COUNCIL CHAMBERS Mary Embleton Jan Faught Scott Wilm James Caniglia Council Workshoo Ae, enda - December 11~ 2007 Introduction of Chris Rosenberg. Code Enforcement Officer Chris will attend tonight's council workshop. Parkin~ issues bv the Laurel Middle School Mayor Oison stated that the ciW does not support action to address the public right-of-way regarding parki~4~ issues. Rick and Kurt will be at tonight's council workshop to answer questions. Beartooth RC&D: Presentation of tho Comorehensive Economic Develooment Strategy Chris Mehus will give the presentation to the council. Planning Board issues: · Variance for Paul Bokoske, 1535 Valley Drive, for a proposed tree nursery James stated th_at the Planning Board recommended approval of the request (3-2) to the city council. James mentioned concerns regarding enforcement issues. · Building heights of up to 45' in Corcanunity Commercial zone James stated that a new zoning category might be needed. There was discussion at the Planning Board meeting, and the item will also be discussed at next month's meeting. · Annexation allowance for 1 or 2 years to conform James stated that Dick Fritzler expressed concern about this issue for developers that buy large plots of land and complete their projects in pha~¢s. There was a lengthy discussion regarding the need to require engineering for and installation of curb, gutter, and sidewalks for annexations. James said that a mandatory timefi'eme is needed in the annexation policy. Mayor Olson asked James to provide copies of the annexation policy for the council members at tonight's meeting. There was further discussion regarding the variance for Paul Bokoske, the conditions recommended by the Planning Board, and the concerns regarding enforcement. Executive review: · Appointments: o Police Commission: Reappoint Brett Lurid to a three-year term ending 12/31/2010 The appointment will be on the December 18a' council agenda. · Council Issues: o Yellowstone Historic Preservation Board issues (Emelie Eaton) l~anm~t I-~d M~fing Minutes ofI~o~nbe~ 11, 2007 The issues will be disenssed at tonight's meeting. o Trespassing and blocked sidewalks (Emelie Eaton) Rick will atteaid tonight's meeting and will address the issues. Review of draft council agenda for December 18, 2007 · Ordinance No. O07-12: An ordinance of the City of Laurel, Montana, establishing load limits on city streets; providing for track mutes and for loading and unloading; establishing exceptions; providing enforcement procedures and definitions; and providing for a penalty. (First reading - 11/06/2007; Public Hearing - 12/04/2007; Second reading - 12/18/2007) Mayor Olson explained the county's request to drill a water test well on a smell portion of the Laurel Cemetery. There was discussion regarding the request and the water rights. Mayor Olson explained that the closing for Thomae Lumber is scheduled for tomorrow. Paul Thomae asked him to sign an assignment of the encroachment permit for the new owners. The document and a resolution will be presented to the council at toni~ght's workshop. Mayor Olson explained Interstate Eugineering's proposed change to its agreement with the City of Laurel to prepare a Master Plan for the Laurel Cemetery for $8,400. The resolution will be presented at tonight's council workshop. Denartment Reports: Ambulance Service · Ambulance parking- MMIA's response Jan has not received a response from MMIA yet. Ace Electric has been contacted to fix the outlet used to plug in the ambulance. Jan stated that the HIPAA class is scheduled for Wednesday, January 9th, at 2:00 and 7:00 p.m. in the training room at the fire department. City Council President Mayor Olson stated that Gay Easton had cataract surgery today. · City's computer network o Additional server Mary stated that Bart Haskell is preparing the specs for an additional server. There was discussion regarding installation of Live Meeting on each computer. This will allow Technical Edge to remotely troubleshoot problems on the city's computers. The software is flee, so the only cost would be to install it on each computer. It was decided that Bart should contact the depa, h~ent heads to schedule times for the installation. Mary will ask Bart to order a new switch for the server. 2 Depamneat Head Meeting Minutes of December 11, 2007 · Contract with Technical Edge Mary stated that Bart gave Mayor Olson a proposed contract, as their contract expired in January 2006. Mary stated that the Section 125 signup went well last week. Several ~nilJloyees still need to sign the paperwork. Fire Deoartment · Cenex contract update Scott will give the rough draf~ to Sam for review. Scott will talk with Mary about the tender truck. Library_ The retirement party for Peg Arnold is scheduled for Thursday, December 20th, from 3:00 to 5:00 p.m. at the library. Kurt asked if the public works depamnent staff could take tums attending the party, and Mayor Olson Police Department · Parking ordinance changes This item will be moved to future items and should be presented at the end of January. Rick mentioned that Jim Huertas' mother had a brain aneurysm on Monday, and Jim flew out today. City Planner James stated that the Planning Board wants him to inform the council of the issues discussed by the board. · Report on Main Street Program presentation in Red Lodge James reported on the presentation which he attended on Monday. give a presentation to the council. There was further discussion. The state coordinator is willing to · Update