A Special meeting of the City' Council of the City of Lalzrel~ Montane.,
was held in the Council Chambers, and was called to order by i~a,yor Louis M.
Yovetich ~t 7:00 o~clock, P.?~I.~ on Thursday, August 29~ 1974.
Upon taking roll call, the following aldermen answered present:
Tam Hard Tam Kilpatrick E. H. Ebersviller, Sr. Bob Burns
Chuck Rodgers Henry G~omer Ervin ~etz~er
This meeting wa,s called for the specific purpose o~ deciding whether or not to take into the City Limits property described as E%, SE 4, NE Section
9, X25, range 2~E, f'or the purpose of builcL.n~ a multi-unit apartment house.
This pr. o~~ct~ wa.s brought up b;~ the Mayor. The City Attorney was called on to
expla3.n the situation. Ne stated thc,t the hearing should proceed in axi orderly
r~.aszner with. the Meadowlark Corpor~.tion e:rolainin their proposed. builcli.ng.
Mr. Dixon and representata~ves of the !~ea.dowlark Deve1_opers, along w3_th the ~rch~.teat far the project presented posters end forms.
The next ~rd.er of business ~~as to hear frcxn the protesters. Kent
Harris way evidently the spokesman. Mayor °ovetich stated that while he was
nei they for. nor against t~h~ proposed buil~.ing, in h.is opinion he ci~_d not be-
lieve than fire families had the right to stop construction o~ a ane-h~1f mi~_~_3.on dollar project. r~non~ the prote~tPrs who voiced. their abjsetions were

Larry Herman spoke f'or the Zoning Board. Herman stated that the
council could ma~Ce a m~ti.on to .r. a-consider. The City Attorney asked that the
counci~_ address any c~u.estions to the n~[eadowl~rk or to the protesters.
Mr. ~agelson spoke to the persons pr. went. Mrs. Ma~elson then
mentioned a few thinp~s in rebuttal to one of the protesters. Then. it was
suggested thu.t the council take a ten minute recess.
.Ater re-convening the meeting the MCZyor G,sked the members of tine
caazncil to a.sk qu~st:~ons of. either the des~elopers or the protestors. Burns then. ask.Pd Mea.dowlask if they had an:~ ass~~rance thst these units would be
occupied only by the elderl;~.
Hexm~n stated that the zoning board would mention th~.t under
Orc3lnance s08, Section ~9 it gives the Cit;~ Council the authority to make
a decision contra.rT to the reco~nriendation. of the zoning ba~.rd.
'"he Cit~r Attorney .r~cammended consideration of the original resolution
Noo 1J~.73 at this time. ~e~olution was then presented as the resolution of
intention t.o tike the ~?~ove~descr3.bed property into the City 1i.~nits as stated
in the resolution. lotion was then made by ~bersviller that this resolution
be passed and a.doptEd. There being no second to the motz.on, the motion cliec~
_f or lac? of a s ec and.
There being nn ~urtYier business to c~.e before the cotixicil at this
tame, motion ~•J~,s du1.y made and seconded that the meeting be adjourned.. Motion
carried.
