Motion by Miles Walton, second by Laurel Haggert, to approve
the minutes of the May 6, 1999 meeting. Motion carried.
® Motion by Miles Walton, second by Gerald Shay, to approve the
$200 administrative services bill for June 1999. Motion carried.
PRELIMINARY PLAT- RICHARDSON SUBDIVISION
Harlan Lund spoke regarding the application.
This preliminary plat is 22 acres to be divided equally into 5 lots
with a maximum lot size of 4.462 acres. It is presently
agricultural, and the intended use is for single family residences.
The lots cannot be further subdivided due to covenant restrictions.
At this time two of the lots are occupied by family members of the
applicant:
Water and Sewer system plans will be submitted to the Department of
Environmental Quality, and access permits will be requested from
the State Highway Department.
Harlan states that they would like three accesses into the
property.
Motion by Miles Walton to recommend approval of Richardson
Subdivision.
Discussion.

Yellowstone County Public works recommends that a one-foot, no
access strip be provided along busy U.S. Highway 10 frontage and
that only one access into the property be allowed instead of the 3
requested. Cal concurs. Cal also spoke to the State Highway
Department and they indicated they would support just one access.
Harlan Lund stated that when he talked to the State Highway
Department they were not opposed to having 3 accesses off of the
road.
Gerald Shay states that the road is well traveled with more and
more traffic all of the time.
Miles Walton spoke regarding getting the correct information on the
opinion of the State Highway Department since there are two
different statements regarding that issue.
Motion to recommend approval of Richardson Subdivision made by
Miles Walton was seconded by Kurt Baltrusch. Motion carried.
PRELIMINARY PLAT- MAJOR SUBDIVISION- PLEASANT VIEW
Henry Meyers spoke regarding this preliminary plat.
This subdivision is located south of Danford Road about one-half
mile West of 72nd Street West. It consists of 17.036 acres and
will be divided into 15 lots with a minimum lot size of 1.062
acres. There is no zoning on this piece of property and it will be
used for future development of single family dwellings to include
modulars that meet UBC, but no manufactured homes.
The name of the subdivision will be changed to Morning Side
Subdivision.
The access road. will be built to county standard. Each access into
the lots will not have culverts and each lot will hold it's own
water runoff.
Cash in lieu of land for park requirements will be given by the
owner.
Discussion.
Cal recommends approval subject to: 1) road standards be met; 2)
County Health and State Health department requirements for sewer
and water be met; and, 3) Cash in lieu of park lands is fine,
but he would like to see a plated piece of land given so that the
County could sell it for park money.
Motion by Miles Walton, second by Kurt Baltrusch, that we
recommend approval of Please View Subdivision subject to the 3

above recommendations by Cal. Motion carried 5--1 with Laurel
Haggart voting "No".
SPECIAL REVIEW- LAMAR BILLBOARDS
This was tabled at the 5-6-99 meeting.
A letter was received just prior to the meeting from Lamar Outdoor
Advertising changing their initial application from 5 signs to 3
signs and that they be given a postponement of 30 days on the
Planning Boards decision. They hope to get an endorsement from the
Laurel Revitalization League in the interim.
Cal reminded the audience that this is not a public hearing. This
is a discussion among the Planning Board members.
Discussion.
Most of the board members are questioning whether or not the
billboards will be helpful to the City of Laurel. Allowing the
signs will not mean that the signs will be Laurel oriented.
The possibility of the City of Billings imposing a moratorium on
billboards until their impact can be studied more in depth was
discussed.
The other feeling is that allowing these billboards could set a
precedent for future billboards. If these billboards are allowed
in Laurel, will people run to Laurel to put up more signs because
Billings is not allowing anymore while a moratorium is in effect?
Cal stated that Laurel is just beginning a $120,000 study to
determine what its citizens want Laurel to look like and to become
in the future. He would likes this study to be completed before we
allow more billboards that will be up forever. A city denial of
the request is good for one year, enough time for Laurel to
establish its plan.
Miles would like to see the board give a 30 day extension to allow
more time to look into some of the questions being brought up by
the Planning Board.
Motion by Males Walton, to postpone the Lamar Outdoor
Advertising special review for 3 signs for 30 days.
Motion died for lack of a second.
Discussion.
Motion by Laurel Haggart, second by Kurt Baltrusch, to

recommend denial of the Lamar Outdoor Advertising application for
3 billboards. Motion carried.
Motion by Gerald Shay, second by Miles Walton, to recommend
that the City Council hold an additional public hearing on the
Lamar Outdoor Advertising special review application for 3
billboards. Motion carried.
Home Occupation Form Review
This is being reviewed because the board feels there are changes
that need to be made to help eliminate some of the ongoing problems
with home occupations.
The board agreed that they need to be more aware of the home
occupations that are prohibited. -
Cal feels that the ordinance is somewhat confusing and needs to be
more defined as to what is allowed and what is prohibited.
Discussion.
After a lengthy discussion Cal will provide a draft for the next
meeting of possible changes.

meeting. Motion carried.

