AN ORDINANCE MODIFYING TITLE 3, CHAPTER 3.08 OF THE
LAUREL MUNICIPAL CODE, TO COMPLY WITH CHANGES BOTH IN STATE
LAW AND THE CITY'S ADOPTION OF A
PURCHASING AND PROCUREMENT POLICY.
WHEREAS, City procurement and contracts are currently governed by Title 3, Chapter
3.08 of the City's Municipal Code; and
WHEREAS, the State of Montana recently increased the statutory limit for purchases
and construction projects from $25,000 to $50,000 at MCA § 7-5-4302, requiring the City of
Laurel to publicly advertise all purchases of goods or services which costs exceed $50,000; and
WI-IEREAS, Title 3, Chapter 3.08 requires modification in accordance with State Law.
NOW, THEREFORE, BE IT ORDAINED, by the Laurel City Council that Title 3,
Chapter 3.08 is hereby amended as follows:
3.08.010 Awarding contracts~
Bidding process required.
A. All contracts of the city for the purchase of any
automobile, truck or other vehicle or road machinery, or
for any other machinery, apparatus, appliances or
equipment, or for any materials or supplies of any kind
in excess of" ...... fiRy thousand dollars or for
construction, repair or maintenance in excess of V, vent-y-
five fifty thousand dollars must be let out to the lowest
responsfole bidder aRer advertisement for bids.
3.08.040 Bid evaluation process.
A. If requested by the City Council, Tthe bids shall
be opened by the city clerk-treasurer, in the presence of
the council while the council is in actual session at a
regular, adjourned, or special meeting. If not renuested
by the City Council, then the clerk-treasurer shall open
the bids at the date and time specified in the
advertisement. After the bids shall have been opened,
the contract shall be let or awarded by the council, at the
next rek~ularly scheduled or special council meeting.
3.08.050 Contract preparation.
A. Upon receiving the statement of the awarding of a
contract, it shall be the duty of the city attorney to
prepare or review and annrove a contract and bond in
accordance with the statement. All contracts shall be

executed onthe part of the city by the mayor and attested
by the city clerk-treasurer, and together with the bond
therefore shall be filed with the city clerk-treasurer.

This ordinance shall become effective thirty (30) days after final passage by the City
Council and approved bythe Mayor.
