Motion by Gerald Shay, second by Ziggy Ziegler, to approve the
minutes of the January 14, 1998 meeting. Motion carried 7--0.
Motion by Gerald Shay, second by Betty Hart, to approve the
$200 bill for administrative services for February 1999. Motion
carried 7--0.
Motioa by Miles Walton, second by Ziggy Ziegler, to approve
the purchase of a dictating machine with 1/3 of the money coming
from Public Works, 1/3 from City Clerk and 1/3 from Planning Board
budget. Motion carried 7--0.
HOME OCCUPATIONS:
EriG,,.and.Melissa Wark have requested a home occupation for 2721
Alpine View to allow him to service x-ray processors. He will not
be selling or showing any of the processors at his home but he
would store parts and equipment in his garage. All of his work is
done on customer's property.
He would have a delivery truck_ come in approximately once per
month.
There are some electronics involved in the repairs but it would not
effect radio or television around.
He would be storing fixer and developer in the garage. Normally he
has four 50-gallon drums of fixer and four 50-gallon drums of
developer. He also keeps a 10-gallon bypath, a concentrate to make

10 gallons of chemistry -that the customer would mix up. He
normally has a skid of each (72 and 64 cases). That works out to
720 gallons and 640 gallons of each of that. He states that none
of the chemicals are labeled flammable or hazardous. He states it
is a safe chemistry that doesn't require any special shipping.
At this time his business is located on Central Avenue in Billings.
He has been in operation since July of 1998.
Miles Walton suggests that if this is approved he would like Larry
McCann or Jim Stevens to read the MSDS sheets on the chemicals, due
to the large volume of chemicals that will be in a residential
area.
Cal recommends denial of this application. This is not the usual
home occupation once you bring in chemicals. This is the type of
business that should stay in a commercial area and not be invited
into a residential area.
Ed Thurner states that if we are going to encourage growth in our
downtown area then we need to look at limiting the number of home
occupations.
Ed would like to see some ordinances drawn up regarding home
occupation applications and consider having the Planning Board be
more of a board of appeals for home occupations.
Laurel Haggart states that the trend now is home businesses.
Ziggy feels that this is not a home occupation because all he is
doing is storing equipment in his garage such as a mechanic. He is
only storing items that he puts into his truck and hauls into his
business in Billings.
The purchase of this property is contingent on the approval of the
home occupation.
A .lengthy discussion was .held on the board's concern -over the
chemicals-that would be stored in a residential area.
Motion by Miles Walton to table the application until the
March meeting.
The applicant stated that if this was tabled until March they would
be unable to purchase the property as they have a March 10, 1999
deadline on the buy-sell.
Miles pulled the motion off the floor because there was no second.
Motion by Ed Thurner to deny the home occupation request,
second by Gerald Shay. Motion failed on a 3--4 vote with Haggart
abstaining.

Motion bar. Gerald Shay to recommend approval of the home.,.
occupation, second by Hetty Hart, subject to the review of the MSDS
sheets by the Fire Department or Public Works Director. Motion
carried with a vote of 5--3.
Public Hearing - PROPOSED CHANGES TO ALLOW CERTAIN CLASSES OF
MANUFACTURED HOMES IN AGRICULTURAL OPEN, RESIDENTIAL SUBURBAN, AND
RESIDENTIAL TRACTS ZONES.
-The Planning Board meeting was closed and the Zoning Commission was
reconvened for the public hearing.
Cal recommended the proposed changes to minimize the possibility of
litigation from the Manufactured Housing Association in regards to
where manufactured homes can be placed.
A lengthy discussion was held on the proposed changes.
It was decided that there should be no Class B manufactured homes
allowed in any other zone other than the existing manufactured home
zones.
Cal pointed out that opening the door to Class A manufactured homes
wasn't opening the door generally to all manufactured homes.
The board decided that there is already an adequate amount of
manufactured home zoned land available within the city for
manufactured homes.
After much discussion it was decided that Cal will bring this back
to the zoning commission once the legislature session is over, as
there are several proposals regarding this issue that are being
considered.
Cal does not recommend that the board do that because he feels that
there are more planning issues than zoning issues before the
legislature.
Cal proposed that Class A manufactured homes be allowed through a
Special Review process for agricultural open, residential tracts
and suburban residential zones. After a lengthy discussion it was
decided by the board that this was not a good solution either.
Motion by Kurt Baltrusch, to allow Class A manufactured homes
in agricultural open, suburban residential and residential tract
zones. Motion died for lack of a second.
Motion by Miles Walton, second by Laurel Haggart, to make
corrections to item # 2 of 17.16.010 table, and corrections to
item #3 17.16.020 table on the recommendation to change zoning
ordinance to allow manufactured homes (Class A & B) in AO, SR, & RT

