Cai Cumin, City Planner Cheryll Lund, City Secretary Leonard & Dee McLelland Minutes of the June 1, 2006 were approved with the addition of member David Oberly being present. Public Hearing -Annexation Request- 708 E. Maryland Lane- McLelland PROPONENTS: Leonard McLelland spoke requesting annexation ofh/s property at 708 E. Maryland Lane, Laurel, legal description of: Certificate of Survey #2385, Amended Tract B-1. They are requesting annexation to be able to receive city services. The property consists of 4 acres. OPPONENTS: There were no opponents. Chairman Shay closed the public hearing at 7:07 pm. Cal recommended approval. This annexation fits within the city's intent to annex adjacent property that has access to city services. Motion by David Oberly, second by Dan Koch, to recommend to the Laurel City Council approval of armexation for C/S 2385 Amended Tract B-1 to the Laurel City Council. Motion carded by a vote of 6-0. Public Hearing- Reduce amount of commercial parking requirement; Allow porches in residential zone to protrude into front yard setbacks; Allow reconstruction of non-conforming housing units destroyed by fire; and~ Increase drivewa~ approaches to residences from 20-feet wide to a maximum of 24- feet. The public hearing was opened at 7:I0 pm. The public hearing was closed at 7:11 pm as there was no audience present. Section 17.16.020 - Front yard setbacks in residential zones. Cai recommended reducing the front yard setback from 20 feet to 5 feet for construction of open porches only. This allows porches to be constructed and helps induce the feeling of people on the street and of neighborliness. The source for this is the desire to increase neighborhood communities and density in residential neighborhoods and is in compliance with the GMP and the concepts developed in the City Streetscape Project. A question was asked if the line of sight on a comer would be affected. Cal will address this before it goes to Council. Motion by David Oberly, second by Todd Linder, to recommend to the Laurel City Council that 17.16.020 be changed to a 5-foot setback for open porches only. Motion carded by a vote of 6-0. Section 17.40.090.J(2). Parking requirements in the Community Commercial District. Cai recommends that the amount of off-street parking be reduced from one per 100 square feet to one per 200 square feet. This is similar to Billings and will help commemial development in this district, especially since we recently did away with all off-street parking in the Central Business District. Motion by David Obefly, second by Bud Johnson, to recommend to the Laurel City Council that 17.40.090J(2) be changed to reduce the amount of parking spaces from one per 100 square feet to one per 200 square feet. Motion carried by a vote of 6-0. Table 17.56.030(1) Non-conforming use in residential areas. Cai explained that in residential single-family areas where a non-conforming second dwelling unit is presently located, allow it to be rebuilt if destroyed by fire or natural causes. Specifically in Section 17.56.030.1: should be changed to read, "ifa single- family dwelling, presently a non-conforming use, in a residential area is destroyed by natural causes or fire, it can be rebuilt". This issue is a constant problem where people are refinancing houses and then discover that their house is a non-conforming use and a mortgage company won't touch it. After a discussion by the board it was decided that the words "by fire or natural causes" be removed and the word "destroyed" would stay. That would cover both natural and man-made causes. Motion by David Oberly, second by Dan Koch, to recommend to the Laurel City Council that Section 17.56.030(1) be changed to read "ifa single-family dwelling, presently a non-conforming use, in a residential neighborhood is destroyed, it can be rebuilt". Motion carried 6-0. 2 Section 12.08.070. Residential driveway width change from 20 to 24 foot maximum. Cai explained that this issue was brought forward by the Public Works Director and even though it is not a zoning issue it was felt that the Planning Board should consider tkis issue and send it on to Council with a recommendation. Newer residences typically have 3-car garages and the standard 20-foot driveway width does not work as well as it should. Changing the maximum width to 24-feet would be helpful. Cal recommends approval. Motion by Todd Linder, second by David Oberly, to recommend that the Laurel City Council change the driveway width to a maximum 24 foot. Motion carried by a vote of 6-0. Subdivision Regulations Review Cal read through and explained Chapters 16.5 through 16.8 of the proposed revised Subdivision Regulations. The board was encouraged to read the proposed revisions more in depth and call Cal with any questions or concerns. Miscellaneous There was a discussion on several code enforcement issues involving accumulations of junk. Cai encouraged the board to contact the County Code Enforcement Officer that works out of Yellowstone County if the violations were in the County and Gary Colley if the violations are within the city limits.
