Council Chambers MEMBERS PRESENT: John Smith, Chairman Gerald Shay, Member-at-Large Tom Robertus, County Rep. Kurt Baltrusch, County Rep. Kate Stevenson, City Rep. Laurel Haggart, City Rep. Ziggy Ziegler, County Rep. Bud Johnson, City Rep. OTHERS PRESENT: Cal Cumin, City Planner Cheryll Lund, City Secretary Motion by Gerald Shay and seconded by Bud Johnson, to approve the minutes of the February 3, 2000 meeting. Motion carried 8-0. Home Occupations: None this month. Cal Cumin Contract: Last month the board approved Cal's current contract. Some of the board member's wanted to see the original contract, and it was provided to them in the agenda packet. Laurel Haggart is questioning why the City budget states that there is $10,000 allotted for a planning consultant, not $15,000 as was approved for Cal. She wants to make sure a mistake hasn't been made which the board could pay for later. Bud Johnson feels that the information Laurel received was not correct. He sits on the Budget Finance committee and remembers the $15,000 being approved all the way through to the final budget. This will be looked into further. Proposed Home Day Care Review: Cal is concerned because of the lack of review required on daycare operations located in residential homes. The City of Laurel has 4 different categories of daycare: Family Day Care home (3-6 children), Group Daycare home (7-12); Child Care Center (7 or more); and Day Care Center (13+). Under Laurel zoning ordinances only 6-1.. day care centers (13+) require a special review. All other types require a home occupation only. No city license is required, but the state requires a is license. Cal would like the board to consider what requirements they would like to put on a home day care operating in a residential zone. He feels we should give the neighbors the option of opposing or supporting a day care next to their home. There have been several situations in town where a day care came into a neighborhood without any review. It eventually caused some problems with the elderly neighbors in the area and a complaint was lodged against the day care home. A question was brought up on the Little Tykes Academy on Seitz Ronan. It appears that they have put an access road off of Seitz Ronan, after the Planning Board and City Council required the access off of North Ramshorn. Cheryll will look at the file and report her findings to Cal. Letter from Mayor - Regarding Items Placed on Council Agenda: Cal stated that the Mayor has sent a directive to all committee chairmen . regarding items the committee wants the city council to consider at the next council meeting. There has been a lack of communication regarding this matter and things have slipped through the cracks. The Planning Board needs to state their recommendation and/or resolution for action by council in writing, in a certain time frame. A line item will be permanently placed on the agenda, at the end, titled "Council Agenda Items". Draft Resolution Creating a Method of Determining Fair Market Value For Land Being Subdivided When Cash Is To Be Donated In Lieu Of Park Land Dedication. Cal would like the Board to look over a draft resolution for Cash in Lieu of Park Land and be ready to discuss it at the next month's meeting. The meeting was adjourned at 7:30 PM. A RESOLUTION OF THE CITY OF LAUREL, MONTANA CREATING A METHOD OF DETERMINING FAIR MARKET VALUE FOR LAND BEING SUBDIVIDED WHEN CASH IS TO BE DONATED IN LIEU OF PARK LAND DEDICATION. WHEREAS, State law provides that when a cash donation is to be accepted in lieu of the dedication of land for parks or playgrounds when property is being subdivided, the amount of that cash donation shall be the fair market value of the unsubdivided and unimproved .land which would have otherwise been dedicated; and WHEREAS, the previous policy of determining the fair market value by using the appraised value data recorded in the County Assessor's Office has not resulted in determination of actual fair market value in all cases; WHEREFORE, be it hereby resolved by the City Council of the City of Laurel, Montana: 1. At the time the preliminary plat is submitted to the City-County Planning Department, the subdivider shall submit evidence to be used in determining the fair market value of the unsubdivided and unimproved land being subdivided. criteria: 2. The evidence to be submitted by the subdivider shall meet the following A. It shall show the actual per acre sale price of at least three (3) comparable parcels of land. B. The comparable sales must have occurred within three (3) years of the date of the subdivision submittal. C. Information on sales of parcels located more than two (2) miles from the subject property will not be acceptable ex_ cent in those cases where no information is available on sales within two (2) miles within the past three (3) years. 3. The City Council of the City of Laurel--based on the information submitted by the subdivider and the City-County Planning Board--shall determine the amount of the cash donation which will be accepted in lieu of park land dedication. Such decision will be made by the City Council at the time the Council acts on the preliminary plat.
