CITY-COUNTY PLANNING BOARD
JUNE 16, 1997 7:00 P.M.

Motion by Merrill Watkins, seconded by Gerald Shay, to approve
the minutes of the May, 1997. Motion carried 6--0.
Motion by Gerald Shay, seconded by Sob Dantic, to approve the
bill for June administrative services for $200, April, May and June
bill for Cumin Associates for $3375, and a bill for Yellowstone
County GIS (zoning maps) for $10. Motioa carried 6--0.
HOME OCCUPATION- VanVranken- 2704 Lackawanna
Sue VanVranken spoke regarding the proposed home occupation. She
and her husband run a vacuum cleaner and air filter business out of
their home.
They keep at least 12-15 vacuums in stock, but all sales are done
at their customers homes. They do employee other sales people (1
at this time) and the salesmen do come to the home between 1 and 2
times per week, depending on their sales. At this time they have
1 salesman working for them. He only comes to their home ,to pick
up stock he has sold.
Cal recommends approval subject to no customers coming to the home.
Motion by Merrill Watkias, aecoaded by Bob Dantic, to
recommend approval of the VanVranken home occupation subject to no
customers coming to the home. Motion carried. 6--0.
PUBLIC HEARING- PRELIMINARY PLAT- ANDERSON SUBDIVISION
Henry Meyers spoke regarding the proposed preliminary plat. This
is located in the county in the Southwest part of Laurel. There
are 5 lots in the plat, with lots being l acre or larger, for a
total of 5 1/2 acres.
This is a planned site for mobile homes. There are 2 existing

mobiles on the lots now. There will be one access off of Wold
Road.
Opponents:
Gerry Lynn Morris spoke in opposition of the preliminary plat. She
lives on the property south of the subdivision, and has for
approximately 1 year.
She states that Mr. Anderson is not a good landlord. He does not
take care of the property, he only cares that he is getting the
rent money. She showed pictures of the "buggy" road that comes
into the property. He has 3 mobile homes on the lots, not 2 as
stated by Mr. Meyers.
There are no covenants on the subdivision and she feels the place
is a mess.
Cal pointed out that there is no zoning out in that area, and there
is nothing that can be done regarding the complaints that Mrs.
Morris has. Some of the complaints, having to do with the "buggy
road" will be taken care of through this preliminary platting
process. This is as much as can be done through this board.
Cal recommends approval with the following conditions:
1) Put "preliminary" in plat title.
2) Require a 30' right of way for Wold Road.
3) Developer obtain an access permit from the County Public
Works Dept. for the private east-west road.
4) A half 50' turnaround be provided on the south end of
Wold Road where the private road intersects. This
provision may be negated in the future should Wold road
extend further south.
5) Private road be constructed to 18' wide gravel standard,
the minimum acceptable for emergency vehicle access.
Adequate space must also be provided at east_end of the
private road for emergency vehicle turnaround.
Structural design of the private road shall consist of
12" of 3" minus gravel base and 2" of 1-1.5" minus top
course. The minimum easement for the private road shall
be 40'.
6) An 8' utility easement be provided along the east side of
Wold Road and the south side of the lots.
7) Preliminary plat must show:
-adjacent land ownership
-adjacent land use
-adjacent zoning and zoning on-site
-street addresses
-location of existing power and telephone
8) SIA:
-showing Anderson's address

-show date submitted to Planning Board (5/15/97)
-paragraph 1.B.: should indicate that sewer and
water "is and will be"
-paragraph 1.0.: subdivider agrees to comply with
"Laurel and Yellowstone County Regulations"
-private easement needs to indicate 40' not 30'
9) Findings of fact:
-paragraph 1.B.3.b.: needs to be answered
-paragraph 1.B4.: needs to be answered
-paragraph III.l.b.: needs to be filled in
-paragraph IV.3.: needs to be followed, corrected,
and 3.b. filled in.
-paragraph V: development is outside the
Comprehensive Plan area.
Motion by Bob Dantic, seconded by Charles Fischer, to
recommend that Anderson Subdivision pre-liminary plat be approved
subject to the above list being completed. Motion carried 5--1,
with Gerald Shay voting "NO".
CHERRY HILL SUBDIVISION- PRELIMINARY PLAT
Henry Meyers spoke regarding the proposed preliminary platting of
Cherry Hill Subdivision, 2nd filing, amended.
He noted that lot 11 will be a part of the preliminary plat.
The existing land use right now is "vacant". The zoning is
Residential 7500, which is single family residents only. There
will be no park requirement because it was met with the original
plat in 1979.
Question was raised on why the street is being put in now, prior to
the preliminary plat.
Mr. Meyers spoke stating that the street is not part of this
preliminary plat. It was never vacated by the city when de-
annexation took out the lots involved in this preliminary plat.
The street remained dedicated and at this time is being put in to
accommodate the lots that the city owned and sold to Mr. Rookhuizen
a few months ago.
Charlie Fischer states he is opposed to this project due to the
manhole not being covered and neighbors being flooded out during
the Sunday, June 8th storm.
Cal states that is something to be taken up with the Public Works
Director, and is not associated with this preliminary plat before
the board.

