COUNCIL CHAMBERS A Council Workshop was held in the Council Chambers and called to order by Mayor Tom Nelson at 6:30 p.m, on January 9, 2018. General Items • Appointment of John Beck, David Walters, Jesse Gee, and Jayson Nichols to the Laurel Volunteer Fire Department. Fire Chief Brent Peters introduced the new firefighters to the Council. They have passed both the selection from the Fire Department and from the Fire Chief, this will bring the total volunteers to 44 out of 45 slots. Mayor Nelson questioned if any were qualified as EMT's. Fire Chief Brent Peters stated no they are firefighters. Mayor Nelson stated tha.t in his opinion the Laurel Volunteer Fire Department is the best in the State. *There was a misspelling on the letter the City received. Jayson Nichols should be Jayson Nicholson. • Appointment of Johnathan Wayne Simpson and Nick Vito Buciuman to the Laurel Police Reserves. Mayor Nelson stated that Police Chief Musson and the appointments aze not present tonight. Bruce clarified that these appointments were supposed to be on last weeks agenda and that training had begun. • Mayor Appointment Memo Council Workshop Minutes of January 9, 2018 o Mayor Appointment: Budget/Finance Committee: Emelie Eaton, Bruce McGee, Scott Stokes and Richard Klose. o Mayor Appointment: Emergency Services: Richard Klose, Irv Wilke, Bruce McGee and Bill Mountsier. o Mayor Appointment: Public Works Committee: Emelie Eaton, Bill Mountsier, Richard Herr and Heidi Sparks. o Mayor Appointment: Cemetery Commission: Richard Klose, Richard Herr o Mayor Appointment: Pazk Board: Scott Stokes, Irv Wilke, Richard Herr o Mayor Appointment: Tree Board: Richard Herr o Mayor Appointment: Health Insurance: Bruce McGee, Heidi Sparks Mayor Nelson stated he was sworn in on the 3rd of January as the Council had appointed him Mayor. He knew Budget/Finance would need to meet to pay bills. Per the advice of the City Attorney, he signed a memorandum appointing Council Members to each committee. These appointments had been discussed and agreed upon by both Mayor Nelson and Council President Eaton. These appointments were made as of the 3fd of January. Council will vote to approve the memorandum at the next Council meeting. Mayor Nelson stated that he would be encouraging each committee do work within their scope to bring recommendations forward to Council. Executive Review • Resolution—Riverside Park Master Plan—Public Hearing scheduled for 1.16.2018. Mayor Nelson reminded Council that the Public Hearing for the Riverside Park Master Plan is scheduled for January 16, 2018. The Riverside Park Master Plan requires public comments to be part of the plan. Therefore, the Council will not be voting on this resolution next week. Those comments will be added and brought back to Council at the Workshop on January 30`h to be voted on at the February 6`h meeting. Noel Eaton, City Planner, stated that she would have a PowerPoint ready to present to Council and the Public regarding the Riverside Park Master Plan. The Riverside Park Master Plan was created to provide a comprehensive framework for the pazks future and its use. It is also used to provide a basis for different funding opportunities. The City partnered with Great West Engineering and created an advisory committee with members of the community. They had an open house in August with more than 100 attendees. There were posters set up with different ideas for the park. Attendees were to rate each as important/neutraUleast important. The top priorities were water and restrooms, restoring historic buildings, RV camping and the continuation of shooting in the park. The plan calls out for a champion to bring forth a plan of how they will restore the building(s). Noel handed out the requirements for a proposal and asked Council if there was anything additional they wanted on the Requirement Form. A priority list has been established and a timeframe in which to do projects. This plan is good for the next ten years. It offers a conceptual layout of the park. The plan includes cost estimates for each project as well as different funding opportunities. The Park Board has recommended this plan to the CounciL Emelie questioned what voting to approve this plan means, such as is this plan cast in stone and required to follow the timeline given. Noel stated that the plan is to be reviewed each year and that if funding opportunities become available that the City should pursue those opportunities. She encouraged Council to send all 2 Council Workshop Minutes of January 9,2018 feedback on what they like and don't like to her so she can pass this information onto Jerry. The plan is meant to be a working document and therefore, not cast in stone. Mayor Nelson stated this is similar to the Growth Plan, which is a document that identifies what areas we