HomeMy WebLinkAboutCity/County Planning Board Minutes 10.17.1997MINUTES CITY-COUNTY PLANNING BOARD OCTOBER 17, 1997 7:00 PM COUNCIL CHAMBERS MEMBERS PRESENT: Smith, Walton, Shay, Ziegler, Fischer, Foos, Watkins, and Baltrusch; also present: Cumin This meeting was a special meeting called a week ago because of lack of quorum at the regulazly scheduled meeting time. Motion by Walton with second by Baltrusch to approve the minutes of the last regular meeting; motion carried 6-0. Motion by Walton with second by Watkins to approve the administrative services bill from the City for $200; motion carried 6-0. Preliminary Plat: Pector Subdivision Jim Slehofer of D&J Surveying presented the prelinunary minor plat for Pector Subdivision, a proposed County subdivision located east of the Clazk's Fork River along Spring Creek Road. The plat shows two lots, one of which already has a home on it. The developer lives in the existing home, wants to sell it, and build another next door. Letter from County Public Works stating the access easement must be 40 feet wide and that the developer provide another 40 feet on the east side of Spring Creek Road for public right-of--way. The utility wmpanies want a 16-foot easement extending from the point of survey beginning southwest to Spring Creek Road. The County and State health deparbnents must also approve septic tank, drainfield, and water welllcistern locations and designs. In the Subdivision Improvements Agreement (SIA), Cumin recommends that, addition to the above requirements, the following changes be made: 1. Ute agreement be between Shilo Trust and Yellowstone County (not Laurel Planning Boazd); 2. Uie middle paragraph on page one which r:fers to "-approval of the final plat by the Laurel Planning Department-," be charged to refer to Yellowstone County; 3, that paragraph numbered "1," on page one indicate that Spring Creek Road is a `public right-of--way;' 4, that paragraph numbered " 2." on page one is not correct in that additional right- of--way is being requested by the County; 5. that in paragmph numbered " 3." on page one, the words "-required by the County Subdivision regulations-" be deleted; and 6. U~at paragmph numbered "7." oa page two refer to the correct State deparbneht. Motion by Shav with a second by Walton to aoorove as recommended; motion carried 6-0. Plat will go to the County Commissioners. Land Use Variance--McFnte The Planning Board assumed its role as City-County Zoning Commission and reviewed the following: Property is located at 1111, 1113, and 1119 Highway 212 South (see attached Notice of Public Hearing) in a Heavy Industrial Zone. Applicants want to build atwo-car gazage and move on a manufactured home. A public hearing was Geld by members of the Planning Board last week. Only the applicants were there to support it and no one showed up to oppose it. A representative of Cenex (Bill Stroud), however, did ask for clarification that the variance did not include any Cenex land-which it doesn't. Cumin stated that denying the applicants a vaziance for the garages and replacing the dilapidated shack with a manufactured home on a site that the applicants have lived on for many years probably constituted a hardship. He recommended approval of the application with the understanding that HlcFate's be aware of the fact that they are living in a heavy industrial mne, and someday it will probably all be industrial. Shay mentioned that the applicant should also not complain about conflicts with surrounding industrial land uses in the future. Motion by Shay with second by Watkins to approve the application; motion carried 6-0. TEMPORARY USE PERMIT: FLOYD Robert Floyd would like a Temporary Use Permit to allow him to put a small drive-by flower shop and expresso stand at the south end of the Town Pump property (312 First Avenue South). He plans to add additional pavement. to the south end of what the Town Pump has paved and place his building so that cars go azound it in a U-turn and back out the existing curb cut on the south end of Town Pump property. Cumin recommended that it be approved, but before it goes to the City Council that Floyd have a written agreement with Town Pump showing approval by Town Pump of lus plans. Cumin also stated that prior to going to City Council Floyd have the plan layout approved liy the City Engineer. Discussion followed by Planning Boazd. Motion by Walton with second by Shay that the application be approved subject to the conditions of the Temporary Use Permit regulations (which include the posting of a $1500 money order or cashiers check with the City prior to approval) and the recommendations of Cumin. Motion carried 6-0. Zoning Commission adjourned. Letter from Larrv Thomas Reenrdine Garv Temple was read by Cal. Thomas feels Temple is not providing off-strcet parking for his residence and wants to know bow Temple is getting away with it. Cumin to respond that the building Temple lives in is not asingle-family dwelling as Thomas alleges. Meeting adjourned at 7:50 PM. MONTANA 59044 PHONE (406) 628-7100 September 12th, 1997 To Laurel City/County Planning Board, Nancy McFate and her immediate family are seeking a variance to the zoning of her properties approximately one mile south of Laurel on the north side of the Yellowstone River bridge. The mailing addresses for these properties are 1111, 1113, 1115, & 1119 HWY 212 S. Laurel MT. 59044. These are also known as Lots 3A and 3B in the Burdette Subdivision. The zoning of these properties as "Heavy Industrial" prohibits any residential improvements. It is the family's desire to be able to make improvements to residential holdings on these properties as they are needed. Of pressing .importance is the need to demolish a residence (Exhibits A, B, C) which has been uninhabited since the early 1980's and replace it with a new home (Exhibit D). The new home will provide much needed security and supervision for the southern portion of the businesses that the McFate family owns and operates on the property. Nancy McFate and her family have lived on and have operated businesses on this property for 29 years. The property has actually been in the family since the 1920's. We would appreciate it if you would grant us the zoning variance which would allow us to continue to be productive business and family members of the Laurel area.
