Bob Worthington and Alan Hulse, Montana Municipal Insurance Authority representatives, attended the
Committee of the Whole meeting to present information regarding risk management for the City of
Laurel.
Mr. Worthington stated the general elements of liability insurance: 1~ par~y coverage involves a contract
to insure your property directly; 3~d party coverage is a contract to insure your negligence. The four
elements of negligence necessary to prove liability are duty, breach of duty, proximate cause and damage.
Alan Hulse presented several court cases that have relevance to liability issues.
Bob Worthington stressed the importance of property maintenance, record keeping, report writing, risk
transfer, policy and procedure.
Mayor Rodgers thanked Bob Worthington and Alan Hulse for their presentation.
The meeting adjourned at 7:00 p.m.
