O05-12 ORDINANCE REPEALING CHAPTER 17.64 OF THE LAUREL MUNICIPAL CODE WHICH PROVIDES FOR A BOARD OF ADJUSTMENT WHEREAS, the City of Laurel has a provision in the Laurel Municipal Code for a Board of Adjustment, a quasi-legal appeals board for non-land use zoning issues; and WHEREAS, such Board of Adjustment has not met for at least two years; and WHEREAS, previous meetings of such Board of Adjustment often did not have a legal quorum of members with which to make decisions; and WHEREAS, the City Council of the City of Laurel had previously removed any issues concerning land use from the purview of the Board of Adjustment; and WHEREAS, enabling legislation of the State of Montana, 76-2-321, MCA, provides that local governments may provide for a Board of Adjustment but does not require same; and WHEREAS, the Laurel-Yellowstone City-County Planning Board, acting as the City Zoning Commission, has proposed elinfination of the Board of Adjustment and conducted a duly advertised public hearing on June 2, 2005 at which no objection was presented; and WHEREAS, the City Council of the City of Laurel hereby finds it is in the best interests of the residents of Laurel to approve this change. IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana that Chapter 17.64 of the Laurel Municipal Code is hereby repealed. This ordinance shall become effective thirty (30) days after final passage by the City Council and approved by the Mayor.
