The purpose of this letter is to infonu you of the opportunity to review and comment on a draft Environmental
Assessment (EA) issued by the Department of Environmental Quality (Department). The EA describes the
Department's draft decision to approve, with changes, a Class 2 permit modification request by CHS, Inc.
CHS, Inc. requested multiple modifications to its hazardous waste permit (MTHW?-02-02) issued for the Laurel
Refinery. The modifications requested include: 1) revisions to permit text to clarify submittal sequence and
requirements of various documents to better describe the actual submittal process; 2) clarifications of definitions
listed m the Corrective Action Management Unit (CAMU) Module; 3) modification to the New Landfarm
(NLF) Closure Plan to allow for a determination whether waste residuals are present in the NLF; and 4) various
administrative and informational permit language changes.
The Montana Environmental Policy Act requires that state agencies rnust conduct an EA for certain state
actions. The Department has prepared a draft EA for the modification request and has made the draft available
on the Department's website at http://www.deq.mt.gov/ea.asp. A copy of the EA may also be obtained by

The public is given thirty (30) days to review and comment on the draft EA and the Department's draft decision
to approve the CHS modification request. The 30-day comment period is January 23 to February 21, 2006.
