The Board of Adjustment meeting of August 8, 1989 came
order at 7:30 P.M. with the following members present:
Andy Muri, Chairman
Claude Cory
Bruce Teeters
Bob Western
Johnny Goodman

Petition present. Fee paid. Advertisements appeared in the
Laurel Outlook July 19th and 26th, 1989. No protests.
Clay and Mary Jo Devener of 1006 Betty Avenue have applied for
a variance to be allowed to put up a 6 foot high fence 6 feet
into the required 20 foot setback requirement.
West Maryland Lane dead ends right beside their house, parallel
to their back property line, and Betty Avenue dead ends in front
of their house, so no other neighbors would be affected by their
proposed fence. Also, all the houses on West Maryland have only
a 10 foot setback. The Council changed the setback requirement
in that area about 2% years ago, to 20 feet, right before their
house was built. So, all other houses in that area are setback
only 10 feet.
If the Deveners were not allowed to build the fence within the
20 foot setback they would have to tear up and relocate 2 of
their sprinkler heads, as they would be located right on the
allowed fence line. They would also have to remove and relocate
a swingset that is set into cement.
The adjacent property owner, Jerold Cantrell, who owns about 22
acres to the West and Northeast, has made a request to the City
to allow him to deannex 18+ acres out of the City. This will
be a decision by the City Council as to whether he will be
allowed to do this. If the deannexation does happen Mr. Cantrell
plans to run cattle on that acreage. This would mean that the
land will not be developed into residential area for some time,
and there would be no neighbors directly affected.

Motion by Bruce Teeters, seconded by Claude Cory to grant
requested variance. Motion carried.
The meeting was adjourned at 8:00 P.M.
