OLD COUNCIL CHAMBERS MEMBERS PRESENT: OTHERS PRESENT: Andy Muri, Chairman Bruce Teeters Bob Western Marvin Carter Cal Cumin, City Planner Cheryll Lund, City Secretary Les Riddle, 804 W. Maryland File 97-10. Les Riddle, 804 W. Maryland Les Riddle, 804 W. Maryland has applied for a variance for the relief of the side property line setback by 18 to 24 inches, in order to build a 20' X 30' double garage. The foundation wall of the garage would be set right at the 5' setback. The eave would be within the required setback. When the house was originally built it was placed within the required setback on his property which resulted in him only being able to put a single wide garage in while adhering to the side line setback of 5'. Les stated that he has looked into the option of putting the garage behind the house in the alley but it would take his yard down to approximately 25' x 36' Cal Cumin recommended that the application be denied due to no hardship. He reminded the board that fire code designates a minimum of 10' between buildings. (5' setback on each property) Andy Muri feels that there would be no problem with the eave within the setback because it would only be a maximum of 24" over the required 5'. Bob Western questioned why Les couldn't build the garage without an eave? Les stated that he wasn't sure that the building code would allow him to build without an eave, but he is willing to check with his contractor to see if it is possible. Motion by Bruce Teeters, seconded by Bob Western, to deny the application to build within the required setback. Motion carried 4--0. WHEREAS, after due and legal notice of the application was given pursuant to law, and a hearing on the same was held before the Board at its meeting on the 5th day of August, 1997; and WHEREAS, after full consideration of the same by the Board at the said meeting variance No. 97-10 herein was granted~by the following vote: ~-~. (State law requiring the concurrence members is required to grant any variance); IT IS HEREBY ORDERED, hereby: of at least that Variance application No. Granted, as stated above.
