The meeting of the City of Laurel Board of Adjustment
· was brought to order at 7:35 p.m. with the following:.
members present=:

Glenn Bies, 1017 llth Avenue.,
Laurel, Mt.
File # 89-02- BIES
Petitioner present. Fees paid. Advertised in the Laurel
Outlook 2 times, June 21, 1989 and June 28, 1989.
Mr. Glenn B/es of 1017 llth Avenue has made an application
for a variance to build a double car garage on the south
side of his property at 1017 llth Avenue, Laurel, Montana.
United Building Code states that a 5 foot setback is required
on a sideline property line. Mr. Btes garage will be 20 feet
wide, which will place it 2 feet from the property line..
This.is why Mr.. Bies applied for a variance.
Mr. Bies states that his neighbor to the South, Jerry Jones,
has no problem with what he wants to do, and has brought a
letter stating such.
A question is raised about whether Mr. Bies will still build
the garage if his variance is denied. Mr. Bies states yes.
Joe Bradley reminds the Board members that they need to go
through Ordinance 17.12.040, A-G, to determind whether this
variance should be denied or granted.
Cai Cumin recommends that this be denied because there is
no hardship. He feels that by granting this variance we
would be opening up the opportunity to other people wanting
to build within the required setbacks.
At this time some options as to what Mr.
the variance were denied:
1)
Bies could do if
re-plat the subdivision, a costly project and more
than likely would create more problems.
2) build a'smaller garage.
3)
build a garage off the back alley, which would
be less excessible and harder to do because of
the landscaping.
Motion by Bob Western, seconded by Claude Cory to
deny the variance to Mr. Bies. Motion carried 5--0.
The meeting was adjourned at 8:03 p.m.

WHEREAS, an application for variance was f~led with this
Board by Glenn B/es , on the 15th day of
June 198 , being designated to be file No. 89-02
WHEREAS, after due and legal notice of the application
was given pursuant to law, and & hearing on the same was held
before the Board at its meeting on the 13th day of July
198 ~ and,
WHEREAS, after full consideration of the same by the Board
at the said meeting, it was moved by Bob Western
seconded by Claude Cory , to ~ the application
for vartance~ and the said motion was passe~/=~4~[ by a vote
of 5 in favor and 0 opposed (State.law requiring that
the concurrence of at least 4 Board members is required to grant
any variance).
IT IS HEREBY ORDERED, that VARIANCE APPLICATION NO. ~
IS HEREBY= GRANTED
