A regular meeting of the City Council o~ the City of Laur~;l, Mont., was held in the Council Chambers and was called to order by Mayor Louis M. Yovetich at 7:00 o'clock P.Nt., on '~U.~sday July 16, 1974. Upon taking roll ca11, the following aldermen answered present: Gay Easton Tam Kilpatrick E. H. Ebersviller, Sr. Sob Burns Chuck Rodgers Henry Gomer The minutes of the previous meeting of Ju1g 2~ 197., were read. Motion was made by Eber~viller and seconded by Gamer that the minutes be approved as read. 1!2otion carried. Certa~_n reports of the City of Laurel, Montana, were presented for approval as follows: City C1erk~s Cash Report, City Clerks Trial Balance and the City Treasurer's Financ~.al Statement. Motion was made by Ebersviller and seconded by Gom,er that th~sP reports be approved. r~Iotion carried. Police Judge Report was presented f'or approval. Motion was m~.de bar ~,bersviller and seconded by Rodgers that this report be approved. Motion carried, The Police and ~ia.ter reports were presented for approval. Motion was made bar Roll ers and seconded by Burns that these reports be approved. Motion carried. A note was read fr~n Duane F3ehm requesting the use of the ball park on July 26, 27 and 28th .for a little league series. Motion was made by Ebersviller and seconded b~ Cxam.er that this request be referred to the camm- ittee with authority to act. Motion carried. Motion was made by Kilpa..trick and seconded by Rodgers to accept the ?'Mayors appointment. Motion carried. The Mayor stated that he would like to a;~;in appoint Leonard Wollan to the City County Health hoard. Motion was made by Ebersviller and seconded by Comer to accept this appointment. Motion carried. The Mayor reported. on the landfill situation and stated that Jim Redman ha.s been informed not to tike anything that is not land_f.'illable. The m~.yor suggested ch~:r~in~ everyone that dwnps. This matter referred to a. committee of Rodgers, chairman, Comer ~n~. Kilpa~,rick to study the d~unp sit- uation. Goner reported that the yield sign by Durl~.nd eve. and Railroad street sho~lc~. Yee moved back. This matter .referred to the Public Safety Caimnittee to study and come ba.ek with a recommendation. Burns reported that the committee ch~ckecl into the matter of up- dating the city orclin~nces and resolutions. Burns stated t~a.t Pa.lmershei.~r: end Larry Herman would do this _for a minimwn ch~.rge of about t$35Q0.00. Motion was made by ~iurns and seconded by Kilpatrick to let Pa.lme.r. sh.eim and .Herman update the ordinances. 1~otion cdrri~d. Minutes of the City Council of Laurel Rodgers asked permission to leave the state. Motion was made by K.il~atrick and seconded by Eber~vil.ler that permission be granted. Motion carried. Ebersvill.er reported that the personnel cc~nmittee would like to recommend that the two supervisors, I)3.ck Metzger and Ken Beven, be raised to X900.00 per month with no overtime, ef_fecti.ve July 1, 197G. Hfter 6 months it will be decided 3.f thei.r should be any bonuses given. Motion was mode by F?bersviller ~rnd seconded by Kilpatrick to go along ta~_th the re- c~nmenc?at-i_on of the committee. Motion carried. ~bersviller reported on th.e cost of concrete alley appro~.ches. Easton reported on the bids for the tractor 1oa.cler and stated that the committee wou~.d like to recolmnPnd that the ba.d from Tractor end. Equipment be accepted. Easton made this in the form of a motion seconded ley Ebersviller. P~Iotion carried. Easton reported on the cost of enclosin the Tdutting Drain frarn First ~.-ve. to Colorado Ave. This matter referred to the Planzzing and Tm~rove- m~nt Committee and the Public Safety Ca~nmittE~. Dave McCoullough reported that the $9.00 water rate and the new metered water rate would cover the maintenance of the meters. N?cCoullough stated that he Felt the water sewer p1~,ns should be reproduced so that the original plans could be preserved. The cost would bP about X75.00 to have the entire set reproduced.. The Mayor asked McCoullough to take these plans to ~3illings and het some copies made. Mr. Nelson and. ~~r. ZnTalters fram the ~3ad.ger Meter Co. appeared before the council to report what, theix company would have to offer in the way of ~aa.ter meters. Z'he mayor stated that it was C. little prem~±ture f'or much d~.scussi~n on this matter ~~nd. the council wai~ld contact them a ~_ater date. The 1'~Iayor presented a. petition f_ram the protestors on dash. t~ve. and Morris Subdivision containing the signatures of ~.~.1 residents who wish to protest the annexa.t~_on of an R-3 area adjacent to their subdivision. A Mr.. Dixon fr. am Meadowlark Development Co. presented. same floor plans on the proposed apt. complex to be constructed in this area. Ray Harris, represent~..ng the ~rot~estors from this ?rea, stated th~~t the reason the people are protesta_ng is because of the w~.,y the pro,jeet is being handled. These people would like to see some ~l~ns a_.nd figures on the complex. This matter to be discussed at the next regular council meeting. Larry Kukowski, who owns a house outside the city limits, u~a~eared before the council to request permission to hook onto city roster and sewer. He stated th~;t he has completed a.ll the work concerning the hookups Gnd has spent about ~~OO.OQ. Mr. Kukowsl~i. said that John. Daley load previously given him pexmiss~_on to hook on to the water and sewer. Now, he finds that we have a "pigtail" ordinance prohi_t~it~.ng tax~pinr~ on to the existing water lines. After discussion, znot3on ~r~s m~:de b~ ~;bersvi? ter and seconded by Gomer that this mattea~ be referred to the p~a.blic works cc~nmittee and water committee to investigate with ~uthorit~ to act. Motion carried. Motion carried. Lenhardt reported a man doing business in Laurel, without a city license, ~,nd who wa.s violatinn the Green River Ordinance. Lenha.rdt stated that after the mt,n wa.s stopped fr. am working he checked into getting ~ c3_ty license. He was refined a city license by the City Treasurer anal told he would have to present his rer~uest to the council. This man approached.'.' ~bersviller in regards to a license end Ebersviller instructed the City Treasurer to issv.e h~xn ~ license. after checking; into the reputation of th~_s man h~_s license w~.s then taken away. Lenhardt su~gegted that ~l1 n.ew ]_ice~ses be rieferred to the cotncil before they are ever issues. Burns stated that this was ~,.lready the ~o]icy and the license sho~.ld have never been issued. TJiotion wa.s then m~.de by i~.odgers and seconded by Kilpatrick that any new license be referred to the Chief of Police first and then the City Council. Dick ~getz,~er asked what had been decided about the dip at ~.th live. and 7th Street. Burns reported that the committee decided to install ~ culvert. Dick 1'netzger reported thGt the ~arb~~,e cret~r was in the process of changing their routs. This date, July 16, 1971~~ pr~v3.o~sly set as the time and place scheduled for public hearing and receiving protest or ob~eetion to the issuance of Industrial Revenue Bonds for the purpose of acquiriMg r~anu- facturin~ or industrial properties and to lease or sell the same to Boi$e Cascade Corporation, as requ~.red by Section 11-x.103 (5) R. C. M. The Clerk inquired if there mere any protest or objections to the issuance thereof . No objection or protest was made and therefore the Counc~.1 unman- amously determined that the proposal was in the public in~~rest of the Gsty of Laurel, and authorized the issuance when the texxns arzd details were es- tablished.
