Yovetich, ~i at 7:00 o'clock, P.M., on Tuesday, February 15r 1977• ~I Upon taking roll call, the following aldermen answered present: I'~ I Gay Easton Tom Kilpatrick E.H. Ebersviller Chuck Rodgers Sue Carter Ervin Metzger Herman Michael II The minutes of the last regular meeting of February 1, 1977, were I read.. Motion was made by Ebersviller and seconded by ~tetzc~ that the minutes I~ be approved as read. Ntotion carried. The Mayor stated that since it takes so long to read the minutes III that after they are typed up that a copy be made for all the aldermen and ~ we could waive the reading of the minutes before each meeting. Motion was made by Kilpatrick and seconded by Ebersviller that the minutes be typed up and ~I a copy given to all aldermen the Friday before the next council meeting. Motion carried. Letter was read from the Laurel Aux. Police requesting a change of pay from a flat rate of $17.50 to an hourly rate of $5.40 per hour. Motion was made by Ebersviller and seconded by Michael that this matter be referred to the personnel committee. Motion carried. The Clerk read the report of the election returns as follows: CANVASS OF RETURNS OF CITY OE LAUREL SPECIAL PRIMARY ELECTION, FEB. 8, 1977 MAYOR - Larry D. "Bud" Henman-Dem. - - - - - 50 Ward IV - Donald E. Meyers - Dem. - - - - - - 68 There were also a numerous amount of write-in votes cast. The Mayor presented the two Resolutions on S.I.D. No. 94 and 95 con- cerning the revolving fund as follows: RESOLUTION NO. x,589 A RESOLUTION PURSUANT TO STATUTORY PROVI5IONi SETTING OUT THAT THE CITY COL3NCIL UNDERTAKES AND AGREES TO ISSUE ORDERS ANNUALLY AUTHORIZING LOANS OR ADVANCES FROM TFiE REVOLVING FUND TO MAKE GOOD ANY DEFICIENCY IN PRINCIPAL AND INTEREST ACCOUNT TO THE EXTENT FUNDS ARE AVAILABLE AND TO PROVIDE FUNDS FOR SUCH REVOLVING FUND BY MAKING TAX LEVY AND LOANS AS THE COUNCIL DETERMINES NECESSARY. Motion was made by Kilpatrick and seconded by Metzger that Resolution ~ No. 1589 be declared passed and adopted. Motion carried. ~ RESOLUTION NO. 1590 SAME HEADING AS A~~VE. Motion was made by Michael and seconded by Carter that Resolution No. 1590 be declared passed and adopted. Motion carried. Attorney Jim Murphy presented a "SIGNATURE AND NON-LITIGATION CERTIFI- CATE" to be signed by the Mayor and City Clerk before the exchanging of the bonds and money. Wilhelm 50.91 Jim Twomey 1,500.00 Motion was made by Metzger and seconded by Rodgers that the claims be approved for payment. Motion carried. Copies of the City-County Planning Notices of Public Hearings were presented: Bob Graham presented request for annexation of lots 7-12 in Block 8 Nutting Brothers Subd~.vision with a request fox zoning of R-3. Kilpatrick stated that he is not in favor of annexation with only a half block. IIick Mefizger reported that the de}~artment heads did not think that the sewer facilities were adequate. Graham says that there would be only three units within the 300'. The Mayor stated that several years ago Graham was the strongest protestor to the multi-unit dwellings, and also that the council should take a better look at this project. A drain ditch was mentioned. Also a protest petition accompanied the request for annexation. Jonn McMartin spoke to the council in regards to some questions that should be considered. A Mr. Simpson, A Mr. Kline, and~Nlrs. Workman, i also Chuck Cashmore spoke on this. After discussion., motion was made by Michael and seconded by Hard to deny the petition to annex. Easton voted to annex - the other members of the council voted to deny.- Motion carried. Kilpatrick said: that the city should place the multiple dwellings in various parts of the city, rather than piling everything in one part of town. i Graham had another request to annex a portion of Casa Linda Subdivision, Lots 2-5 with a zone designation of R-1 for Blocks 2 and 5. Blocks 3 and 4 are requested to be "split zoned". There were several objections to this request. Among them were Chuck Cashmore and others who do not want the R-3 zoning. Mantee spoke on this matter. Kilpatrick suggested that this matter be tabled, and made it in the form of a motion. Seoonded by Michael. Motion carried. ~ Michael reported on the Giblin-Pelican Platt. He stated that the planning board had okayed this plat. The City Attorney stated that there were two years' taxes which were not paid, and the owner must agree to pay the taxes up to date. This is industrial property. Motion was made by Kilpatrick and seconded by Michael to approve the lat with the stipulation that the bank taxes be paid. Motion carried. ' ~°7..