Box 200901 Helena, MT 59620-0901 (406) The purpose of this letter is to infoma you that the Montana Department of Environmental Quality (Department) has issued a final decision on a CHS Inc. (CHS) hazardous waste pen'nit modification request dated November 14, 2005 and received by the Department on November 16, 2005. You are receiving this notice because you are on the Department's mailing list to receive information concerning the CHS Laurel, Montana hazardous waste permit. This notice is required under 40 Code of Federal Regulations (CFR) 270.42(t)(1) (incorporated by reference into the Administrative Rules of Montana). CHS issued a notice of a permit modification request to the public on November 16, 2005. A poblic notice was published in the Billings Gazette and the Laurel Outlook announcing a sixty (60) day public comment period on the draft permit modification. No connnents were received by the Department during the comment period. In accordance with the Montana Environmental Policy Act, the Department prepared a draft Environmental Assessment (EA) for the requested permit modification. The draft EA was presented to the public for a thirty (30) day comment period on January 23, 2006. The Department received no comments on the draft EA. A final EA has been prepared and is available on the Department's website at http://www.deq.state.mt.us. The alternatives considered and the summary of impacts as described in the final EA remains the same as the draft EA. Any person who failed to file comments on the draft permit modification may petition the Board of Enviro~tmental Review to review only the extent of any changes from the draft to the final penuit decision, in accordance with 40 CFR 124.19 (as il~corporated by reference into the Administrative Rules of Montana). The petition must be received by the Board of Environraental Review by April 18, 2006. The petition must include a statement of the reasons supporting the review, including a demonstration that any issues being raised were raised during the public conuuent period. The petition must inclode, if appropriate: 1) a finding of fact or conclusion of law which is clearly erroneous; or 2) an exercise of discretion or an important policy consideration which the Board of Enviromnental Review should review. The final permit decision will become effective on April 19, 2006, unless a review is requested on or before April 18, 2006.
