ORDINANCE NO. 573
BEING AN ORDINANCE FINDING IT NECESSARY THAT ADDITIONAL LAND
AND REAL PROPERTY BE OBTAINED TO EXPAND AND IMPROVE THE
MUNICIPAL AIRPORT AND THAT CONDEMNATION PROCEEDINGS BE INI-
TIATED IN REGARD THERETO.
The City Council of the City of Laurel, a municipal corporation,
of Yellowstone County, Montana, in regular meeting assembled, does hereby
find, resolve and ordain:
THAT it is necessary for the said City of Laurel to expand and
improve its municipal airport, adjacent to the City;
THAT the public interest and necessity require that the said
Laurel Municipal Airport have additional land for runways and land for hangars,
repair shop and other necessary airport services and that the land and real
property hereinafter described are necessary for the enlarging and improving
the said municipal airport runways and service facilities and that said expan-
sion and improvement of said municipal airport is planned and located in a
manner which will be most compatable with the greatest public good and least
private injury; and
THAT the lands and real property which are necessary for the
construction of the additional runways and expansion of the airport facilities
and the known owners of the same, or any interest therein are more particular-
ly described as follows:
A portion of the West Half of Section Thirty-four (34),
Township One (1) South, Range Twenty-four (24)East,
M. P. M. , Yellowstone County, Montana, and more
particularly described as follows:
Beginning at a point on the west line of said Section
34 which bears North 0°21' West a distance of 30. 0 feet
from the southwest corner of said Secti?a 34; thence
North 0° 21 'West 2109. 0 feet; North 50 00' East 3434. 8
feet; South 0°201/2' East 1136.6 feet; South 50 00'West
2954.0 feet; South 0°21' East 1281. 5 feet and West 370.0 feet
to the point of beginning, containing in all 78. 55 acres, more
or less.
Reserving, however, and leaving with the defendants a
50 foot easement on the Northeast boundary of the premises
sought to be taken; said easement for access purposes for
the defendants' remaining lands, all as is shown on the
survey map.

THAT the above described tract of land constitutes a portion
of the tract of land; that there are no improvements located upon the same.
THAT the above described tract of land is owned, or claimed
to be owned by Philip Fox, Jr., also known as Phillip Fox, Jr., and Pauline
Fox, husband and wife.
THAT the City of Laurel, acting by and through its duly
authorized officers and employees, has made a fair effort to negotiate an
agreement for the purchase of the property as hereinabove described, but
that the said City of Laurel has been unable to reach an agreement for the same
and has been unable to acquire the same by purchase, at a cost which is
deemed reasonable by the City Council.
NOW THEREFORE, IT IS HEREBY ORDAINED AND RE-
SOLVED, that the City of Laurel, a municipal corporation, of the County of
Yellowstone, State of Montana, shall procure the necessary land and real
property in fee simple, as hereinabove described, by condemnation proceed-
ings, in the manner prescribed by law, on the landowner above named, and
any and all other owners known or unknown, owning said parcel of land or
interest therein.
Passed and approved this 15th day of March, 1966.
