ADDING SECTION 5.08.040 TO THE LAUREL MUNICIPAL CODE
CONTRACTOR'S LICENSE AND BOND REQUIREMENTS.
BE IT ORDAINED by the City Council for the City of Laurel,
County of Yellowstone, State of Montana, the following ordinance:
Section 1:
a)
No person shall do business as a contractor in the
City without first obtaining a contractor's
license. After approval of the license
application, obtaining a bond as required in
Section 2, and payment of the license fee as
prescribed by Council resolution, the City shall
issue a contractor's license.
b)
A contractor is defined in this Section as an
individual firm, partnership, corporation,
association or any combination of these, who
undertakes or offers to undertake or engages in the
business of constructing, altering or repairing
buildings or other Structures or sidewalks or
street pavements, including but not limited to the
following:

General building contractors
Cement or concrete contractors
Masonry contractors
Carpentry contractors
Acoustical contractors
Electrical contractors
Drywall contractors
Excavating contractors
Fencing contractors
Glazing contractors
Heating, air conditioning and refrigeration
contractors
Lawn, chemical and fertilizer applicators
Paint contractors
Plastering contractors
Plumbing contractors
Roofing contractors
Sewer and drain layers
Sheet metal contractors
Cleaning contractors
Window contractors
Wrecking and salvage contractors

Section 2:
a)
In the event that any of the above named
contractors are licensed by any department of the
State of Montana of Professional and Occupational
Licensing, that individual, or in the event of an
entity, or an employee of that entity, must have a
current license as issued by the agency regulating
that profession or occupation.
b)
In the event a state license is required as above,
the City can require the state license number to be
included on the application submitted to the City.
Section 3:
a)
Before issuance of the contractor's license, a
compliance bond in an amount prescribed by Council
resolution, shall be filed with the City Treasurer.
The bond shall be approved as to form and
sufficiency by the City Council and conditioned
that the licensee will, in good faith, perform all
the things required by the City and that if any
injury to any person or damage to any property
results by reason of the licensee's failure or
neglect to conform with the provisions of this
Article or other ordinance of the City relating to
the work performed by the contractor, the licensee
shall hold harmless and identify such persons
injured or the property of such property damage.
b)
Any contractor that has had a Laurel business
license for three (3) consecutive years or more,
will not be required to obtain the compliance bond
as set forth in Section 3 (a) above.
Section 4:
If any owner of property wishes to do any of the
work performed by any of the contractors as stated
above on his own property, he shall not be required
to obtain a contractor's license or be required to
provide a bond. However this provision does not,
in any way, affect the owner's requirement to
obtain the necessary permits to perform any of the
work.
This Ordinance becomes effective thirty (30) days after final
passage by the City Council and approved by the Mayor.

Council on April 19, 1994 by Alderman Dickerson
PASSED and ADOPTED by the Laurel City Council on second
reading this 3rd day of May , 1994, upon a motion
by Alderman Kellogg
of