want and need growth. The Council needs to review that document every five years. The Riverside Park Master Plan is a plan the City would like to follow,but it is flexible. Heidi questioned if the City had received any money from the Exxon Mobile settlement or was this plan was to obtain money from that settlement. Kurt Markegard, Public Works Director, stated that no money had been distributed to anyone from the settlement. They are working on the final review, and final recommendations will be going out later this month. The City had anticipated installing a new water line across the bridge to allow for camping within the park. Kurt spoke with Alicia, and it was not recommended to use those funds towards that water line. The City was commended for having such a well-established plan for the park. He gave an update to the Park Board last week, and they are working on updating the cost. Emelie questioned who is Alicia and who is she associated with. Kurt clarified that Alicia is from the Department of Justice. Mayor Nelson stated that this plan allows the City to have a clear vision of the Park with clear projects and the cost associated with those projects. • Resolution—Turkey Shoot Mayor Nelson clarified that this agenda item is not a resolution but just a motion. He explained that Irv Wilke is the president of the Laurel Rod and Gun Club, he also sits on the Council. There was a question if Irv could vote on this issue. Mayor Nelson spoke with the City Attorney who stated as long as Irv is not receiving any monetary gain from this event then there is no conflict. He further clarified that if Irv needed to abstain from voting, he would do so during the Ex Parte portion of the Council agenda. Irv questioned if he needed to resign as the President of the Laurel Rod and Gun Club. Mayor Nelson stated there is no issue as long as there is no personal gain. Mayor Nelson requested Irv to present this agenda item to the Council. Irv stated that the following dates are reserved for the Turkey Shoots, February 18th and March 18tn with an alternate of April 1�`. Shooting would take place from the hours of 9 a.m. to 4 p.m. following all the rules set forth by the City in the lease. Emelie questioned if these are the last shoots to be presented to Council. Irv stated there would be one more shoot this year. The third one will be a membership party and will be done before the expiration of the lease. That letter will be coming later in the year. Emelie questioned if April 1�` is Easter, it is Easter. 3 Council Workshop Minutes of January 9, 2018 Irv stated that they would do what they can to have the Turkey Shoots as scheduled. They have in the past cleared snow and shot on cold days. • Resolution— Garbage Truck Mayor Nelson stated that the Solid Waste Department has been saving to purchase a garbage truck for quite some time. He asked Kurt to present to Council. Kurt stated that the City went out for sealed bids in December of 2017 and closed on December 28, 2017. The City received ten bids. There were three manufacturers of trucks, Peterbilt, Mac, and Autocar. There were four manufacturers of bodies, Wayne Curbtender, Bridgeport, Heil, and Amrep. Kurt wrote a letter to the Mayor, which are included in these minutes. The lowest bid was for a Bridgeport body for $255,548, but no camera system was included. The cost of the truck after the camera upgrade would be $258,150.40. The City has not demoed a Bridgeport truck, they have reviewed via YouTube. Matt contacted the seller of the body to schedule a demo. The closest truck to the City is in Gillette, weather pernutting Matt and a truck operator will travel to Gillette tomorrow, January lOth, to demo the truck and submit a final recommendation to the Council. The tentative recommendation is to purchase a Wayne Curbtender truck as the City already owns two, they are working well, and the mechanic is proficient in repairing the truck. The Public Works Department is going to attempt to demo the Bridgeport as it is the most cost-effective option. They have demoed a Heil refuse truck and have an operator who has ran an Amrep and had a good understanding of both these options. There are no Bridgeport trucks in the State of Montana. The packets of info given to Council contain pictures of what each truck looks like. The last truck purchased was a Wayne Curbtender on a Peterbilt truck for the price of$250,833 six years ago. The price for the same truck has increased two percent per year. Mayor Nelson clarified that as City Council they do not have to accept the lowest bid. However, staff needs to provide sufficient evidence that the additional expenditure will provide better service to the City. Emelie questioned if regardless of which truck is recommended to the Council the Solid Waste Fund has this expenditure