Cai Cumin Mark Richards Cheryll Lund Continuation of Board Discussion- Brookwood Subdivision- Preliminary Plat Bob Anderson fi-om Hydrometrics gave his overview of the water issues at Brookwood Subdivision and the surround subdivisions. In his opinion there is enough water available for the proposed 101 lot subdivision without effecting the subdivisions within the area if the developers have a recharge and an irrigation system planned. Pat Davies from Engineering, Inc. also spoke and answered questions fi-om the Planning Board. After an extensive and detailed discussion of site hydrology and alter reviewing the recommendation fi-om the MDOT, Cal gave his recommendation. Cai recommended approval subject to conditions (see attached). Motion by Todd Linder, second by Dan Koch, to recommend approval to the Yellowstone County Commissioners with Cal's conditions. Box 10 Lam~el, Montana Planning DEPARTMENT September 22, 2006 Board of County Commissioners Yellowstone County POB 35,000 Billings, MT 59107 RE: BROOKWOOD MAJOR SUBDIVISION PRELIMINARY PLAT (101 single-family lots on septic and water wells located NE of Laurel on Airport Road and Seitz Ronan.) Gentlemen: The Laurel City-County Planning Board, at its September 7 meeting, conducted a duly advertised public hearing on the above referenced subdivision; there were no objections, although one person on the south side of Montana Meadows Subdivision expressed concern about his water well capacity as affected by this new development. The Board recommended tabling its decision on this subdivision until September 21st, at which time it held a special meeting. The pr/mary reasons for delaying decision (with applicant concurrence) was the final report o£the hydrologic study was not ready, and MDT had not provided details of their concerns about the intersection of Seitz Ronan and US 10. After extensive discussion of groundwater issues, this Board recommends conditional approval subject to the following conditions: SUBDIVISION IMPROVEMENT AGREEMENT 1. Address concerns of the County Public Works Department. 2. Maintenance of the dry hydrant facility and its access should be included in the RSID for Maintenance. 3. The issue of"water shares" under IRRIGATION FACILITIES needs to be clarified. 4. Delete the notarization of the County Commissioners' signatures block. 5.. The recharge basins must be designed to provide at least two surface acres at a minimum as per the recommendations of the hydrologic analysis. 7. The developers state it is their intent to prohibit, to the extent possible, the use of ground water for irrigation. This needs to be spelled out both in the subdivision covenants and the SIA. 8. The planned separate irrigation system needs to be detailed in the SIA. 9. Put the groundwater recharge system into the Park Maintenance District. 10. The developers need to pay a proportionate share of the southbound left turn lane at the intersection of Seitz Ronan and US 10 when warranted and constructed by MDT. This cost share is recommended by MDT (see at~ached letter). 11. The Environmental Assessment states that the old beet workers' cabin in the planned park ama is of interest to the local historical society; in compliance with local historical preservation efforts this needs to be addressed for the public record. OTI-[ER 1. The County Park Board has reviewed the proposed parkland dedication with PMD proposal--and concurs. 2. Provide utility easements as requested by utility companies. I will not be able to attend either your discussion or the Commission Meeting for this item, as I will be out of the State. Hopefully I have provided the information you need to make a decision coupled with the applicant's presentation of his project. We concur with this recommendation and want to inform you that the developer(s) involved in the improvements must contact MDT for approval prior to initiating any work within MDT right of way. Additionally, MDT is currently developing an improvement project on this section of Highway 10 and additional coordination at this time might allow MDT to incorporate the left mm lane into our project. For MDT to do so, we will need to recover any additional costs associated from the mm lane from the area developers. To initiate discussions, we request that the City include conditions on the Brookwood Subdivision that will require coordination with MDT conceming improvements at the Seitz Ronan/Highway 10 intersection. We would also request a similar condition be placed on any other developments taking place along the Seitz Ronan road that will impact the traffic at this intersection.
