Minutes of the February 26, 1996, meeting were read. Motion
by Joe Bradley, seconded by Steve Cosner to approve the minutes
as corrected. Motion carried.
Correspondence. Received the minutes of the February 15,
February 21, and the agenda of the March 7, 1996 meetings of
the Billings Local Governmental Review Commission. Received
the minutes of the February 22, the February 29, and the agendas
of the February 29, and March 7, 1996, meetings of the
Yellowstone County Local Governmental Review Commission. Received
a copy of a Montana Attorney Generals Opinion distributed by
Crosby Opinion Service, of Helena, Montana. This was an opinion
asked for by the Belgrade City attorney, asking if the City
of Belgrade could prohibit a competing garbage contractor from
doing business along with the carrier that was currently
franchised by the City of Belgrade. The opinion consisted of
three criteria; (1) city powers under self-governing provisions,
(2) powers established under the Montana Public Service
Commission and (3) pertinent state statutes governing the
licensing of various occupations. It was held that the city
could not deny the new contractor access to the city as long
as it met Montana PSC provisions and the more stringent city
provisions.
Discussion was held concerning the licensing of various
occupations, including attorneys, CPAs, cosmetologists, insurance
agents, etc., in reference to self-governing powers, PSC
regulations and state statutes.
Discussion was held concerning attending a meeting the
Billings Local Governmental Commission to be held in City Council
Chambers, March 27, 1996.
