Collins Jim Redmond Jim Flisrand Ernie Davis John Volmer Gary Remmick Chuck Rodgers Bob Graham OTHER'S PRESENT: Dennis Johnson of Big Sky Haul--Away A quorum (3 or more) present, the following action was taken by the Committee: A new contract for the Landfill operation was presented by Dennis Johnson of Big Sky Haul-Away. Discussion was held on two proposals: 1. an increase of charges. 2. a proposed transfer station. Motion was made b L.D. Collins and seconded by Jim Flisrand to present both proposals to the City Council for consideration. Motion was carried 5--0 (Ernie Davis abstained). Jim presented the Women in Laurel garbage can proposal. The Garbage Committee was in favor of the concept but not of the proposed container. BOX 30331 BILLINGS, MONTANA 59107 (406) 248.5400 March 21, 1988 City of Laurel Garbage Committee PROPOSED TRANSFER SITE: As you will see in the following proposal, we would like to offer an option to the existing landfill operation. We encourage you to look at the options as an alternative to operating the existing landfill. We have listed some of the advantages to a transfer site concept. 1) Landfill Use. Because of the water table we are unable to dig pits as deep as they were formerly. We can only dig to a depth of approximately 5-8 feet to stay within the guidlines of the State of Montana's Environmental Health Department. At the present time we are using approximately 41 acres of land a year to dispose of all of Laurel's refuse. Through the use of a transfer site this land could be saved for future use if necessary. 2) Liability. The State Environmental Health and the Federal EPA are constantly changing regulations to landfill operations. As these changes occur they could possibly increase cost to operate a Class 2 landfill. One of the changes in the near future will be monitoring wells surrounding the landfill. Because of the water table at the landfill we have had to abandon one pit. We are presently using this for Class 3 material only, such as yard refuse and construction material, which falls within the guidelines of the State of Montana. A transfer site would eliminate any liabilities of pollution to the environment. The elimination of these liabilities should seriously be considered by this committee for future use of the existing landfill. 3) Protection of Health and Environment. With regard to public health a transfer site would eliminate litter problems which are seemingly constant due to the wind at the existing landfill. All refuse would be dumped within the building, separated, and placed within the proper containers, thus eliminating litter problems completely. A transfer site would give the caretaker an opportunity to monitor the types of materials being disposed. He will have a chance to see what is dumped and take all necessary steps to separate any types of hazardous material such as batteries, small amounts of motor oil, any types of liquids, again eliminating liabilities. 1 J PROPOSED TRANSFER SITE CONTINUED, Page 2 4) Recycling. Because the entire operation will be conducted within the building or fenced area, this will give the caretaker the opportunity to separate all recyclable material such as glass, newspapers, aluminum, and cardboard, thus reducing the amount of refuse to be transported to the Billings landfill. We have done some recycling at the landfill over the past year, but because of the winds and weather we have not been able to pursue recycling at it's full potential. We feel by using a transfer site we can reduce volume by 20 %, thus in turn possibly reducing cost to the City of Laurel. In each ton of garbage there are approximately 600 lbs of recyclable material. 5) Convenience. All persons using the transfer site would dump onto the concrete floor within the building making it much more convenient, especially in winter. It would also give the city garbage truck a flat and stable location to dump it's load. COST OF OPERATING TRANSFER SITE: Big Sky Haul-Away would be interested in contracting on a per load basis to haul all refuse to the Billings landfill at a cost of $80.00 per load. All yard refuse and construction material would be dumped into the existing Class 3 pit. Big Sky Haul-Away would provide a caretaker, a Cat for disposal of Cl.ass 3 material, all necessary equipment at transfer site ( 4-40 cubic yard containers), all equipment used for the purpose of recycling for a monthly operating cost of $1,800 per month. We feel by using the Class 3 pit for yard refuse and construction material, and by recycling we can reduce the total number of loads that would be necessary to haul to the Billings landfill. We feel there would be approximately 420 loads or 16,800 cubic yards for an approximately cost of $33,600.00 per year. This would include the cost of disposal charged by the City of Billings. Because of the uncontrolled variations that can occur due to population increases, decreases, or just overall useage changes, we would like the committee to realize that the above numbers are loose approximations. If the committee chooses to consider our proposal we can conduct a study for more accurate numbers. SITE DESIGN AND COST: We have enclosed a cost breakdown and layout for constructing a site at the existing landfill. NOW, THEREFORE, in consideration of the mutual covenants and agreements between the parties hereto, it is mutually agreed as follows: 1. That the CITY wi l l permit the disposal of solid vaste, except industrial wastes, collected by MUSSELSHELL COUNTY at the sanitary landfill facility operated by the CITY at such times as said landfill shall -be opened for disposal of solid waste. 