on alley vacations James did not have an update yet. There was discussion regarding the properties involved in this issue. Public Works Department · Update on water line in Sheets Subdivision Kurt stated that work is being done today and should be completed within the next couple weeks. · Signage at Bernhardt Road and SE 4th Street by Wal-Mart Kurt explained the need for signage at this location. The comer was designed for a 25 mph speed limit. Advanced warning signs and speed restriction signs are needed and will be posted according to regulations. · School crosswalks 3 Departme~ut Head Me~4in§ Minutes ofDoc~al~r 11, 2007 Kurt asked Charlie White to bid winter construction prices to do the school crosswalks. This will be coordinated with Josh Middleton. A small services contract will be needed iftbe bid is $1,500 or moro. There was discussion regarding an SID for street improvements on Yellowstone Avenue, where additional townhouses could be built. Kurt mentioned several issues that were discussed at Monday's Public Works staff meeting. These included: curb and gutter issues in f~ont of Mike Penne's house; concerns about dust l~om the refinery; how to bring empty lots up to city standards; how to proceed with an active role for code enforcement; the new public works pamphlet; code enforcement and abandoned properties; new standards for ADA; and the new 30 amp plug in the city shop so the patcher can be plugged in and ready to do patching through the winter. City Attorney · Cable TV Sam stated that Cable Montana's attorney will return on Wednesday. Sam is working on the ambulance bylaws and the police department policies. Mayor Olson · Web site progress Jim Huertas has met with some departments. · Laurel City Voice Mayor Olson stated that the newsletter will go out by the end of January. The Schedule of Fees and Charges will be done in Janumy. The item will be listed under the mayor on the next depmment head agenda. A muting slip will be distributed after January 1st. Mary stated that the budget process needs to begin soor~ Kurt requested a meeting with Mayor Olson to discuss the upcoming transition with the new public works director. They will meet on Wednesday at 4:45 p.m. The public works director's office and pickup have been prepared for his arrival on Monday. Kurt had 3 call outs this weekend: 1 sewer call out, 1 waterline break on Woodland, and 1 missing stop sign at S. 5m and W. Railroad. Kurt will be working on CIP this week along with the schedule of fees. He requested that Gary look at the fee schedule and make recommendations for changes if he has any. CTA A_mhiteets will be here this am at 9:30 am to talk about W. 13t~ Street and 4* Avenue, the Reeder property. Kurt is getting a bid fi'om Charlie White for handicap crosswalkn for the schools. Cemetery Kurt continues to work with the County on the Veteran's Cemetery. Parks Nothing. Streets Kurt is working on getting a 30 amp plug in for the Shop so that the Porta Patcher can be plugged in and the crew can continue to do patching during the cold weather. De-Icer was delivered today for sanding of the streets. Twenty ton of cold mix asphalt was delivered last week for patching. Solid Waste Kurt is looking at purchasing m.~re 90 gallon and 300 gallon comainers for the City's expanding growth. McDonalds has four 300 gallon cans. Kurt wonders if that will be enough. Kurt is going to look into the possibility of purchasing and using 350 gallon cans. Solid Waste The crew is trimming all trees in the alleys that are scraping the garbage trucks. The bid package for the new route truck will be done by the end of this week. Christmas trees will bo taken at the old Hageman Elevator parking lot from December 26~ through January 20~. Woter/Sewer Systems This is water meter reading week. The water leak on Woodland that happened over the weekend is being fixed today. Frozen water meters will be repaired rather than replaced. This will be a significant savings to customers. WTP & WWTP Nothing. Code Enforcement Chris will go to the Council workshop on Dec. 11a' to be introduced. Public Works pamphlet needs to be finished and presented to the Mayor. L.M.C. for boulevards needs to be changed to allow gravel be placed instead of grass. This needs to be sent on to council for review. Complaints will still be handled as before. Building McDonald's and Wal-Mart have both been issued fma] certificate of occupancies. Fitchner Chevrolet has requested a permit for a sign. It is being reviewed. Gary approved thc plans for the new residence and garage at 80] E. 4~ with thc grendfathered setback being approved by Jemes. This is thc house that burned down last year. Gary asked if the city was going to require curb fend gutter on Yellowstone. The owners need to work with the city on engineering the curb and gutter. There was a trash can fire in the 900 block of 7th Avenue. Chris asked if there was still a meeting planned with the judge and police regarding issuing tickets for code enforcement offences. Planning James has a meeting with Jerry Neuman today at 1:00 pm regarding Cherry Hills subdivision. James is also headed to Red Lodge today for a 3:00 pm meeting regarding becoming a Main Street city. Cheryll told James that the Mayor set up a 1:00 meeting with the developer from Bozeman and would like James to be there. James said that there was some objection to his proposal on requiring curb fend gutter within 1 or 2 years at, er annexation occurs. He brought the proposal up to the Planning Board.
