COUNCIL CHAMBERS Members Present: Doug Poehls Scotty Snowden Chuck Dickerson Others Present: Greg Brown Jan Faught Brad Kimble Rick Musson Scott Wilm There was not a quorum present at the meeting. Fire District Agreement Discussion of the agreement after it was reviewed by the attorneys. A memo was received from the City Attorney Sam Painter referencing 3 issues, building description, termination and insurance. 1. A map of the Cenex property will identify all buildings on the east side of the highway as being included in the Fire District Agreement. The buildings on the west side of the highway will stay under the Mutual Aid Agreement, which includes anything inside of the refinery walls. 2. Cenex wanted to change the number of days each party had if desiring to terminate this agreement from 30 to 60 days. Cenex will agree to remain with the 30 days. 3. Cenex requested to be named as additional insured on the city's policies. City's insurance, MMIA, denied this request. Cenex has agreed to pay an annual fee of $9,500.00 per year (payable in two semi-annual payments) for the Fire District Agreement. Cenex would like to have both the Fire District Agreement and Mutual Aid Agreement approved at the same time. The meeting was adjourned. Respectfully submitted, Neva Hall Secretary