2. That MUSSELSHELL COUNTY agrees to y the CITY for the use of said sanitary landfill facilities at the rate of r$$.53) Fifty-Three Cents per cubic yard of non-compacted solid waste and ($1.15) One Dollar and Fifteen Cents per . cubic yard of compacted solid waste, and/or ($4.24) Four Dollars and Twenty-Four Cents per ton, said rate to be determined by the load capacity of the vehicle used to haul said solid waste regardless of the actual size of the load or by actual net weight. 3. That MUSSELSHELL COUNTY agrees to pay a guaranteed annual fee of $5,300.00 even if useage charges generate less than that amount. 4. It is further understood and agreed that this agreement shall be effective for Six (6) Months from and after the 1st day of January 1986, unless terminated by the CITY. The CITY will provide 90-days written notice prior to any termination date. 5. Box 30331 Billings, MT 59107 (406) 248-5400 February 16, 1988 City of Laurel Garbage Committee RE: New Contract-Operation of City Landfill We are asking the Garbage Committee at this time to consider renewing the existing contract for operation & maintenance of the city landfill for an additional 2 years ending 1990. Because of a couple changes that have occurred in the last year it will be necessary for us to increase the cost to operate by 8% or $3,984.00 per year,' for the additional 2 years. The changes we are referring to are listed as follows: 1: Yellowstone County Air Pollution Control Board A: On Dec. 9, 1986 Mr. L.D. Collins informed the Board that Landfill Services, a private contractor, was taking over the operation of the city of Laurel's landfill. He said the Board should reconsider the burning permit issued to the city. of Laurel if the operation was transferred to a private con- tractor. The subject was tabled. B: Feb 10, 1987 Mr. Duganz updated the takeover of the city of Laurel's landfill by Landfill Services. The board discussed the situation, and Mr. Fraser moved to change our agencies policy to state that "no landfill in the Yellowstone County will be issued burning permits to burn refuse in a landfill. Mr. Steinmetz second, and the motion past. (See attached informa= tion Yellowstone County Air Control Board.) 2: Department of Health and Environmental Sciences A: Inspection, Sept. 28, 1987, Ground Water. Because of the ground water height it was necessary for us to abandon the existing trench for Class 2 waste and move to a different loca- tion. We are presently using the old trench for Class 3 material. The move to the new trench makes it necessary for us to move dirt a longer distance for cover, resulting in a more costly operation. (See attached information titled Dept. of Health and Environmental Sciences.) As I am sure the garbage committee realizes it is more costly to bury Class 3 material rather than burning it. We feel that because of these reasons the proposed cost in- crease is justified. There is only 1 change we would like to make regarding the old contract. It maybe necessary to install water monitoring wells at the existing landfill in the next couple of years. We feel the City should pay all costs if this should occur. In closing we are asking for an additional 2 years to be added to the ex- isting 1 year left, making the contract extend to January 1991. The 8% increaser would only apply to years 1989, and 1990, beginning January of 1989. We sincerely appreciate your consideration in this proposal. Concerning October's Industrial Compliance, Mr. Duganz discussed the storage of coke from the Exxon refinery at the Mossmain Industrial Park near Laurel by International Minerals and Chemicals. He said they would be storing coke at the site for two or three years, and they will be adding latex to reduce emissions of the coke storage area. Concerning November's Industrial Compliance, Mr. Duganz updated the status of Asphalt Supply saying the results of the bench test conducted by EEMC indicated that the carbon ab:;orl-)1 i on niet-hod woul cl noi- he feasible. The ' amount of carbon needed would be prohibitive, Mr. Wadington of EEMC indicated that incineration would be the only suitable method, but its cost would be very high. Mr. Duganz said he talked with Mr. Dennis Paxinos of the County Attorney's office concerning the status of the pending litigation against Asphalt Supply. Mr. Duganz said there is nothing to report at this time because the attorneys are still preparing the case against Asphalt Supply. Regarding November's Administration, Mr. Duganz said our operating