HomeMy WebLinkAboutBoard of Adjustment Minutes 09.13.1988BOARD OF ADJUSTMENT LAUREL, MONTANA 59044 Sept. 13, 1988 The Board of Adjustments was called to order at 7:45 with the following members present: Andy Muri, Chairman Bruce Teeters Bob Western Don Cahill Cal Cumin Joe Bradley Members absent: Others present: Claude Cory Cheryll Lund, Secretary Roland Wright, 302 Forrest Avenue, Laurel File # 88-07-Wriqht Petition present. Fees paid. Advertised in the Laurel Outlook two times, 8/24/88 & 8/31/88. No protests received. Mr. Roland Wright of 302 Forrest Avenue is requesting a variance to build a carport/shed onto his existing garage. Mr. Wright has lived at this address for approximately 6 years. He plans to use the extra space for his own storage. Mr. Wright's lot is 30' X 120' and located on the corner of Forrest Avenue and South Third Street. The Laurel Municipal Code states that any structure over 3 feet high must meet a 20 foot setback, on a corner lot. Mr. Wright's garage is built 4 feet away from his West property line, and right on his property line on the North side. The Code is very specific on not allowing an expansion of an existing violation~ The garage is in violation now. Mr. Wright says he plans to stay in this house and is not building it to enhance his property, he just plain needs the space. Ail property owners within 300 feet of Mr. Wright's property were notified by mail. Of the 50 letters sent out, 2 were unclaimed, and 6 people came into the office to inquire. Out of the 6, all were in favor of granting the variance. At this time a question is raised concerning the curb cut. Mr. Wright states that he will contact the City Engineer regarding this matter. Cai feels that this variance should not be granted. He states that there is no hardship involved. Bruce Teeters feels that there is a hardship involved because if Mr. Wright tore down his existing garage he wouldn't be able to build another one. At this time Mr. Wright is asked whether or not he uses the welder, which was noticed sitting alongside his garage, for profit. Mr. Wright stated that he does do some odd jobs with his welder but does not plan to open up a shop. There is some question as to whether or not he should obtain a City business license. At this time the Board members go down the list of considerations when granting a variance. All 7 sections are gone through. Motion by Bruce Teeters to grant the variance in reference to Section 17.12.140 of the Laurel Municipal Code A through G. The applicant requested expansion of an existing building that was built prior to the enactment of the zoning ordinance, and the majority of unattached buildings within that area do not meet current setback requirements.