zones). Motion carried 8-=0_
Billboards In Violation of Zoning.
There are two billboards on ground by the Hoffman Greenhouses that
were put up without going through the required special review
process. Cal would like to have a motion to send a letter to the
owners of the billboards requiring them to go through the special
review procedures.
Motion by Miles Walton, second by Laurel Haggart, to have Cal
write letters to the owners of the two billboards to require them
to go through the special review process. Motion carried 8--0.
Cal stated that a public hearing is scheduled for March 4, 1999 to
allow be allowed to create a zoning district in the Sportsman Park,
Moser Dome area.
Cal states that the Laurel Downtown Development Group is
progressing.

9. A fee of $ 150.00 (one hundred fifty dollars), to cover the
cost of administration, must accompany this application before
it will be accepted for processing.

INFORMATION:
Home Occupations are deemed to be site specific and owner specific.
Thus, the use of a portion of a dwelling fora home occupation will
not permit the preceding owner an automatic home occupation
designation. •
PROCEDURE:
1. Complete this Home Occupation Request Form and submit it to
the secretary in the Public Works Office seven (7) workincr
days prior to a regularly scheduled meeting of the City-County
Planning Board (which usually meets on the second Thursday of
each month).
2. The Planning Board will consider the request at their meeting.
Attendance by the applicant for home occupation or his
representative is required at this meeting.
3. The Planning Board will make a recommendation to the City
Council that the request for home occupation be granted or
denied.
4. The City Council, at its next regularly scheduled meeting,
will consider the Planning Board's recommendation regarding
the home occupation and approve or deny the request. The
applicant or his representative must also attend this City
Council meeting. If the Council approves the home occupation,
the applicant must then go to the Council's Business License
Committee for the actual business license to operate the home
occupation.

ZONES.
Public Hearing Held February 11, 1999
1. Manufactured Homes, Class A and B, aze defined in the Laurel Zoning Ordinance
as follows: Manufactured Hame, Class A: A manufactured home constructed within
the last two years, that meets or exceeds the construction standards promulgated by the U.
S. Department of Housing and Urban Development that were in effect at the time of
construction and that satisfies each of the following additional criteria:
a. The Home has a length not exceeding two times its width;
b. The pitch of the unit's roof has a minimum vertical rise of one (1)
foot for each five (5) feet of horizontal run, and the roof is fuushed with a type of shingle
that is commonly used in standard residential construction;
c. The standard siding consists of wood, hardboard, or aluminum
(vinyl covered or painted, but in no case exceeding the reflectivity of gloss white paint)
comparable in composition, appearance, and durability to the exterior siding commonly
used in standard residential construction;
d. A continuous, permanent masonry foundation, unpierced except for
required ventilation and access, is installed under the home; and
e. The tongue, axles, transporting lights, and removable towing
appazatus are removed after placement on the lot and before occupancy.
• Manufactured Home, Class B: A manufactured home constructed after January
1, 1990, that meets or exceeds the construction standards promulgated by the U. S.
Department of Housing and Urban Development that were in effect at the time of
construction bui that does not satisfy the criteria necessary to qualify the house as a Class
A manufactured home.
Currently the Zoning Ordinance requires any manufactured home regazdless of class to be
located in the RMH zone only.
