wa.s held in the Council Chambers and called to order,;:by President of the Council, E. H. Ebersviller, Sr., in the absence of the I~tayor, at 7:00 o~clock,

The minutes of the previous meeting of June 18th were read.
Kilpatrick wished the minutes to be ch«n~ed .from the "sewer raised to ~h.,~0

Motion was made by Burns and seconded by Hard that the minutes be approved

Bid from Fiimrock Ec~ul.pment Company - mot al Hid Price, F.0.~3. Laurel,
Mon.~~na - $39,994.00 as per specifications on file in the City Clerk's Office.
Burns asked fora 10 minute recess to study the bids. After reconvening
the meeting, Easton made a. motion seconded by Burns that. the ~c~nmittee take
these bids under advisement and have a snort meet n~ after t,~e regular council

Motion was made byI~etz,~er and seconded by Herd that the claims be mellowed.
Motion carried.
Sanitation report was Presented for approval. Motion was made by-
Kilp~trick and seconded by Hard that this report bg approved. ~Zotion carried.
Clerk announced the budget meetings .for July 1.C7th, 18th and 24th and.
Auk. 7th and 12th.

1. Application is herein made for annexation of a parcel o~ i~a
200 feet by 300 _feet located at the south-east corner of Washi.n~tan .eve. and ~Rar~rlan.d Lane and immediately east of_ the city park str~_p. This p~.rce1
is 200 feet east-rest on the south boundary of Maryland l'~ane ~.nd 30Q feet
nortYa~solzth immediately east of the present cit park. This parcel would
be taken Pram a parcel legally described a.s: E~, SEA, NE1w, Section g, 2S~
21~E~ County of Yellowstone, State off' Montana. The present use is agri-
cultural and is bordered by land of a~rucultural, c~nmPrcial, R-3 end R-1 with sc~xne R-2 usage.
2. ~i~e .respectfully request that th~_s parcel be annexed to the
City of Laurel unfler the followin zoning:
a. The first 50 feet east-west x 300 feet north-youth to be zoned as R-2 (Two-family IJwellings) ?nd
b. The next 150 feet east-west x 300 feet north-south to be
desi~~ted R-3 (Multiple Family Dwellings).
3. The firs~h ~0 feet east o~ the prESent park, bearing the R-2
zoning would be in harmony zaith the residential area on the kTest side of Washington Avenue which is now R-1 and R-2 mixed. The addition of this
50 foot parcel would also create a distance of 160 feet between the S~-3
dess_~;nated property end the residents on the w~5t side off' ~+Iashington
avenue. We propose that th:i s ~0 foot parcel, if desi.~natPd R-2~ be
a. Given to the City ~f Lal~.rel a.s acldational park or
b. ?f the Park Conuunission or any other responsa.ble city

be maintained by the adjacent R-3 as an ~dditi.ona;l "buf_fer strip"
Usage of the R-3 desinn.ation would be for the creation of a 2~. unity 1-bedroom apartment ccenplex designee) for the elderly in which a maximum
of two residents per apartment would be allowed.
If for any reason, the above zoning is not permitted, we respectfully
request the withdrawal for annexation.

The Zoning Board of Adjus~z~ent recommends that the City of T~aurel
accept the 50' parcel of land adjacent to the present park, E. 50~ x 300' on
Wash. Ave., to be annexed to the City first and then recommends the other parcel
of land East of said. park be annexed as R-3 f.or multiply dwellings.

Kent Harris appeared before the council as a spokesman for the residents in
this area and presented a petition protesting the R-3 annexation of this
property. Ebersviller stated that there was no legal protestors within 1~0~.
The meeting was recessed fora _few minutes while Burns called Saschia Herman whQ is a member of the zoning board. Burns reported that Saschia Herman
would came up to the meeting in about 1Q minutes. This matter tables until
Saschia :Kerman bets to the meeting.
Gomer reported that the Cemetery looked a mess. Dick Metzger
stated that LarrT~r Karst and Tony Strand have been working at the Cemetery everyday.
Saschia. Herman appeared before the council and presented the
plans for the 21.E unit apartment complex to be built on Wash. Fve. Aftsr
much d_isaussion, motion was made by Burns and seconded by Gomer to pass a
resolution of intention as per the recozmnendation of the zona~ng board. Motion carried.

