M. Yovetich~ at 7.00 o~clcaek, P.M., on 2ue~day, pct. 19, 1976+ I Upon taking ro11 call, the following aldermen answered present: Gay Eason Tc~m Kilpatrick Chuck Rodgers Sue Carter Ervin Metzger Herman Michael The Minutes o~ the last regular meeting of Wit. 5th, were read. Lary He~:nan stated th~.t f3rd3.nance No. 625, 626 and 627 were ~.ot passed and adopted but only presented for the lit reading. With this correction, motion way made by Metzger and sc~eonded by Kilpatrick that the mi~ut~s be ~.pproved. Mot3.on carried. Certain reports of the City of Laurel, Montana, were presented for approval as follows City Clerk's Cash report and City Clerk~~ Tri~.1 Balance for the montY~ o.~ September. Motimn was made by Metzger and seconded by Michael that the reports be approved. Motion carried. This being the t3r~e and place advertised for the opening of bids for S,T.D. Ito. 9L~ and No. 95, the clerk way asked to open aid read any and all bids. Before; the open3.ng of the b3.ds, Attorney Jim Murph;~ pres~n~ed a guaranty made by Vantage Dev~lo~anent, Inc. Mating that after the ec~npl~tion of construction they will gu~.ranty at least $5,0~~.00 remaining to be placed in the revolv3n~; fund, In the event that less than $5~~00.0~ remains, Vantage Develo~ner~t will make up the difference. The Mayor stated that he would like to have the $~~000.00 first in case they should go bankrupt. City Attorn~~r stated that the city h~.~ no liability and that the funds really are not needed. The Mayor said th~.t the only way he would approve the guaranty is with our own guaranty that there would be no levy on the taxpayers of Laurel for the revolving fund until such time as the city gets its guaranteed $5,OC30.00. Jixn Murphy stated that ors Friday Oct. 15th, he spoke to John Easley of D.A. Davidson explaining the prospects of thy. development of the property and stated that the City of Zaurel doesn't cont3.~plate f or a p~;riod of 5 year, until after the completion of the S.T .D. ~ ~ to have the full 5% of the ~¢nount of outstanding bonds. Murph~r stated that Jean Huffard, head of the Bond Dep~.;also has the same understanding. J3.m Murphy stated that the S.I.D. A1o. 96 docLUnents wire not readq~ for presentation at tonights meeting. John Strecker appeared before the council to ask if he could abandon the old .~cwer now connected to an old house and make a new line to connect to a modular home. The Mayas stated that it is our policy not to extend our sewer outside the city. Murr stated that he did not mow where our sewer line was in that area. Murr ~o check with H.K.I. and contact John Meyers. Beven repor~Ged that the :refuse containers in the down~c~wn area have not been serviced for 3 or weeks. Thee cans have posed spick-up problem for tMe city's r~ew garbage truck. PImtion was made bar Michael and seco~d~d by Kilpatrick that these cans be removed. Motion carried. L - - _ - - - _ I i i I i Minutes of the City Council of Laurel Beam stated that he wc~u].d like to send 3 ?nen to the grater and waste water school in Bozeman. Motion was made by Kilpatrick and seconded by Metzler that Beven send 3 men to this school. Motion carried. I I Beven reported that MaLit Const~.etion feels that the City is respo~.~ib1e for installation of the firs hydrants in the area of the Laurel Gardens since no provi~ion~s were made previously. Montee said that Dave Powers wrote them a letter in Jung Mating that they would have to put them in. Easton sated that this i~ the first he has heard of this and he is the i eh~,i.rman of the water ccttnmittee. The council was in full agreement that MaZit ~I would install the hydrants without cost to the city before any water would be allowE:d. After discussion, motion was made by I~lpatri¢k and .~eeond¢d by Michael that fr~n now on a sheet must be attached to all plans received by the city for review by each department and will not be approved until each department head his initialed the sheet. Motson carried. Michael read petition No. 76-6 regarding Wm. 3iegel~s rEquest of a zone designation of "I" Industrial cm lots 11-2~~ Block 25, and Lots 2-8, Block 2~., East Yellowstone Sub. The City County Planning Board re~~nmends that the petition for gone designation be den3.ed because the area i~ under- going a new phase of residential development with the influx of new dwelling unit, and the most appropriate use would be residential. The Board reccxnmends a zone designation of R-3 for property up to the tracks which form a natural b$rrier, with industrial zoning on the east side and residential on the west. Motion was made byI~iiehael and seconded by Kilpatrick to go along with the reccxnmenda~ion of the board. Motion carried. At this time Muir Isaacs hay cane back with a ~~ccanmenda~ion on S.I.D. No. 9!