budget is in good shape at this time. Mr. Duganz noted he had no idea about funding for next year at this time. He said our Agency had hired a new secretary, Vicki Archer, to replace Lynda Music who quit to accompany her husband to California. They discussed various standards, ambient levels, and methods to control emissions. Mr. Duganz said our Agency has received inquiries concerning the tax credit for wood-burning stoves. He noted that the EPA should release standards and specifications concerning wood-burning stoves by early 1988. In other business, Mr. L.D. Collins updated the possible transfer of the operation of the City of Laurel landfill to Big Sky Haul-Away, a private contractor. Concerning January's Industrial Compliance, Mr. Duganz said an operating permit was issued to Earth Builders for a gravel crusher. He said the sandblasting operation at Empire Steel had been inspected and no problem was found. One individual keeps complaining about this situation, but no evidence to verify his claim can be found. The preliminary hearing on As halt Supply is scheduled for February 19th in Judge Barz's court. Mr. Duganz thought the Dawson case might cause a postponment of this case. Concerning January's administration, Mx. He said the Air Quality Bureau has officially requested redesignation of Billings for attainment of carbon monoxide; he said he didn't know how long the EPA would consider the matter before ruling. Regarding January's Schools and.-Meetings, Mr. Duganz said he attended a meeting with the Yellowstone Valley Citizens Council to discuss the State sulfur dioxide ambient standards. He said Russ and himself attended the State Board of Health and Environmental Sciences meeting in Helena where the Billings sulfur dioxide situation was discussed. Box 10 Laurel, MT. 59044 Re (Laurel Landfill Inspection j bear Mayor Gauthier: On September 28, 1987, Scott Peterson, Solid & hazardous Waste Bureau,- and myself inspected the Laurel Landfill in response to a complaint that had been received. Enclosed is a copy of that inspection. When Scott and I arrived at the landfill to investigate the complaint, we were both quite alarmed. Allowing groundwater to infiltrate garbage and leaving rgfuse uncovered are both serious violations. On several occasions in the past you were informed of the potential for high groundwater in this area and were instructed on how to check for it when each trench was excavated. Dumping Confined to a Manageable Area (Rule 16.14.520 (3)) - Dumping of solid waste shall be confined to areas within the disposal site that can be • effectively maintained and uper•atud in accur•dance with this rule. The area being used for dumping was almost as wide' as the trench itself. The refuse was being dumped on the Lop of- r'eccnL rill areas and wus then pushed over the edge into the trench. This created an extremely steep slope which could not be properly worked by the machinery. The dumping area must be kept as small as possible and limited to the capabilities o the machinery and site. #4 Refuse Properly Covered After Each Operating Day (Rule 16.1 .521 (2)(a)) - All Class II sites using landfilling methods shall compact and cover solid waste with a layer of at least six (G) inches of approved earth cover material at the end of each operating day. Because of the way the garbage was being dumped and handled, it had created a face of garbage (almost a wall) that could not be covered. I was. told that this had occurred over several days, but it appeared large enough to be several weeks worth of refuse. #5. Spreading and Compaction of Refuse Adequate (Rule 16.14.521 (2)(a) - Once again because of the working face that had been created, it was not possible to properly spread or compact the refuse. The working face of refuse should be at approximately a 3 to 1 slope so that the machinery can spread, compact and cover the face. #6. Rodents and Insects Controlled (Rule 16.14.520 (5)) - Flies and other insects, as well as rodents, shall be effectively controlled. Without the proper cover on the rePur;c it i?; impos-;ible to Control insects and rodents • attracted to uncovered garbage. As mentioned above the refuse must be covered with six (6) inches of compacted soil cover. V. Blowing Paper Controlled (Rule 16.14.520 (4)) - Effective means shall be taken to control litter at solid waste storage and disposal facilities. The landfill site, adjacent fields and along the highway are spotted with litter. This litter needs to be picked up and properly disposed of. To prevent this from being a continuing problem, I recouutrend that portable litter screening be purchased or constructed. These screens can be moved to surround the working area to prevent litter from escaping. I have already supplied Dennis Johnson and Jim Flisrand with sample plans for this type of screen. In order to provide adequate protection you would need a minimum of six (6) and preferably ten (10). #10. Other 16.14.505 (2) - The trench in use at the time of the inspection had been excavated into and through groundwater bearing soil strata.