~. ~ Attorney Jim Murphy appeared before the council to ask for the Resolu- tion creating 5.I.D. iVo. 96 to be passed. After discussion, motion was made by Metzger and seconded by Ebersviller that this matter be tabled for further ~stt~~y. Mur~z~ stated that if the resolution was not passed, he would have to redo the ~ papers, because all the dates of publication a~~.d be wrong. Metzger then with- ~ drew his motion and E~ersviller withdrew his second. Another motion was then made by Michael and seconded by Metzger to pass Resolution No. 1589 creating S.I.D. ~ No 96 upon approval of the water committee. Motion carried. (Water committee j meeting was held after the regular meeting, adjourned at 11:15, and approval given to S.Z.D. No. 96). There is na ro ert availab e at 1 a reasonable rice in the downtown P P Y P area lar e enou h for the necessar facilities. 5 q Y Some of the areas that were considered was the block where the new ~I, City Complex was built; the Laurel Warden Creamery with the Grace Baptist Church, Wold's Garage and Chuck's Repair.. these properties were too expensive. Also ~I considered was Angfe DeCarlo's property plus Baker's, Ostwald's and another house I on Main and 5th Ave. The drawback to this property was the fact. that o:l~f,?~h I pressure gas lines with main valves are located there.. The gas company said it would be very expensive and almost impossible to move. Close to town and businesses is Rybin's and Parker's south of the underpass. With the proposed new highway 2I2 coming, it is hard to know haw to build on this property until the blue- prints for the highway are drawn. The only area suggested ~ythe Chamber of Commerce is an area west of Laurel outside the city limits.. Other places considered were Price's Apartments plus four houses; ~ Carlson`s Trailer Court; Hurzl.er Hotel plas a house and Auto Truck Repair; and the Merchants Hotel.. A11 of these properties involve renters. In these cases the Government would have to pay moving costs of the renters and pay any rent above what they are now paying for five years. Past experience has shown that persons renting a $75.Od place will not move into anything but a $300.00 a month apartment when someone else is footing the bill. There is a new area back of Fichtner's Chevrolet that could be used. After ten years of study, I believe that the area on First Ave. owned by Eastons, Freebury and Olsen is the best choice for Post Office use and will cost the taxpayers the least amount of money. Mr. Harris stated that the Chamber had never approved one post office site over the other. He said that the Chamber had met with a Mr. Fuller. and Mr. Winston, and that the Chamber had nothing to do with picking the s-its. He requests that this remark be placed in the minutes. i `r The Mayor then went and got the tape from the previous meeting and played j i it back. The Mayor wants a public apology from the Chamber of Commerce.. \ ~ The following letter was then read from the Chamber . Mayor Louis Yovetich Laurel City Council City of Laurel Laurel, Mont.. 59044 Gentlemen and Mrs. Carter: I have been instructed by the Directors of the Laurel Chamber of Commerce to reply to the remarks of Mayor Yovetich at the council meeting on January 18, 1977, in which Mayor Yovetich stated that the Laurel Chamber. of Commerce had taken a position in opposition to the First Ave. site for the new post office. The Directors of the Laurel Chamber of Commerce emphatically deny taking an open position in opposition to the site. We ask that the remarks of the Mayor concerning this matter be stricken from the minutes in so far as it relates to the actions of the Laurel Chamber of Commerce. We invite any concerned individual to inspect the records of the Laurel Chamber of Commerce to reassure them that there never has been any secrecy connected with this matter. Further the city records will disclose that Mayor Yovetich has been advised on the Postal Service activity in trying to develop a site-for a new post office, as early as February 25, 1976. Representatives of the Laurel Chamfer of Commerce will be present at the i next regular council meeting to answer any questions you may have concerning the position of the Laurel Chamber of Commerce. The Building Inspector staffed that Bob Graham had wanted to purchase a building permit. Most of the Council, The Mayor, and John McMartin were of the opinion that this permit should not be issued, and recommended that the council vote "no". Michael reported on the Meyers property -The Nutting Brothers second Subdivision. McMartin asked the council to oppose. Motion was made by Easton and seconded by Michael that this matter be opposed. Motion carried. I There being no further business to come before the council at this session, motion was duly made and seconded that the meeting be adjourned.
