BOARD OF ADJUSTMENT
JUNE 8, 1993 7:30 P.M.

~ariance #93-01. Bernard Bray- 1018 llth Avenue.
A variance has been requested on Lot 11, Block 3, Cherry Hill
Subdivision, address being 1018 llth Avenue. The variance would
allow a garage to be built within the required 5 ft. sideline
setback.
Clark Johnson was present as the Agent for Bernard Bray. He
submitted a letter signed by Marcia Bray stating that Clark was
acting in their behalf.
Clark stated that Mr. Bray has contacted him to construct a double-
wide garage that would be attached to the house on the north side.
The neighbor on that side has a garage located 10 feet from the
same property line. The Bray's garage would be within 2' 6" of the
property line (of which I foot is the roof overhang). That would
make a distance of 13 feet (approx.) between the two buildings.
Question on lot size? This lot is 75' wide by 140 ' deep. Cal
states that this lot is larger than the average City lot.
Marvin Carter asks what would of happened had they of built a
garage on this home when the home was originally built? Cal states
that they would Of adjusted the house size down to enable them to
put on a double garage.
No objections or protests were received on this application. Clark
states that the neighbor to the north has stated that he would like
to see this proposed garage built.
Johnny Goodman questions what would happen if the neighbor to the
north would decide to expand his garage? Then the two buildings
would be less than the required distance away from each other.
Johnny Goodman questions why Mr. Bray can't change the plan to a
single garage? Clark states that the applicant wants a double
garage so he can park both cars in it.
Question about putting the garage behind the building? Clark
states that the owner does not want to put the garage in the back.
He has a satellite dish that he.wants to leave in place. The owner
would go back to a single garage before he built in the back of the
lot.
Cal states that he cannot find any good reason to grant this
variance. He read the Ordinance pertaining to the granting and
denying of variance's.
This lot is just like every lot in
have double wide garages, some have
put the garage in the backyard.

this one that the Board turned down in 1989 (Glenn Bies at 1017
llth Avenue). Also, the Board of Adjustments requires four
concurring votes. If there are not 4 concurring votes the
application is automatically denied.
Motion to deny the varianoe made by Bob Western, seconded by
Johnny Goodman. After a roll call the motion was defeated due to
a vote of 3--1. (There were not 4 concurring votes)
The meeting was adjourned at 7:45 p.m.
