I RESOLUTION N0. 15~t3 II RESOLU`rION N0. 1~1~3~ BEING A RESOLUTION TO VACATE A STREET. TOWN AS I SOUTH THIRD STREET FR(~+I THE ALLEY IN THE CENTER OF BL(7CKS ~ & 7.~ OF YELL~1nT~TO1VE ~I SUBDIVISION, etc. was presented. Motion way made by Kilpatrick and seconded by Hard that this R.~~olution b~ pas~~d and adopted. Motion carried. Kilpatrick was put next on the agenda go that Mr. Bob We~ter~ could appear before the ccauncil to disc~zss the petition that he pr~s~~ted at the last council meeting. It was sugg~;sted that possibly a stop sign or signs be used. The M~.yor and the G3.ty ~.ttorn~y reported on this, ag did Hard. Metzger asked that the stop signs be tried before the btu+lps prev-icrc~sly suggested. Easton and Rodgers stated they were not in favor of the b~p~ b~e~,us~: of the emergency vehicles. This matter was referred back to the ~tr~~t grid alley ca~nm3.ttee. Dick Metzger reported on Ordinance ~To. 602, and read a 1e~ter as follows: REGULATIONS FOR PROPER BACK FILLI~tG IN STREET OR ALLEY OPE~Il~GS AS REQUIRED BY CITY ORDINANCE No. 60~ That all individual., firms, eontractor~, corporations and u~ili~y c~npanie~ should back fill any street or a11e3* openings with pit-run ar eru.shed road material. If pit-run is used, the last one (1) foot must be 3/!~ inch road mater3.al. Narrow tre~ehes such as telephone 13.ne~, gay lines, power lines and also curb and gut~~rs ~?~~t be filled w3.th 3/fit inch road material. Blacktop struts must also have the blacktop replaced at the cost to the contractor or individual. R.A. I Inez Vaughn, Chairman of thy; Police Ccagmission stated ghat tie ec~a- I~ fission wanted 'a ~ecr~~ary to be made ~.vailable, and also the purchase of a filing cabinet that care be locked. Dione Smith appe~.x~d before the council ire regard to a claim for $6,200.0 for a new roof on one of the buildings at Riv~rsid~s Park. The ~lerk~s office had refused to pay the claim because there were root enough funds i~ the $l~2,40~.~0 grant project. HUD hss refused to all<~w the claim, because the rules were not adhered to -the project was not pmt up for bids -nor were the applicati.on~ for additional funds made. The Mayor Mated that the- claim mint be allowed. Motion way made by Michael and seconded bar Met~g~r that the claim be allowed and paid frcam the General Fund. Easton stated that ~~pen~es mint be cut back soon as the General Fund dial not hive the money. The HUD Fund carp be charged for administrative expense. Dion Smith asked that the council revere ats d~cisiori not to have dances at Riverside Sisll during the ~vm~er month. Kilpatrick made the emotion seconded by Carter that dances b~ allowed. Easton stated that he was against 3t. Kilpatrick reported on tla~s. Monte reported on certain drawin~~ on struts, alleys & combs & gutters, on behalf of Herman Michael. Should have a uniform code on curb & grater. 6-inch rolled curb. He would also reccxend a polic~r of sid~:walk and ~.s to how i~ should b~, in tY~e .future. Should be inspected before the concrete is poured. Michael made the motion, sECOnded by K3.lpa~ricl~ that the reccmuunendation b~ adopted. There was no vote on t~.is. Kilpatrick then asked why sidewalks should be 5 foot. Herman stated that the comity should be consulted on this. After d3.scus+sion, motion way made by Ebersviller and seconded by Rodgers that the matter b~ tabled at the mc,ent. The Chief of Police being back in the council ch~nbers, Kilpa~ricl~ asked him for hip opin3.on on bumps in the ~tre~ts. The Chi~;f of Polies ~ai.d that he was not in favor of eith~:r the bumps or the dips. The minutes of the sewer appeals committee meeting wire read a.~ follows; A meeting of the sewer appeals committee was held ~Iay 20, 1976 at 5s00 P.M.~ in the council chambers. Attending were: Marvin Carter, ~'c~ Hard, Herman Michael, T<xn Kilpatrick and Louie Da~~ Manager of Cene~ Refin~;ry. Mr. Day presented a copy of an e~.se~ent gin~n t0 the city by Ce~ex for a ewer line through their property. Mr. Day also presented copy of a letter written to Dorot~~r Bundy from C. A. Crc~nwell i~. 1961 st~.ting a verbal agree~rser~~ made by the engineer and Cenex gave Cenex a free dap on the s~±wer line in exchange for the easement. Since that time Cenex has put in a second tap. Mr. Day stat~:d tY~at eves if a verbal agre~nent was in effect, h~ feels that new circu~starice~s have arisen (namely: new standards and the building of a secondary s~wag~ plant). Kilpatrick requested that a copy of this be sent to Louie Day at the Refinery. Michael reported on the Sprinkling and Stag Gas Tax fund. Eber~vi3.7.er reported that the personnel eo~nmitte~ and Mantes had met with the union representatives today and said they are going to trr to work in the Sob classification before opening negotiata.an~ on wage . Montee stated that the meeting was just getting together on opening the agreement. Motion was made bg Easton end seconded by Michael that t1~~ personnel ec~mmittee and the union open up this agre~rnent for consideration. Motion carried. Mot3.on was made I by Ebersviller and ~eepnded by Hard that this resolution be delcared pawed and adopted. Motion carried. Rodgers reported that the ecarotnittee had met with the two banks 3.n regard to the loan for the garbage machinery. Monthly at $2,6.8.00 for 36 month., for a total of $95,359.32. Mot3.on way made by Ebersvill~r and seconded by Hard to inquiry abc~u~ a dif~'erent method of payment. Motion earr~ed. Motion was thin made by Rodgers and seconded b~ Metzger to authorize the Mayor and City Clerk to sign the contract. Motion carried. Motion was made by Carter and seconded by Hard that the resolution be p~.ssed and adopted and notice published. Motion carried. Thy -Mayor appointed Bob Byars to the Park Cc~nmission. Motion was made by Ebersville~ and ~eeonded by Carter that the appointment be approved. Motion carr3edo The Mayor r~-appointed LeoMard Wallan to the City-County Health Board. Motion was made by Met~.ger and seconded by Haxd that the appainta~~.nt be approved. Motion carried. Bonnie Preiksza~ was appointed by the Mayor to serve on the Zoning Commission. Motion was made by Ebersviller and seconded by Rodgers that the appointment be approved. Motion carried. Mayor reported on the worms and bugs. He would like achy-wide assessment. Motion was made by Ebersviller and seconded by C~.rter to put the emergency Snow Removal assessment to Insect Control for thie ~ear~s taxes. Motion carriedo The Mayor stated that the City Clerk's office should be re~r3.sed so that there would be a better way of keeping records. He suggested the possibility of going to ccimpu~er. Fie also said he way in favor of goa.ng back to the separate levies for all fund. Kilpatrick said he thought a ~omn~,tpr w~a a marvelous idea. Motion was made by Kilpatrick and seconded by Carterrthat the Mayor be given the authority to go ahead with hi$ plans. Motion carried. Carter asked permission to leave the state. Motion was made by Eber~viller and seconded by Hard that pernlission be granted. Motion carried. There being no further business to come before the council a~ this time, motion was duly made and seconded that the meeting be ad3ourned. lotion carried.
