Hazel Klein, City Rep. Todd Linder, City Rep. Clarence Foos, County Rep. Greg Johnson, County Rep. Dan Koch, City Rep. Rick Flanagan, County Rep. Others present: Cai Cumin, City Planner Cheryll Lurid, City Secretary The minutes of the March 2, 2006 meeting were approved as sent out. Public Hearing - Conditional Use Permit - St. John's Lutheran Ministries David Trost spoke on behalf of St. John's Lutheran Ministries. He is one of the managers of St. John's and is in charge of this project that is being called "The Crossings". It will be located on the corner of East lVlaryland Lane and Alder Avenue. St. John's is requesting a conditional use for property that is presently zoned Community Commercial (Block 3, Lot 7, Iron Horse Station Subdivision). They specifically want to be allowed to build up to three stories (45 feet from the presently allowed 25 feet) in parts of their 36-unit plans. The second part of the request is a clarification of the uses they plan to put on the site: "Elderly Independent Living, Assisted Living, and Nursing Cottage." These do not specifically match the LMC definitions, and Cal had suggested they include their specifics in the request, for the record. Mr. Trost goes on to state that St. John's Ministries is here in Laurel only by invitation from members of the Laurel community. Dr. Lee Richardson and Pastor Marry Dreyer have both been involved with St. lohn's in Billings and have encouraged St. John's to come to Laurel. Because of Marvin Brown's recent donation of approximately four acres land to St. John's it is now possible for them to make such a project work in Laurel. Don Olson, 02 Architects, spoke as architect for St. John's. Most of the living units will be considered independent living and some will be assisted living (m/nor assistance). There is no nursing home being planned, only elderly apartments. DRAFT Allowing part of the planned structures to be three stories will also allow a smaller footprint for the building and consequently more landscape and walking paths. The building complex will have a sloped roof and have lower elevations at both ends to help it look more residential. He showed the board a drawing of what the structure will look like (see attached). Included in the complex will be a small cottage that will house 12 residents on the southeast comer of the property. The main accesses to the whole complex will be offof Golden Spike Drive and Roundhouse Drive. There will be an access offofEast Maryland Lane that the delive~ trucks will use to bring in supplies. There will be a detention basin located in the southeastern comer of the property. David Trost stated that they invited the neighbors to an open house to visit with them about their concerns or excitement about the project. Out of the 6 neighbors that attended the open house 5 of them signed a letter of support (letter attached). Marty Dreyer spoke in favor of this project. He knows many Laurel senior citizens that have had to move into facilities in Billings because of the lack of facilities in Laurel. This facility is a plus for our community. He also stated that the high quality of service and housing that St. John's provides is also a plus for the community. Bob Robinson, 916 Washington, spoke in favor of the project. He stated that this is something that Laurel needs and the community should give this project 110% of their support. Dr. Lee Richardson spoke regarding the need for this type of housing in Laurel. St. John's offers a facility that elderly couples can live in either in the same room or in the same building and still be able to have their meals together. St. John's is a well run facility that is needed in Laurel. Michelle Cart spoke. She is employed by St. John's and is a Laurel resident. She feels that this is a great oppoamaity for the resident's of Laurel She has talked to many elderly Laurel residents that are favor of this facility. Opponents: There were no opponents present. At this time the public hearing was closed (7:20 pm). Board Discussion. Todd Linder reminded the Board that at the July 7, 2005 meeting the Board discussed this type of facility and decided it was needed and it also fit within Laurel's Growth Management Plan. DRAFT Hazel Klein stated that through her business she has found that many elderly Laurel residents are forced to sell thek homes and move to a facility in another town. Greg Johnson questioned the "future nursing cottage" that shows on the plan. David Trost stated that the wording of that is misleading. The "future nursing cottage" is actually a one-story assisted living facility that will house 12 residents with a common living and dining area for the residents. It is not a nursing home. Don Olson stated that this request is only for Lot 7 of Block 3. Lots 1-6 are not a part of this project. Question on the parking requirements. Don Olson stated that he is working with Cai on parking requirements. Question on the ditch. Don stated that the ditch is owned by Cenex. He went on to state that if this project is approved, construction would begin in July or August. Cai recommended approval without any conditions. David Trost stated that there will be an auction/entertainment fundraiser on April 21, 2006 at St. Anthony' s Church. He invited the Board to attend. Motion by Bud Johnson, second by Clarence Foes, to recommend approval to the City Council for the conditional use application, as submitted, for St. John's Lutheran Ministries. Motion carried by a vote of 7-0. Discussion - Annexation of Riverside Parlh Water Treatment Plant and the Wastewater Treatment Plan After a discussion a motion was made by Bud Johnson, second by Hazel Klein, to hold a public hearing on May 4, 2006 at 7:00 pm for the City's annexation requests. Motion carried by a vote of 6-1 with Todd Linder voting no~ Subdivision Regulations Cai requested that the Board review the implementation issues for the City's adopted GMP that need to be integrated into the new, revised Subdivision Regulations. In addition the State Legislature has mandated the statutes passed at the last session be implemented by local governments no later than October 1, 2006. These items will be discussed at the May 4, 2006 meeting. DRAFT Cai passed out the copies of the 145-page Billings-Yellowstone County Subdiv/sion Regulations. The Cotmty Commissioners would like to see the same regulations govern land within the Laurel Planning Jurisdictional Area as in the rest of the County. The board needs to integrate or change the draft regulations to reflect the needs of our area. The meeting was adjourned at 7:45 pm. The Planning Board Secretary shall note the time of receipt, keep one copy, send one copy to the Planning Director, and forward the remainder to the members of the Zoning Commission. The Planning Board Secretary shall publish notice of a public hearing in the local newspaper at least 15 days prior to the Zoning Commission meeting at which the application will be considered; adjacent property owners of record within 150 feet of the application property shall also be notified by mail by the Zoning Commission. Those that attended were personally invited for the purpose of being informed about the project, as well as to have the chance to ask questions, or ra/se concerns. Those present agreed to allow St. John's to use their names in this document stating that they did not protest The Crossings project, nor a special condition to permit a building no more than 45 feet.
