HomeMy WebLinkAboutOrdinance No. O06-03EMERGENCY ORDINANCE NO. 006-03 EMERGENCY ORDINANCE IN ACCORDANCE WITH MCA § %5-104 AND § %5-108, TO MODIFY EMERGENCY ORDINANCE NO. 006-02, TO CORRECT ERRORS AND OMMISSIONS IN THE PREVIOUSLY ADOPTED SCHEDULE OF FEES AND CHARGES AS IMMEDIATELY EFFECTIVE AND ENFORCEABLE BY THE CITY OF LAUREL. WHEREAS, the City Council previously adopted Emergency Ordinance No. 006-02 in which the City's fees and charges for various services were combined into a Schedule of Fees and Charges to enable citizens to have immediate access to the various fees and charges levied by the City for various services in a format that is simple to understand; and WHEREAS, the previously adopted Schedule of Fees and Charges contained errors and omissions requiring further City Council action to correct the errors and input the omitted fees and charges in the City's Schedule of Fees and Charges; and WHEREAS, staffhas attached the previously adopted Schedule of Fees and Charges with all the corrections and additions marked and labeled therein for purposes of review, consideration and notice; and, WHEREAS, City staffis currently working to revise the entire Laurel Municipal Code to be consistent with the final Schedule of Fees and Charges adopted by this and Emergency Ordinance No. 006-02, which will be brought before the City Council for review, consideration, debate and a public hearing prior to final adoption by the City Council. IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana, that the attached Schedule of Fees and Charges is hereby adopted replacing the previously adopted Schedule of Fees and Charges incorporating all of the attached amendments and additions recommended by staff. BE IT FURTHER ORDAINED, that any person, group, entity, citizen or member of the public who had obtained a quoted price for a City fee, license, or permit prior to the City's change in fees and/or charges through emergency ordinance and who had relied upon the City's quoted price, may request the assessment of the previously quoted fee and/or charge. The City Council further authorizes the Administrative Assistant, upon concurrence of the Mayor, the authority for approval of a limited waiver of the newly adopted fee or charge for equitable reasons and upon a showing of good cause. BE IT FINALLY ORDAINED that this Ordinance shall become effective immediately upon adoption and shall remain effective until repealed, replaced or until it expires. Building Permit Fees for projects with total values of $1,000,001 or more are $5,608.75 for the first $1,000,000 plus $3.15 for each additional $1,000 or fraction thereof.