Re: Special Review For Proposed Outdoor Advertising Sign Structures To Be
Built On Interstate #90 East of Laurel
Dear Zoning Commission:
The subject Special Review is requested to allow Lamar Outdoor to lease and
build five (5) sign structures on Mr. Grill Burdett's land north of the Interstate.
These sign structure locations qualify under Montana Law for highway areas
under the jurisdiction of the Montana Department of Transportation. The
attached site plan shows the locations of the sign structures moving west
from the East Laurel Inter-Change #437.
Each of the proposed sign structures will be built on a center mount single
pole with the sign faces back to back in a V configuration with a fifteen foot
(15') spread between the faces away from the highway. The sign faces will be
ten feet six inches high (10'6") by thirty-six feet (36') wide or three hundred
seventy-eight (378) square feet in area. Montana State Law allows a
maximum sign size of six hundred seventy-two (672) square feet, so these
sign faces are approximately forty-four percent (44%) smaller in size than
allowed. The tops of the sign faces will be set at thirty feet (30) off the
centerline of the adjacent highway to also comply with State Law.
We are now using computer generated painting on vinyl sheeting for sign
faces rather than the traditional painting of four feet by eight feet (4'X8')
plywood sheets. The new process allows the- sign face to project far better
color and photographic reproductions of people's faces. Installation of the

sign face is accomplished by stretching the vinyl sheeting over a steel face of
a similar dimension. The attached photographs show the fabrication and
appearance of the sign structure described. During the Public Hearing, we
would be pleased to respond to questions concerning our industry and the
sign construction we are proposing.

Dear Planning Board:
Regarding the application from Flying Box Ranch Company for Special Review for five new
billboards: The Planning Board needs to close the Planning Board meeting and re-open as the
City Zonin Commission--and then o en the public hearing.
Chapter 17.68 of the Zoning Ordinance discusses Special Reviews and states that "Although
each zoning district is primarily intended for a predominate type of use, there are a number of
uses which may or may not be appropriate in a particular district depending upon the
circumstances of the individual case." There follows several examples of things to consider
which for this application include: the location, nature of proposed use, character of the
surrounding development, and potential environmental effects:
1. The location: the area in which the billboards are proposed is the east entrance
to Laurel; it is basically the first part of the community seen by people on the interstate
coming from the east.
2. Nature of proposed use: introduction of large, multi-colored billboards on
presently vacant land adjacent to the interstate and community.
3. Character of the surrounding development: There are no billboards in this area
at present. The land is flat, vacant, and agricultural. The backdrop to the land is the rail yards
and residential land uses beyond the rail yards. The site -is zoned Light Industrial.
4. Potential environmental effect: The issue of the environmental effect of
billboards is a public perception issue that is going to become more and more contentious. I
believe Billings will probably soon consider modifications to its billboard allowance provisions
and a possible moratorium on billboards. The new CTEP program administered by the
Montana Department of Transportation, which Laurel is using to develop its Fireman's Park
Cabin, South Pond, and the Canyon Creek Battlefield sites, has a provision for providing
Federal assistance (matched with local monies) to actually remove billboards (a very difficult
process).

After the public hearing, (close the public -hearing before making recommendations and
decisions) the Zoning Commission (see 17.68.040) shall make a recommendation to the City
Council to:
I . Grant the application for Special Review;
2. Deny the application;
3. Delay action on the application for a period not to exceed thirty days; or
4. Grant the application subject to conditions and recommendations and the give
the reasons therefore.
5. (The Zoning Commission can also recommend to the City Council that it hold
or not hold an additional public hearing--which is at the Council's discretion.)
My recommendation is that the applications be denied. Laurel is just starting to try
and promote its sense of community pride and place. An important part of this sense of pride
and place is how the community looks--both to those who live here and to those who drive
the interstate by here. The construction of five large billboards at the east entrance to the
community--where there are none now and where the view is presently of the larger
community and open space--is not conducive to enhancing the image of Laurel as a
community that cares about itself.
Laurel needs additional time to develop and define its sense of place and the new
planning efforts that are under consideration (the downtown planning effort and the new
transportation planning grant that has been applied for). Laurel also needs time to consider
methods of how to plan the entrances to the community--such as that from the east. Approval
of these billboards at this time will largely dictate how the east entrance area is perceived
regardless of future design provisions desired by the City.
It is in the interest of Laurel to deny these applications at this time in order to allow it
to develop appropriate procedures for dealing with the entrances to its community (a process
it has currently started) and for billboards specifically. It currently has no provisions for
considering or establishing size, number, spacing, lighting, and the other characteristics of
outdoor advertising. Granting approval of these applications at this time would largely negate
the effort to influence such facilities in the future. Once billboards are erected it is almost
impossible to remove them, regardless of subsequent location and design control efforts.
It is important that Laurel completely understand the implications of the new
billboards--both Federal and State regulations and provisions. Laurel should also, as
requested by the City Council, try and coordinate its zoning regulations with the larger,
Billings and Yellowstone County Unified Zoning Regulations. Laurel needs to wait and see
what the larger area is going to do about billboard control before it makes decisions that will
remain in effect over a long period of time.
Denial of these applications does not prevent the applicant from coming back to Laurel
in one year and re-applying for approval--a time frame in which Laurel will be better prepared
to add the Ion -term, pertinent issues involved.

Re: Special Review For Proposed Outdoor Advertising Structures To Be Built On

Dear Zoning Commission:
In a letter of March 16a' Lamar Outdoor Advertising requested a Special Review for five
(5) sign structures to be built on Mr.Gill Burdett's property east of Laurel. Following our
initial application and the postponement of a decision on the application for thirty (30)
days, Lamar would like to reduce the number of sign structures for consideration from
five (5) to three (3). On the map previously submitted, sign locations number three (#3)
and number four (#4) should be deleted. The attached map shows the deleted sign
structures.
On Wednesday, June 2nd we met with the Laurel Revitalization Council hoping to solicit
from them an endorsement for our highway sign proposal in that three (3) of the sign
faces should have an economic benefit to the Laurel business community. At the meeting,
we were informed that their general meeting would not be held for another week, so we
will not have an opportunity for an endorsement until that time. In view of this
circumstance, we would like to formally request an additional thirty (30) day extension
for our Special Review request to allow the submission and review of an endorsement
from the Laurel Revitalization Council. Your consideration of our request is sincerely
