Minutes of the City Council of Laurel
Decc>mber 7, 1976
A regular meeting of the City Council of the City of Laurel, Montana, was
held in the Council Chambers, and was called to order by Mayor Louis M. Yovetich at
7:00 o'clock, P.M., on Tuesday, December 7, 1976.
Upon taking roll call, the following aldermen a~ti~wered present:
Tom Hard Gay Easton Tom Kilpatrick E. H. Ebersviller, Sr.
Chuck Rodgers Sue Carter Herman Michael
The minutes of the. previous meeting were read. Motion was made by Ebersviller and seconded by Michael that the minutes be approved as read. Motion
carried.
Letter of resignation from Dr. E.C. Hall was read as follows:

Dear Mayor:
For reasons of health, I have retired from the practice of medicine. Regretfully, I hereby resign, effective immediately, my responsibilities as Laurel City Health

It was suggested that a letter be written to the family stating how much. his work was appreciated. Motion was made to that effect by Easton and seconded by Carter
that this letter be written. Motion Carr"ied.

Motion was made by Easton and seconded by Ebersviller that the tally by the
office force be accepted. Motion carried.
Resolution was presented regarding a 5p~:cial Local Government Primary Election
as follows:

Motion was made by Kilpatrick and seconded by Carter that this resolution be declared passed and adopted. Motion carried..
RESOLUTION NO. 1576
RE50LUTI~N NO. 15761 BEING A RESOLUTION TRANSFERRING CERTAIN FUNDS OF THE
CITY OF LAUREL, MONTANA, was presented. This transfer was for $375.00 from the Water
Revenue Bond Fund to the Water Reservoir Bond Fund. Motion was made by Ebersviller and ~

RESOLUTION NO. 1577
RESOLUTION NO. 1577, BEING A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE
CITY OF LAUREL AND THE MONTANA POWER COMPANY. SAID AGREEMENT RELATING TO RIGHT-OE'-WAY
EASEMENT, was presented. Motion was made by Easton and seconded by Michael to turn this matter over to the water committee. Motion carried.
ORDINANCE NO. 629
BEING AN ORDINAI3CE PROHIBITING PARKING OF CAMP TRAILERS AN13 OTHER CHATTELS,
was presented. Motion was made by Kilpatrick and seconded by Michael to approve this ordinance, on this, the second reading. Upon taking roll ca11 vote, all aldermen
voted "aye" and said Ordinance was declared passed and adopted.

Motion was made by Ebersviller and seconded by Hard that the claims be allowed. Motion
carried.
This being the time and place advertised for the opening of the bids on
S.I.D. No. 94, the city clerk reported one bid received. Bid from D.A. Davidson & Co.,
with Cashier's check in the amount of $7,570.00 attached was received. Motion was
made by Easton and seconded by Hard that this bid be accepted. Motion carried.
Pat Mullaney appeared before the council to request that the pasture land
around the Water Reservoir be let to him. He promised to repair the fences and keep them
in good repair. Easton made the motion, seconded by Carter that the pasture land be
leased to Pat. Then Kilpatrick made the motion, seconded by Ebersviller that this
matter be sent to a committee first. Motion carried.
Herman Michael made a report on mail boxes in the MaLit Subdivision. After discussion, Michael stated that he had no recommendation. Kilpatrick stated that this .
should go back to committee. The Mayor then referred this matter to the street Arid
alley committee.
Michael reported on the Meyers subdivision and a memo stated that the dept.
heads did not approve this plat No. 1176. Motion was made by Kilpatrick and seconded by Hard that the council go along with the committee. Motion carried.
Tom Kilpatrick was on the agenda on the Airport Commission contract. He
turned this over to John Smith who introduced Duane Roybal and Keith Fetchett. The
airport wished to lease about 30,000 square feet. Fetchett will take care of the
lights, etcetera. City agrees to put in a water system and a septic tank. After
discussion, motion was made by Kilpatrick and seconded by Hard to accept the recommenda- tion of the airport commission. Motion carried.
Ebersvil.ler reported an a city health officer. He stated that the personnel
committee requires that the new employees take a physical examination before coming to
work for the city. Motion was made by Easton and seconded by Michael that the council
accept the recommendation of the personnel committee. Personnel committee to contact
the resident doctors and see what arrangements can be made. ..Motion carried.
Dick Metzger appeared before the council regarding garbage cans in the business district.
The Mayor read a letter regarding funding for a sewer rate study and applica-
tion for a federal grant.

Letter was read fram H.K.M. regarding the re-application for a rate increase
through the Public Service Commission. Motion was made by Ebersviller and seconded by Easton that a new application be prepared for a rate increase. Motion parried.
Montee requested a few minutes of the Mayor's time. He reported on the Fox
property and staffed there would be a further report from H.K.M. at a later date.
Mayor reported two resignations from the City of Laurel Work force. Buck Wood and Chester D. Herbert. He suggested a letter be written to Buck and thank him
for his service with the city. Recommended that Chet Herbert be written a letter also.
Wish him lots of good luck on his retirement. Motion was then made by Hard and seconded
by Rodgers to accept these two resignations. Motion carried.
Letter was read from Dione Smith regarding filling the vacancy left by Inez Vaughn to the Park Board. The Mayor appointed Fred Feuerbacher to this vacancy.
Motion was then made by Kilpatrick and seconded by Hard to approve this appointment.
Motion carried.
Two letters were received from the Police Commission recommending the appoint-
ment of two men to perform as police officers. Larry Bergum and Lee Kerr, to start work

immediately. The Mayor then made these appointments with the approval of the
council.
The Mayor then read a prepared statement as follows:
Once again I wish to emphasize that this Mayor and Council take positive and ironclad
action to control Laurel's growth.
What I have to present will not be looked on favorable by the building and developing
industry.
I feel people wish to control their environment and Laurels development should no
longer be left to the developers.
I
Undoubtedly my policies will be blamed for stopping progress, scarcity of homes and in€lated
prices.
In my opinion, the city should not issue any permits unless the builder can show that essential public services will be available at no added cost to Laurel Taxpayers - When
units are completed. I will insist, with Council support, that all annexing and develap-
~ ment of any outlying area be delayed indefinitley untill a complete environmental study
~ is made and it is ascertained that tax revenues can meet the cost of city services.
At present the cost is being subsidized by the rest of us living in the already developed parts of the city who thereby suffer an increased tax burden.
We have already created some monsters through annexation and to continue this trend
would be folly.
Being big does not generally mean success and in my opinion if Laurel gets any bigger
without some firm and spelled out restrictions we will face ultimate failure. We are at our maximum mill levy as is set by law and we absolutely cannot continue to sub-
sidize new developments. Let the developer pay his own way. I need support from the
council on this issue.

Motion was made by Kilpatrick and seconded by Michael that the council back the Mayor
on this unanimously. Motion carried.
Discussion on a bulldozer that will be needed in the future.
There being no further business to come before the council at this time,
motion was made by Ebersviller and seconded by Carter that the meeting be adjourned. Motion carried.