No more proponents spoke.
Opponents:
Mary Jo Devener of 1006 Betty Avenue spoke in opposition. She
states that she is not exactly opposed to the preliminary plat but
states that Laurel has a backwards way of doing things with
preliminary plats.
She states that she was flooded out during the Sunday storm and is
wondering why the city is not inspecting the project as it is being
done. She thinks we need to look at the function of the Planning
Board so the City can be better served by this board.
She questioned why the park has not been developed in the Cherry
Hill subdivision?
She also states that the City let this property be taken out of the
city until a developer came along that could make money off of it.
She stated that the City is going to have to spend money again on
this property. She feels that there is a lot of administrative
things going on that shouldn't. This could of all not happened if
the City had not of let this property be de-annexed.
She questions the water and sewer mains, as to whether or not it
can handle the extra usage. The water pressure is poor, and is the
sewer line going to be able to handle it? Is there going to be a
tax burden put on city residents so that these lots can be served
with water and sewer service?
Lance Ulrich of 1411 W. Maryland had some questions of the board.
He questioned if there were any requirements on the size of home
and park requirements.
Cal stated that if he wants to get together with his neighbors and
create a park maintenance district he could do that, and al]. of the
neighbors could be taxed to get the park done. The park is a
dedicated park, but that the City probably cannot afford to take on
one ,more park to maintain and develop.
As for the size of home, that would be addressed in the covenants.
He also questioned the weeds on the lots in question. Cal stated
that the owner will be notified to cut the weeds.
Mary Jo Devener states that the developers are benefiting from the
previous platting of the subdivision. She also spoke regarding the
weeds.
Cal explained park dedication.
There was some discussion on park dedication.

Cal recommends approval subject to:
1. Add "An addition to the City of Laurel" to the title.
2. One preliminary plat show:
-adjacent property owners
-adjacent land use to include ditches and houses
-adjacent subdivisions
-zoning in and around
-utilities and hookup locations
-topography at not more than 2' contours
-addresses
Henry Meyers spoke on a letter from HKM that was done in 1979,
regarding water and sewer being able to handle the new homes. He
also states that once the water line is hooked to Cherry Hills
Drive and W. 12th Street the pressure will go up. He also has a
comment on the flooding on June 8, 1997, and it being equivalent to
that of a 100 year flood.
Question raised by Mary Jo Devener on why there is not asphalt in
front of Charlie Fischer's house in the 1500 block of W. Maryland.
She is wondering why she was required to have curb and gutter, but
there is none in front of Charlie's house.
No more opponents spoke.
The public hearing was closed.
Motion by Charles Fischer, to recommend disapproval of this
preliminary plat, until all of the requirements are met. Motion
died for lack of a second.
Motion by Gerald Shay, secoaded by Merrill Watkias, to
recommend approval of this preliminary plat, subject to the
conditions that Cal recommended. Motion carried 5--1, with .Charlie
Fischer voting "NO".
Motion by Ziggy Ziegler, secoaded by Gerald Shay, to add the
public hearing of Randy Swenson for a Special. Review of Ward
Subdivision, Lots 12 & 13 of Block 1 to the agenda. Motion carried
6--0.
SPECIAL REVIEW- WARD SDBDIVISION- PERSONAL CARE HOME
Randy Swenson spoke regarding his proposal to place 2 personal care
homes in a residential 7500 zone.
The annexation of this land was approved by the City Council at the
June 17, 1997 meeting.

These will be state licensed personal care homes for approximately
11 people in each home.
The access for both of the homes will be off of W. 12th Street, and
all of the issues with the public works/building department have
been addressed, such as off street parking and sewer and water
service.
Cal recommends approval subject to receiving and approving a
landscaping plan. Mr. Swenson will provide that to Cal.
The homes will fit into the neighborhood nicely as they are one
level ranch style homes.
There were no opponents that spoke.
Mr. & Mrs. Wennimar from the 200 block of Laurmac asked several
questions and indicated they were in favor of the project.
Motion by Gerald Shay, seconded by Merrill Watkins, to
recommend approval of the Special Review to the City Council, and
that the council not hold a second public hearing. Motion carried
6--0.
The meeting was adjourned at 8:35 p.m.