~ and 95. He reecc~nnmended that S.I.D. No. 95 be awarded to Long Ccm~truction. MQ~ion way made by Eaton and seconded by Carter that the Bid frc~n Long Con~truct3.on for S.T.D. No. 9~ be accepted. Motion. carried. Murr stated that they would like to hold S.I.D. loo. 9~. in abeyance bacau~~ the bid amount is over the petitioned amount. Mr. Mw~phy would 1i~e t0 contact D.A. Dav~..dson to ses if they will increase the bonds to meet the bid or if they want to republish the di.~tric~C for rebidclin.~. Motion was made by Easton and seconded by Michael that S.T.D. No. 9?~ be held in abeyance until the bond3.ng cc3mpany has a change to review it. Motion carried. Michael read petition No. 76-7 regarding Mike R~tnee~s request o~ zone designation of "I~' Industrial on Certificate of Survey ,~9~.1 'the NEB, Section 16, 225, R2l~E, MPM, at the SW corner of Shannon Road a/k/a/ Railroad Street and Bernhardt Road. The City-bounty Planning Board would lil~~ to recommend the zone designation be granted because the opt~m~m usage of the propertq would be ruched by the requested zone change. Motion was made by Kilpatrick and seconded by Carter to accept the recommendation of the board. Motion carried. Burt Ward appeared before the cauucil to ask several question r~~ardin the ward ~uhdivision and b~;ing annexed into the city. Mr. Ward asked to attend the c3.ty-county planning board meeting. Ines Vaughn appeared before the council to explain about a misunder- stanciing that resulted eor~cerning the hiring o~ a poli~~man when correct proceedure~ were not followed. After the res~l.ts frcan. the tests came back they realized that Mr. Ehrlick wa.~ not the man suited for the position. The comrr~ission is still interv5.ewng for a policeman. She stated that this has been reported ~o the police department but nothing has been done. This matter referred to the police ec~nzMittee. Dione Smith requested permission to apply for a B.O.R. grant for the dressing rooms at the pool. Motion was made by Kilpatrick and seconded by Rodgers that Dione apply for the B.O,R, grant. 1~otion carried. lotion was made by Kilpatrick and seecmd~d by I~Ietzger that the second reading of Ordinance Igo. 625, 626 and 627 b~ read by title only. lotion carried. Motion carried. Motion way made by Metzger and seconded by Rodgers ghat Ordinance No. 626 establishing regulations for trailer courts be passed grid adopted. Upon taking roll call vote, all aldermen ~r~sent voted "Aye". Motion carried. i ~ ~ I I I I I Minutes of the City Council of Laurel Motion was made by Kilpatrick and seconded-bar Mettiger that Ordinance No. 627 establishing the office of and de~in3.ng the duties of the personnel director be passed and adopted. Upon taking ro11 call vote, the votes were cast as follows: Easton, "abstaining", Rodgers and Cart~±r, "loo", Michael, P?etzger and Kilpatrick "Yes". At this dime Easton changed his abstaining vote to "Yes". Motion carried l~ to 2. Motion caxried, Elsie Johnson appeared before the council to ask when the newt council meeting would be since the next regular meeting is scheduled on election night. Lynn Scheeler would like to take a pie~ure of the Mayor and eounc3l far the book Mrs. Johnson is making. The meeting will b~ changed to Wednesday night November 3rd, at 7:00 P.M. The M~ror stated that he would like to appoint Bob Burns to serve on the Gar~?bling Ccm~ri3.ssion. Motion was made by Eaton and seconded by Michael to accept the Mayor's appointment. Motion carried. The Mayor stated that Bob Dantic resigned frcxn the City County Planning Board and he would like to appoint Wm. S3.egel. Motion was made by Metzger and Seconded by Kilpatrick to accept the Mayor's appointment. Motion carried. The Mayor reported that he would like to send saneor~e to the meetings in Bozeman on Oct. 28th and 29th regarding mosquito spray. Motion was made by Kilpatrick and seconded by Michael that the Mayor appoint someone to attend. Motion carried. The Mayor reported on the meeting with Bill Johnson a~.d Dennis Crawford from the Public Ser~.ce Cc r?is5ion. The Mayor set up a meeting on ~Ianday Oct. 25th, at 5:00 o~elc3ck, Frith Dave McCullough. There being no further business to cccxnne before the council at this times motion was made by Easton and seconded by Rodgers that the meeting be ad3ourned. Motion caxried. Sharon L.
