AN EMERGENCY ORDINANCE IN ACCORDANCE WITH MCA § 7-5-104 and §7-~-
108, TO ADOPT THE ATTACHED SCHEDULE OF FEES AND CHARGES AS
IMMEDIATELY EFFECTIVE AND ENFORCEABLE BY THE CITY OF LAUREL AND
TO REQUIRE THE CITY COUNCIL TO ADOPT A SCHEDULE OF FEES AND
CHARGES AT LEAST ANNUALLY BY RESOLUTION.
WHEREAS, the City of Laurel has previously adopted fees and charges for various
services through past Ordinances and Resolutions and such fees and charges are currently
outdated and difficult to locate, manage and enforce since they are located in previously enacted
Resolutions and scattered throughout the Laurel Municipal Code in various Chapters and
Sections;
WHEREAS, State Law provides the City Council with a temporary expedited procedure
at MCA §7-5-104 and §7-5-108, wherein the City Council can enact an immediately effective
Ordinance of adoption for up to ninety (90) days following its adoption; and
WHEREAS, the City is concerned that under the current system, the public is unable to
obtain a comprehensive list of the City's Fees and Charges since they are located in past
resolutions as well as scattered throughout the Laurel Municipal Code creating a potential notice
problem f~r the City as well as increasing thc chances for assessment errors by staff; and
WHEREAS, the rapid growth of the City and increasing workload for staff requires the
city government to provide a clear and consistent list of Fees and Charges for the public for
purposes of notice and due process; and
WHEREAS, the current status of the Fees and Charges provides questionable notice and
requires immediate action by the City Council; and
WHEREAS, the City intends to entirely amend and modify the Laurel Municipal Code in
order to assemble its fees and charges in one location for purposes of clarity and notice for the
public and its staff. During the formal amendment and modification process, the City must
provide the public notice and due process regarding the existence and assessment of mandatory
fees and charges imposed upon them in the interim.
WHEREAS, MCA §7-5-104 and §7-5-108, waives the requirement for public notice and
a hearing if an emergency ordinance is adopted for no longer than ninety (90) days from the date
of adoption.
IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana, that the
attached Code entitled "Schedule of Fees and Charges" is hereby adopted and immediately
effective by the City and that any applicable Fees and/or Charges currently existing in the Laurel
Municipal Code and/or that were adopted by previous Resolution of the City Council are
immediately modified and effective as provided in the attached Code;

BE IT FURTHER ORDAINED, that the City Council directs staff to prepare
amendments and/or modifications to the Laurel Municipal Code for adoption within ninety (90)
days from the date of this action.
BE IT FINALLY ORDAINED, that this Ordinance shall become effective immediately
upon adoption and continue until repealed, replaced or until it expires on its own, ninety (90)
days from the date herein adopted.

APPENDIX A: BUILDING PERMIT FEES
Building Permit Fees are determined by the Total Valuation of the project. For new construction and
additions the total valuation is determined by the most recent square foot construction costs as
published in the Building Safety Journal. For remodel projects, the total valuation is based on the
documented project cost.

Building Permit Fees for projects with total values of $100,001 to $500,000 ate $994 for the first $100,000
plus $5.60 for each additional $1,000 or fraction thereof up to and including $500,000. Building Permit
Fees for project with total values of $500,001 to $1,000,008 are $5,233.75 for the first $500,000 plus $4.75
for each additional $1,000 or fraction thereof up to and including $1,000,000. Building Permit Fees for
projects with total values of $1,000,001 or more are $5,608.75 for the first $1,000,000 plus $3.15 for each
additional $1,000 or fraction thereof.