budgeted. Mayor Nelson stated conect. Kurt stated that the City had projected the cost to be $300,000 and all bids came in under this projection. Richard Klose questioned if the new truck would replace an older one or if this was an addition to the fleet. Matt Wheeler, Maintenance Superintendent, stated that garbage collection is done six days a week perpetually. This service will be here forever. The City currently has four trucks, two for daily use and two for backup/heavy use days. The City has not had many issues with the Wayne Curbtender trucks. The City has a dump body on a non-operational truck. They would like to take the oldest of the refuse trucks and switch out the dump body from the non-operational truck. The green trucks are the older of the fleet and kept in working order in the event of a breakdown. Bill questioned why the City likes the Wayne Curbtenders. 4 Council Workshop Minutes of January 9,2018 Matt stated that the City had owned Wayne Curbtender trucks since 2010. The mechanic is proficient in working on these trucks. The company has been easy to work with and has overnighted parts when needed. They have been a very reliable truck. There is a concern that the closest Bridgeport truck is in Gillette Wyoming. He stated he is uncomfortable spending this amount of money on a truck the City has never demoed. Kurt stated that Tuesday is the big day for the Solid Waste Department. When a holiday falls on a Monday, the City will run three trucks on Tuesday. If one breaks down, then all trucks would be in use. Matt stated that there had been days when the City is down to one garbage truck due to one thing or another, usually weather related. Mayor Nelson stated that if you sit on the Council long enough, you will see this again. Matt added that the regular rotation is about seven to eight years. The Council should not see this brought forth for another seven to eight years. Irv questioned if both were on the Peterbilt trucks and if cameras would need to be added to the Wayne Curbtender. Matt stated that the cameras were included in the bid. Bridgeport had not worked with the City before and did not know the City wanted cameras included in the bid. Bill questioned if the cameras are on there for safety reasons. Matt stated correct, not only for the operator but the people and their property in the vicinity of the truck. Also that in the event of an accident the City has done all that it can do to make sure it is the safest vehicle to operate. Bruce questioned if the trucks are closed in the back so garbage cannot fly out on the way to the landfill. Matt stated that the Wayne Curbtenders do have lids and very rarely has garbage flown out. The City gets very few calls anymore. Kurt stated that the two older green trucks, Heil, still do this. When the City purchased trucks in 2010, Heil did not have a lid system, so the City purchased the Wayne Curbtender. • CouncilIssues: o Update on 2011 Yellowstone River flooding event Kurt stated that the Army Corp of Engineers (ACOE) permit for wetland around the pipeline and a culvert that was installed on CHS's property. The ACOE sent out a letter in October or November stating that a survey would need to be done along that route to see what the impact has been on the wetlands. The City has gotten estimates for this survey. The City has asked for an extension with Heidi leaving and a new Mayor coming on board. Kurt has taken over the pernutting for this process. 5 Council Workshop Minutes of January 9, 2018 Mayor Nelson stated that the City is asking for clarification on if Great West needs to facilitate this survey or if a third party can perform the survey. Mayor Nelson stated that the City has to wait for the audit to be finalized before getting the remaining FEMA money released. There is also question on the States 25 percent match. The City has a SED Basin project that is desperately needed,but not feasible. Mayor Nelson stated he would work towards keeping this process as transparent as possible. Emelie questioned how the intake is running and if the checklist is completed. Kurt stated that Tim Reiter has been sick and has not gotten an update today. They recently lowered a pump that provides hot water to the intake. The pump was possibly wired backward. The river is currently full of ice and backed up. Bill questioned why the pump was wired wrong and was it that way from the factory. Kurt stated that no the wires going to the pump were wired wrong. He would like to have Council take a tour of the water plant. Bill questioned who wired the pump. Kurt stated the subcontractor, Canyon Electric. Mayor Nelson stated that there would be a tour of the facility this spring when it is warm and before high waters, possibly May or June. Kurt will get an update and report at the Public Works Committee