must have the planning done before you
can apply. After that it only takes about 2 to 4 months befa~:e we would heap, He also stated that he felt the city has a pretty good chance of getting some
of this money because of the new coal shops at the B.N. Clarence Karst from
the school board stated that the School District has already applied for these
funds and is having a hearing in Helena, Fridap, February 18th, on the pre-
application. Karst presented a letter from the school district supporting the
City Council in their application for coal-impact funds and they would like a similar letter to take-w-th them to the hearing an Friday. Motion was made by
Ebersviller and seconded by Carter that a letter be written to the School District
supporting them in obtaining coal-impact funds for expanding the school system.
Motion carried unanimously.
Kilpatrick read a letter from the City Attorney stating that in his opinion Ordinance No. 629 prohibiting the parking of camp trailers and other
chattels is too ambiguous to clarify by a written opinion. Therefore, the
City Attorney has redrafted a new Ordinance for review and implementation.
Kilpatrick read the following Ordinance:
ORDINANCE NO. 637
BEING AN ORDINANCE PROHIBITING PARKING OE CAMP TRAILERS AND OTHER
CHATTELS. Motion was made by Kilpatrick and seconded by Ebersvill.er that
Ordinance No. 637 be introduced for the first reading. Motion carried.
Kilpatrick read Ordinance Na. 638 and 639 establishing the office
of and defining the dutiES of the Maintenanve Director and the Public Utilities
Director. In this connection the following Resolutions were presented: RESOLUTION NO. 1591
RESOLUTION GIVING NOTICE OF INTENT TO ESTABLISH THE OFFICE OF AND DEFINE THE
DUTIES OF THE MAINTENANCE DIRECTOR. Motion was made by Kilpatrick and seconded
by Ebersviller that Resolution No. 1591 be passed and adopted and notice be
published. Motion carried.
RESOLUTION NO. 1592
RESOLUTION GIVING NQTICE OF INTENT TO ESTABLISH THE OFFICE OF AND DEFINE THE
DUTIES OF THE PUBLIC UTILITIES DIRECTOR. Motion was made by Kilpatrick and
seconded by Ebersviller that Resolution No. I592 be passed and adopted and notice be published. Motion carried.
The Mayor reported for Dick Metzger that a culvert has been put in
the ditch by the clinic. Eventually it will be tiled and covered.
- Montee reported on a letter received from 5afeways asking that the
street vacation in Hageman Subdivision be recorded now since they are ready to start develcapment. The Mayor stated that he would like to hold up until we here
from Mr. Dunsten as to whether or not the shopping center is going in. Motion
was made by Ebersviller and seconded by Michael that we hold up on recording
the vacation until we get a complete agreement from all the parties involved.
Motion carried.
.Loyd Shay speaking on behalf of all the clubs at Riverside Park gave
a brief history of Riverside Park and read the following proposal:
February 11, 1977
The following proposal was made at a meeting at the American Legion Hall
in Riverside park by clubs that have,signed this proposal.
A proposal has been made that the following groups go before the City Council
to ask that sole authority be retained within the City Council in regards to the use and lease of the buildings in Riverside and other city owned parks;
because the city council is the only body accountable to the voter and tax-
payer of the City of Laurel.
We would. appreciate is~nediate action on this proposaal.

