HomeMy WebLinkAboutBoard of Adjustment Minutes 08.17.1994BOARD OF ADJUSTMENTS CITY OF LAUREL, HONTANA The Board of Adjustments of the City of Laurel, Montana, met on Wednesday, August 17, 1994 at 7:00 p.m. with the following members present: Andy Muri, Chairman Bruce Teeters Bob Western Marvin Carter Johnny Goodman Others present: Cal Cumin, City Planner Doris Brown, 420 Montana Doug & Wendy Strauch, 420 Montana Kelly Strending, 301 W. Main Todd & Michelle Linder, 602 2nd Avenue Alice Schreiner, 706 2nd Avenue Pam Thatcher, 702 2nd Avenue Donna Kilpatrick, 814 1st Avenue Richard & Grace Caudillo, 617 2nd Avenue Stephanie Goodman, 316 Cedar #3 Bruce Edwards, 601 3rd Avenue %94-02- BROWN- 420 MONTANA. SETBACKS. Fees were paid, and the required advertisements were done. protests or comments were received, either written or oral. No The applicant is asking to build a garage the dimensions of which would violate setback regulations. The owner would like to tear down the existing single car garage and build a larger garage. Wendy Strauch spoke concerning the application and gave a list of hardships to the chairman. (see attached) She also provided a list of properties within the area that are also violating setbacks. (see attached) Cal states that the lot is 4800 square feet. Their buildings are presently in violation of setbacks on 3 sides, and with the new garage would also be in violation of the lot coverage requirements. Cal recommends denial of the application. Because of the limitation of the applicants existing lot, the existence of several other properties in the neighborhood that already violate setbacks, and the fact that a new structure would increase the value and improve the appearance of the area, a motion was made by Marvin Carter, seconded by Johnny Goodman, to grant the variance, subject to the new garage not extending any .further to the sidewalk than the existing garage does. Motion carried 4--1 with Teeters voting "NO". #94-03. LINDER- THE DESIGN HAIR STUDIO. APPEAL OF PLANNING DIRECTORS DECISION. Fees paid. Advertisements were made. tither written or orally. No protests were received Johnny Goodman will abstain from voting due to being a relative of the applicant. It was noted that the name of the hair studio is The Design Hair Studio and not The Hair Design, as advertised. The address in the ad was correct, which makes the advertisement legal. Todd Linder spoke concerning the application. There will be change on the outside of the building and no change in zoning. They have plans for 1 tanning bed. no A petition in favor of the variance was presented to the Chairman. Bruce Edwards of 601 3rd Avenue spoke in favor of the application. Richard Caudillo of 617 2nd Avenue and Alice Schreiner of 706 2nd Avenue spoke in opposition of the variance. They are against it unless it means there will be no change in the zoning. Motion by Bruce Teeters, seconded by Marvin Carter, to approve the variance to allow the tanning bed for the Design Hair Studio. Motion carried 4--0 with Johnny Goodman abstaining. ~espectfully submitted, Cheryl1 Lurid, Secretary 2 HARDSHIP REASONS I) We have 3 vehicles which are currently parked on the street. We would like to be able to park at least 2 of them in the garage. One of these vehicles is an extended cab pickup which is 19 feet long. 2) We would like to make the garage a little larger so we would have enough room for children's hikes, lawnmower, etc. and still park two vehicles inside. This would utilize the lot space better and prevent us fi.om having to have a shed also. 3) The lot that the house sits on was subdivided in the past and is small. Therefore, we can not abide by the current codes. That is the reason for the variance appeal. If we did have to push the garage back any further than on the drawing, we would then have a problem with the back door entrance. 4) We have found it very difficult in the past to park near our home at the close of the school day due to all the traffic at that particular time. By having a double garage, this would alleviate the parking problem. 5) We found several examples of existing garages that sit close to the sidewalk. Many of these are located on comer lots where the fi.om door faces the "main" street and the garage faces the other side street which is the same situation we have. (Please see attached list).