Gomer reported that the weeds need cutting. Dick Metzler stated
that the WEEC~.S on the city lots have been cut.
Burns asked if the new $9.00 water rate and the existing meter rate would cover the maintenance of the meters. llave McCoullough to check
this.
~3u.rns reported that all the hookups are in at Riverside Park.
Burns stated that he would like to have scxne green thumb workers. Burns 5~.id that since Mr. Emineth has passed away he needs a caretaker at
t~verside Park. Herd stated that the two E~nineth boys were going to take
care of the Park.
Rodgers reported that the Laurel Volunteer Fire Department would
like to invite everyone to attend their J~.th of July Celebration.
Rodgers stated that hP was ~n tre process of getting scene appraisals
on the vacant city lots.
Kilpatrick reported on the amount of water being used and stated
that ~t the present -Dime it looks like we wont have to ration water.

Kilpatrick presented a plan to create~2-) supervisors (Ken Seven
and Dick I~Tetz~;er) with authority to supervise the city crew. Ervin t~ietz~er
stated that he felt Kilpatrick was doing over the personnel cam~n?ttees head, and thought this matter should be referred to committee for study. Motion
was.mad~ by Kilyd.triek and seconded by Hard to accept this plan to have two
supervisors. Roll cell vote was taken with Hard, Kilpatrick anal Rodgers
voting ~'YES~' and Easton, Burns, Comer and M~;tzger voting ~'N0. Motion failed
four to three. Motion was then made by Bums and seconded by Gamer that
this matter be referred to th.e personnel comma.ttee to came back with a recommendation. ?~ot~on carried.
Easton. asked permission for the Firemen to use the Park on the
nth of July. Easton made this in the form of a motion seconded by Metzger.
Motion carried.
Easton reported on nutting drain.
IPnhardt reported that ~'almer~heim was checking into a helmet
ordinance for motorcy=cle drivers and riders.
Lenhardt stated that dam Harr~i_son would be starting a5 the new dog catcher right after the lath of July.
Lenhardt asked .bout the gambling ordinance. P~lmersheim presented

the Ordina.-~ce drawn up by- the City of Billings and Yellowstone County. Motion
was made by Hard 2nd seconded by ~3urns that the Police Committee work on setting some prices for the licenses. Motion carried.
Dick Metzler requested permission to have a couple o~ tires recaped.
Motion was made by Burns and seconded by :Rodgers that Metzger be allowed
to have two tires recaped. l~7otion carried.
Dick Metzger stated that all tree branches must be cut into four foot lengths in order to bury them at the dLUnp.
Dick reported on the dip at 4th A.ve. and 7th Streets he suggested
either a, culvert or a concrete butter be put in. Dave McCoullough reported
on this. Motion wa5zna.de by K~lp~trick and seconded by Gomer that this
matter be sent to the planning and improz~eznent cammitt~e. Motion carried.
Palmersheim presented Petition to Vacate Streets and Plats, Waiver
Of Protest of Annexation and a Petition .for Annexation to be fa~.led in the
City Clerks Office, and a Notice to be posted in three public places.
Palmersheim reported that Boise Cascade would like a letter ~.ssuring them that the city will not require them to put up a Railroad Crossing devisa
on Railroad atreet. Also, they would like the city to guarantee them water
and sewer at the s~~me rate charged to other applicants .for the same services.
Motion was mGde by Burns and seconded. by Metzger that Palmersheim write these
letters to Boise Cascade. Motion carried.
Dave McCoullough reported that the surveying instruments have been
adjusted.
Dione Smith, Chairman of the Park and Recreation Commission. re-
ported the following:
1. The electrical work atRiverside Park ha.s been completed.
2. 12 Horseshoe pits have been installed at Riverside Park.
s 3. Swimming lessons have been raised to ~1~.OQ this year.
There being no .further business to came before the council at this tame, motion was m~_de by Gomer and seconded. by H~.xd that the meeting be
adjourned. Motion carried.