Motion was made by Metzger and seconded by Hard that the claims be allowed. ~!i
Motion carried.
Kilpatrick stated that the meeting with the Riverside Park Committee
and the Airport was an open meeting. Kilpatrick stated that they would sit up i
a meeting with the lessees ~f the four buildings at Riverside Park to meet with two members of the Council, Easton and Carter. Kilpatrick stated that from now on,
at least once a year the council should tour every building of the city. He then
made the motiory seconded b~ Carter that the council accept the committee report.
Motion carried. Kilpatrick stated he had nothing further to report.
David Norris, Ernie East and Park Benjamin appeared before the council with regard to cashing in their present Boise Cascade bond issue, and issuing a
new one, for an additional mill.ian dollars in order to take advantage of a smaller
interest rate. He stated that they had a buyer for the bands, ana Boise Cascade.
was in need of expanding their present location, The Mayor stated he was in favor
of continuing the improvement of this plant. City Attorney spoke on this matter,
and stated that in his opinion, no liability could be placed on the City. In this
connection, Resolution Na. 1594 was presented. Motion was made by Ebersviller and seconded by Hard that this Resolution be deal.ared passed and adopted. l~dcaan carried.
Carter reported on the opening of the Senior Citizen's Center, next to the
Owl Cafe. She mentioned several purchases and several donations of money and furni-
ture. She announced the official opening would be March 15th. She stated a lease
had been signed for seven months, with an option for another 12 months. They aye - inquiring into the purchase of a bus to take the members to dinner, and rides back
and forth and to the doctor.
Mike Ralison appeared before the council in regards to the purchase of
a license for the sale of "Fountain Products". He is to be investigated by the
Police Department and possibly be sold a license.
Charles Montee spoke on proposed House Bill No. 323, regarding the pickup
of Garbage.
A Bill for an act entitled: "An act to preserve existing garbage and solid waste
services in the event of annexation and prohibit competitive ar similar service I
provided by the municipality for 3 years €ollowing annexation except upon a proper showing that existing service is not ac'l~quate."
It was the opinion of the council that the council should discourage passage of this
bill.
Letter was read from Safeway Stores to the Mayor regarding their plans I'II for expansion. After discussion, motion was made by Kilpatrick and seconded by
Metzger that the council approve this action, but that the city would not care to
pay for the streets. City Attorney reed a letter on this. Motion carried.
Letter of resignation to Chief of Police from Margaret J. Gatts. She
has been a part-time radio dispatcher, and has resigned to take a full time position.
A Copy of a letter to Government Innovators from Murr Isaacs regarding
the sale of our Leach garbage packer was read. It was the opinion of the council
to hold up on this matter for the time being, and motion was made to this effect
by Ebersviller and seconded by Metzger. Motion carried.

resignation. Write a letter of thank you to Ben.
The Mayor read a letter from the State of Montana Coal Board which acknow-
ledges receipt of a pre-application far Coal Impact funds. It has been docketed
as #0056 - Laurel Water Treatment Plant and is being reviewed. ~,I
The Mayor stated that there was a problem around 616 6th Ave. There is
a kindergarten in the vicinity. He asked hat a slow sign be placed in this area. Carter also suggested another in the vicinity of the Union Hall.. This matter was
turned over to the Police Committee.
The Mayor stated that he had finally received the packet of correspondence
he was supposed to have received before, regarding' the Post Office facility.

The Mayor made a suggestion that the city sell the buildings to the clubs and
.just lease them the ground. They could pay their own insurance and maintain I
their awn building. Easton stated that he felt the city should keep the build- ings. He also said that ha felt the burden of weight should not be put on the
park commission. The Mayor also suggested that when the leases are up in Nov-
ember that they be held in abeyance until some agreement is reached. Bob Burns
said he felt they were aver-looking one vital issue £or everyone involved - Mon-
itary value over community value - Even though the building were leased for $1.00
for 10 years, alot of good has come out of it. Motion was made by Ebersviller
and seconded by Kilpatrick that the council as a whole meet with one member from each club. This meeting will not be open to the public. Motion carried.
Mayor appointed Kilpatrick to chair this meeting because he does not want to be
involved. Kilpatrick set up a meeting for next Tuesday, February, 22nd, at
7:00 O'clack.
I Donna Kilpatrick reported that the park committee is ready to present the plans for the swimming pool change house. It wi11 take about 3 months and
we are pressed far time. If the city agrees to be the general contractor we
a reed would save about 17~ of the contract. Donna stated that Ken Beven has g
to supervise the project. Motion was made by Metzger and seconded by Rodgers
to accept the archiect's plans and to have the city act as the general contractor.
Motion carried. I
The Mayor read a letter from the Post Office acknowledging the meeting
on Thursday evening.

Mayor stated that he would like to appoint Dick Metzger to the City ~I
County Planning Berard. Motion was made by Kilpatrick and seconded by Michael
to accept this appointment. Motion carried.
The Mayor stated that the Laurel Search and Rescue has agreed to be
available for 24 hour service. Their telephone numbers to be listed at the
Police Station.
The Mayor announced that Sterling Codifiers will have a representa-
tive here at the March lst meeting.
Murr Isaacs asked permission to leave the State. Motion was made by
Michael and seconded by Carter that permission be granted. Motion carried.
There being no further business to come before the council at this time, I,
