Motion carried. Motion by Billielou Lance, seconded by Donna Kilpatrick, to approve the administrative services bill for $200. Motion carried. Canvon Creek Ridae Subdivision - Preliminary Plat Cal stated that there was a revised plan submitted, due to geotechnical testing that indicated that 18 acres in the southeast corner of the proposed subdivision is not suitable for building sites. This proposal has been taken to the Street and Alley Committee where the curbs, street sizes, and various other issues were discussed. It was determined that the City Engineer has the final say in those issues. Rick Newman of CDP Group, L.L.C., spoke regarding the proposed subdivision. • w Mr. Newman stated that they are negotiating with the sellers on a revised cost of this property. The cost for developing the property is much more than that anticipated. The testing of the soil found that there is 18+ acres that are unbuildable in an economic sense for the. developers. It would not be cost effective. The clay soil does not allow them to build homes with basements or with a regular footing, due to the clay not being able to bear the weight. Also, the distance they would have to go to hook into the water and sewer lines is cost prohibitive. Thus they decided to redesign the proposed subdivision. He feels the property is not worth but a fraction of what they originally offered the sellers. They took out the proposed health club, jog path and miniature golf course in order to develop this property as the redesign shows. He feels that if everything goes as they hope they will begin selling lots in August of this year. All lots will be at least 1 acre in size. Questions were addressed on driveways, streets, access to lots for garbage and fire service, the nutting drain, easements, and future water and sewer services for above the proposed subdivision. Question was raised on the upper northeast corner that is earmarked for a nature conservatory. Mr. Newman stated that the homeowners will be responsible for taking care of that property. The plans include keeping it in a natural state and keeping it clean. Question on Bernhart ditch. It runs on the easterly property line off of Alder Avenue. The proposal includes not crossing any of the ditches that run along this proposed subdivision, except the Nutting drain. Question on the unused acreage. It was suggested that it could be donated to the City for ball parks, but it will be up to the sellers to determine what they want to do with it. It has been used as farm land for the past 40 years. Ovuonenta• William Bernhart stated that he was concerned with, but not opposed to, the proposal in regards to the run off of water that could possibly upset the quality of the water in Bernhart ditch. It was stated that the run off will be directed into the Nutting Drain, with the City Engineer's approval. Question by Dee McClelland regarding the run off from the property. It was explained to her that the run off from the lots below the Nutting Drain will drain naturally onto Maryland Lane as it has done for many years. Public Hearing was closed at 7:40 p.m., after a motion by Donald Gudgell, seconded by Billielou Lance. Discussion on various items of concern including fire services, garbage services, drainage, nature conservatory, fending, and trees and shrubbery. Cal recommended approval of the revised proposal of Canyon Creed Ridge subdivision subject to the following conditions: 1) Streets, curbs, gutters, public services, city services and utilities meet the standards negotiated with the City. 2) Drainage not be allowed into Bernhart ditch. 3) Easements be provided to the local utility companies as negotiated. 4) Developer be required to provide a waiver of protest for future City sponsored SID's. 5) Nature conservatory area be maintained and owned by the homeowner's association. 6) Vehicular parking be provided on the east side of the nature conservatory for pedestrian access. The park be maintained and kept clean. Any improvements or changes therein must be approved by the City. Motion by Doaald Gudgell, seconded by Donna Kilpatrick, to add a 7th condition that a fence be placed by the developer on the east lot line of lots 20 through 24. Motion carried 9--1, with Merrill Watkins voting "No". Motion by Sillielou Lance, seconded by Clarence Foos, to recommend approval to the City Council of the Canyon Creek Ridge Subdivision preliminary plat, subject to the above 7 conditions. Motion carried 10--0. Blair Subdivision- Preliminarv Plat This will be brought up at next months meeting if the correct information is brought to us from the engineer doing the plat. There has been some confusion on his part. Laurel Bantiat Church - Landscaping Plan Cal received the landscaping plan but they did not indicate a time frame for it. Cal will write to them and request that information and report back to the board. Roger Anderson Property - Wold Road Mr. Anderson has been informed by Cal on several occasions that he needs to go through a subdivision process to add more mobile homes to land he owns south of Wold Road. Cal has given him a time frame to remove some mobiles and he has been adding mobiles since that time. The County Attorney will be pressing charges against him in a very near future regarding this matter.
