RE: Underground Fuel Storage Tanks
The MMIA Liability Memorandum of Coverage and Pollution Coverage Documents exclude coverage
for Underground Fuel Storage Tanks. MMIA does not offer coverage for the potential pollution events
associated with these facilities. Coverage for underground fuel tanks exists through the permitting
programs of the State of Montana / Department of Environmental Quality or with other private carriers.
Municipalities who have State of Montana permitted underground fuel storage tanks are beginning to
see requests for permit renewal. Under sub-chapter 8, Arm 17.56 the Montana Department of
Environmental Quality is authorized to establish a permitting process. Many of our members have
begun to inquire if we provide any coverage for the underground fuel storage tanks. This coverage
has been excluded because of its availability under the state program.
The state's permit renewal process requires a financial assurance mechanism to demonstrate your
community is fiscally capable of the co-payment ($17,500) for the PTRCB cleanup and recovery
fund. If you do not partJdpate in the fund you must demonstrate your finandal capability to self
insure for the entire exposure. The renewal form has a box which says "insurance". This Bulletin is
notice that MMIA does not provide this coverage. To check this box, you would need coverage from
another policy.