meeting on January 22"a Other Items Mayor Nelson stated there is an online class through the Local Government Center. Mayor Nelson stated this class is a ten-week class. However, this class is only six weeks and starts on January l Oth All newly elected Council Members will be taking this class along with the Mayor. All other Council Members will be taking this class this fall. Irv stated that Park Board has recommended to re-write the lease for the Laurel Horseshoe Club which has nine members. The most current lease is from 1983. They would like it to be a 5-year lease at $60 per year. Mayor Nelson stated that this item will be taken to the City Attorney and added to the Council Agenda. He also clarified that items such as this recommendation should be brought up under the agenda item "Announcements." Review of Dra$ Council Agenda for January 16, 2018 There were no changes. There were no comments regarding not being able to attend the next , meeting. ' Announcements Heidi stated that the CHS Refinery's turnaround is coming up. There has been concern regarding traf�ic flow on the south side and if this can be on the January 30th Workshop. Mayor Nelson stated this item will be on the next Workshop and will request input from Public Works and the Police Department. �� Richard Herr asked for an update on where the City is in the process of hiring a new Chief ' Administrative Officer. � � Mayor Nelson stated the City has gone through the process of interviewing applicants. Emelie stated that there would be a Public Works Committee meeting on January 22°d at 6 p.m, Emelie stated that with the high turn over within the Council there had been confusion on who should chair the committees. Mayor Nelson has requested her to determine who should be the chair of the committee so the Mayor can appoint a chair to the committees. Nelson, Mayor On December 28, 2017 the city opened bids for a new cab-over side-load refuse truck. Three I different companies submitted ten options for the city to consider. The truck chassis are limited �� to three manufactures which are Autocar, Mack, and Peterbuilt. The city received three body � options for the Autocar truck, four body options for the Mack truck and three body options for � the Autocar truck. The Bridgeport body on a Peterbilt Truck is the least expensive bid but it is the least compliant to the city's specifications. Mr. Wheeler will be taking a refuse truck operator to view this truck in action. Mr. Wheeler will then report back to me if the Bridgeport/Peterbilt truck is in the City's best interest. The weather is calling for snow and if Mr. Wheeler encounters bad road conditions he may not be able to try out this truck on Wednesday. I will let you know if other arrangements can be made to demonstrate the Bridgeport Truck. Currently the city owns two Wayne Curbtender refuse trucks with one on a Peterbilt truck(2012) and one on an Autocar truck (2010). The City also owns two Heil refuse trucks one on an Autocar(2004) and one on a Volvo (1997). These older Heil trucks are used as backups during scheduled maintenance and breakdowns. I have attached the supporting documentation to this letter that shows pictures of the submitted trucks, the bid tabs and the bid individual sheets. If Mr. Wheeler can view the Bric�geport truck tomorrow, I should have the final recommendation to you by Thursday. The proposal shall be reviewed by the Parks Board with a I recommendation forwarded to the Laurel City Council. The applicant must also provide a �I presentation of the proposal to the City Council. A Riverside Park building restoration proposal must include the following; • General Applicant information (Name of Applicant(s), phone number, address,email) • Building description and location: • Describe the current condition of the building including, but not limited to,the roof, bathrooms, flooring, mold and water damage,furnace/heat supply(include pictures and detailed descriptions) • Is any remediation(mold, lead, asbestos) needed, if so please describe how this will be done. • Describe the proposed improvements(include any pictures,drawings, renderings and site plans) • How will the project comply with Floodplain Regulations • Has a floodplain permit been applied for with the City's Floodplain Administrator? • How will the project comply with Building,ADA and Fire Code requirements? • How will the building be supplied with adequate water and wastewater supplies? • How will maintenance of the building be handled? • Provide a detailed cost estimate of all proposed improvements and how the project is being paid for. • Timeframe and estimated completion date of project • Proposal for future lease agreement with the City(must be reviewed and recommended by City Attorney prior to the Parks Board's recommendation to Council)
