Dick Fritzler, County Rep. David Oberly, County Rep. Hazel Klein, City Rep. John VanAken, County Rep. Deb Horning, City Rep. Kathy Siegrist, County Rep. Others present: James Caniglia, City Planner Cheryll Lund, City Secretary A motion was made by Deb Horning and seconded by John VanAken to approve the minutes of the December 4, 2008 meeting. The motion carried by a vote of 7-0. Public Hearin for Annexation and Special Review Requests - Block 1 Lots 1-5 Laurmac Subdivision and Block 1 Lots 1-3 Ward Subdivision for RK Development Chairman Linder opened the public hearing. RK Development has requested annexation for Laurmac Sub. Block 1 Lots 1-5 and Ward Subdivision Block 1 Lots 1-3 and Special Review to allow an assisted living facility within a Residential zone. City Planner James Caniglia spoke regarding this annexation and special review. At this time there are 2 buildings that house 22 residents. RK Development's plan is to build 1 more building and expand the current 2 buildings. This change will bring the resident population to a total of 48 in 3 buildings. The property's general location is 1s` Avenue and W. 12th Street. James stated that when he advised the various city department heads of this venture they were in smrt of it. The Police Department would like to have control of 18` Avenue and W. 12 Street by this property being annexed. James stated that the Public Works department stated that there is no problem with this proposed facility hooking to current city utilities but all site improvements consisting of curb, gutter, sidewalk and approaches have to be done prior to a certificate of occupancy being issued by the City Building Official. There is a 20' utility easement that runs north and south in Block 1 Lot 1 of Ward Subdivision. There is a sewer line that runs in that easement that serves both Tender Nest buildings. This is not an alley, it is an easement and it will remain intact. There is a platted alley between the back of the existing Tender Nest and the old Clincher house that Public Works has decided needs to stay intact for future water line placement. James recommended approval of this project and feels that this is a good location because of its close proximity to the Laurel Medical Center and the addition of more density to a main arterial street. Randy Swenson from RK Development stated that he has had recent conversations with Allan Lees, the owner of the property on W. 12th Street that is not annexed in at this time. Mr. Lees stated that he is interested in annexing his property also. Chairman Linder asked if there were any other proponents wishing to speak. There were no other proponents. Chairman Linder asked if there were any opponents wishing to speak. There were no opponents. Chairman Linder closed the public hearing. Discussion by Planning Board. Motion by David Oberly, seconded by Dan Koch to recommend to the City Council approval of the annexation request for Ward Subdivision, Block 1, Lots 1-3 and Laurmac Subdivision, Block 1, Lots 1-5 for RK Development. The motion was carried by a vote of 7-0. James went on to state that the Special Review request for this property is to allow for the addition of an assisted living home and expansion of the 2 existing buildings within this Residential zone. James recommends approval. Motion by David Oberly, seconded by Hazel Klein to recommend to the City Council approval of the Special Review request for Ward Subdivision, Block 1, Lots 1-3 and Laurmac Subdivision, Block 1, Lots 1-5 to allow for the addition of an assisted living home and expansion of the 2 existing buildings within the Residential Zone. Discussion by the board. Dick Fritzler called for a vote on the motion. The motion was carried by a vote of 7-0. 2 Request to re-oven the meat rocessin plant located at 1421 Thiel Road. James stated that he has had a request to allowing the re-opening of the meat processing plant located at 1421 Thiel Road. The property is zoned highway commercial on one section and not zoned on the other section. The owners do not plan to slaughter the animals at this meat processing plant. Laurel Municipal Code 17.12.220(D) states that "where uncertainty exists, the district boundary line shall be determined by the zoning commission by written decision." A letter will be written to the person making the request that the City Planner along with the Chairman and Board members have determined that this piece of property should be deemed "un-zoned" and the meat processing plant be allowed. Allowing this meat processing plant will add needed jobs to the City of Laurel and surrounding area. Public Hearin - Consider Deleting 17.40.09 A 3 "No re uired Parking s ace shall be located in a front or side yard" This deletion is being considered because it is an older code that is not being used. It basically states that no front or side driveway access is allowed. By deleting it it gives us the option of requiring parking in the front. There was no public present for the public hearing. Motion by Hazel Klein, second by Deb Horning to recommend to the City Council that L.M.C. 17.40.090(A)(3) be deleted. Motion carried by a vote of 7 - 0. Public Hearin - Considering Addition to L.M.C. 17.20.020 - "Breweries: on allowed in Light Industrial and Hea Industrial" to add "are allowed also in Central Business District Highway Commercial and Community Commercial" This change is being considered to allow Breweries within the Central Business District, Highway Commercial and Community Commercial zones with specific rules and regulations being defined. There was no public present for the public hearing. Motion by John VanAken, second by Kathy Siegrist to recommend to the City Council that L.M.C. 17.20.020 be changed to add breweries being allowed in Central Business District, Highway Commercial and Community Commercial zones. Motion carried by a vote of 7-0. 3 Miscellaneous David Oberly asked for a clarification on a variance that the Planning Board considered and approved in June of 2007 regarding a 4-unit building at 1103 E. Main Street that had to be torn down after being hit by a vehicle. He remembers that the variance requested that a 4-unit building be allowed to be rebuilt. Upon his recent inspection he noted that a 6-unit building was built. He passed along the information to the Public Works secretary. It will be looked into by the Building Department and reported back to the board. The meeting was adjourned at 7:50 pm. Public Input There was no public present.
