HomeMy WebLinkAboutBoard of Adjustment Minutes 07.10.1990BOARD OF ADJUSTMENT LAUREL, MONTANA 59044 July 10, 1990 The July 10, 1990 meeting of the Board of Adjustment came to order at 7:30 p.m. in the City Hall Council Chambers with the following members present: Andy Muri, Chairman Bruce Teeters Marvin Carter Bob Western Johnny Goodman Others present: Cal Cumin, City Planner Joe Bradley, City Attorney Cheryll Lund, Secretary Phyllis Mitchell, 520 3rd Ave. Bruce Wagner, 722 W. 7th File ~ 90-03. Phyllis Mitchell, 520 3rd Ave. Mrs. Mitchell spoke on behalf of her application to build an addition onto her house at a 5 foot setback instead of the required 20 foot setback. Mrs. Mitchell states that her house is very small, and she would like to have a 16~ X 18' addition built that would be used for a bathroom and bedroom. Her house is set back 5' from the property line, as are most of the other homes in the area. If the addition were built at the required 20' setback it would only be a 5 foot wide room, which wouldn't be useable. Joe states that all the houses in that area are setback 5' because that was what was required when the houses were built. Mrs. Mitchell estimates the house being built in the 1940's. Cal states that he can't recommend approval because it is going against the codes, but on the other hand he hates to discourage anyone from making an improvement to their home. Bruce Teeters states that Mrs. Elsie Johnston, 561 3rd Avenue, is unable to attend the meeting but did s~ate that she and several of the neighbor's have talked about Mrs. Mitchell's request and have no problem with it. Motion by Marvin Carter, seconded by Bob Western, that the application be approved. Motion carried 5--0. Respectfully submitted, Cheryll Lund, Secretary BOARD OF ADJUSTMENT LAUREL, MONTANA RE044 WHEREAS, an application for variance was filed With this Board by Phyllis Mitchell , on the 15th day of 90 June . 196 being designated to be file No. 90-03 WHEREAS, after due and legal notice of the application was given pursuant to law~ and a hearing on the same was held before the Board at its meeting on the 10th day of July 9O 198~ and, WHEREAS, after full consideration of the same by the Board at the said meeting, it was moved by Marvin Carter seconded by Bob Western , to grant the spplication for variance; and the said motion was passed/~Y~ by a vote of .~ in favor and 0 opposed (State law requiring that the concurrence of at least 4 Board members is required to grant any variance).
