Board of Adjustment called to order at 7:40 p.m., with the follo~ing
members present.:

FILE # 87-03 QUESENBERRY: A variance has been requested on Lot 16,
and the N% of Lot 17, Block 25, of Laurel Realty Second Subdivision,
R6000 Zone, to allow fence construction of a non-conforming use~
giving relief for the setbacks. The property is located at 520
Washington Avenue, Laurel, MT.
Petitioner present: Fees paid. Advertised in the Laurel Outlook
7/22/87 and 8/5/87. No protests received.
Andy Muri asked if fence was going on the property line or inside
the property line? Question to Cal, do they need a variance between
the corner and the adjacent property line, and how about all the way
to the alley?
Cal Cumin They may. go 6' from the alley to the front of the house.
Quesenberry from the beginning they wanted a 6' board fence on the
property line south to their neighbors to the alley, from the alley
to the property line north to the back of their home. Since that
time they've spoke with their neighbor to the south of them, Mr.
Frickle and he stated he objected to a 6' board fence and would
protest it. They reached an agreement that a 4' board fence would
be acceptable. Quesenberry stated he wants to get along with his
neighbors. So now they would like a 4' wooden privacy fence on the
south side of their property, bordering East 6th Street.
Cal Cumin city ordinance states along East 6th Street 3' wooden privacy
fence or a 4' chain link see through. Quesenherry's want a 4' privacy
fence from the alley to the corner of their home.
Quesenberry's states they have alot of trouble with children on top
of their garage, wood pile and trouble with dogs.
Andy Muri is concerned about the visibility on the alley corner. Its
a 20' alley but what about restrictive sight. Are you putting the
fence up between the neighbors also?
Quesenberry Yes,
6' full length then North to the house. Want
on alley property line then keep it even with the garage and
attach it to the garage on the building line.
Bruce Teeters You want 6' between neighbors to the North of you?
Quesenberry Yes.
Cal Cumin there are 2 variances being asked here. 1. Change 3'
wooden fence to 4' wooden fence. 2. Change 3' to wooden 6' from
house to alley.
Quesenberry the reason they asked for this is because the existing
buildings are already blocking view on the street and alley ways.
Cal Cumin reason for 3' fence on a paralleling street is not because
it blocks the view but because of the esthetics involved when you
drive along a see just fence.
Curt McKenzie as far as esthetics are concerned they brought it out
to be voted on by the neighbors and no one has heard from them.
I'm for a 6' all the way.
Cal Cumin Curt you cannot administer City Ordinances by neighborhood
consensus.
Curt McKenzie your right but we're the ones that can do it and make
it work.
Cai Cumin I recommend not doing it. ~
Quesenberry states they need privacy-all the houses on the north side
face their back yard.
Curt McKenziemotioned for 6' except that portion between the garage
and the Northeast corner of the house to be a 4' privacy fence.
Seconded by Bruce Teeters. Motion carried 5--0.

WHEREAS, after due and legal notice of the application
was given Pursuant to law, and a hearing on the same was held
before the Board at /ts general meeting on the]]+h day of
August , 198 7 ; and,
WHEREAS, after full consideration of the same by the
Board at the said meeting, it was moved by
seconded by E. Teeters, to graht the application for vartancel
and the said motion was passed/defeated by a vote of 5 in
favor and 0 opposed (State law requiring that the concurrence
of at least 4 Board members is required to grant any variance.)

NOTICE IS HEREBY GIVEN that the Board of Adjustment of
the City of Laurel, Montana, will hold a public hearing on
Tuesday, August 11, 1987, at 7 :30 p.m. , in the Council Chambers
of City Hall, Laurel, Montana, for the purpose of reviewing
the following variance from the Comprehensive Plan:
A variance has been requested on Lot 16 and the N15 of
Lot 17 Block 25 of Laurel Realty Second Subdivision, R6000
zone, to allow fence construction of a non-conforming use,
giving relief for the setbacks. The property is located at
520 Washington, Laurel, MT.
Information concerning the application can be obtained
at the Office of the City Engineer, City Hall . Anyone wishing
to protest the application may appear at this hearing. Any
party may appear with or without counsel .
