O0~-11 ORDINANCE AMENDING CHAPTER 17.40 OF THE LAUREL MUNICIPAL CODE TO ELIMINATE THE OFF-STREET PARKING REQUIREMENT IN THE CENTRAL BUSINESS DISTRICT ZONE OF LAUREL WHEREAS, the City of Laurel recognizes the importance of having a viable and sound business district in its downtown area and that such recognition requires support ~om the City; and WHEREAS, the City of Laurel wishes to help business expansion and new business development in its downtown area and such support is formally adopted in Laurel's Growth Management Plan; and WHEREAS, requiring new or expanding businesses in Laurel's Central Business District Zone, which comprises the City's downtown, to provide for off-street parking is seen as onerous and an impediment to such businesses; and WHEREAS, the Laurel-Yellowstone City-County Planning Board, acting as the City Zoning Commission, has proposed elimination o f such off-street parking requirement in the Central Business District Zone and conducted a duly advertised public hearing on June 2, 2005 at which no objection was presented; and WHEREAS, the City Council of Laurel also held a duly advertised public hearing on August 16, 2005 at which the proposal to eliminate such off-street parking requirement was considered as was the recommendation from the City Zoning Commission; and WHEREAS, the City Council of the City of Laurel hereby finds it is in the best interests of the residents of Laurel to approve this change. IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana that Chapter 17.40.020(D) of the Laurel Municipal Code is hereby replaced with the following: "Tbat portion of the city zoned central business district (CBD) shall not have any off-street parking requirements provided, however, that the owners of expanded or new structures must consider the off-street parking needs of their projects." This ordinance shall become effective thirty (30) days aflcer final passage by the City Council and approved by the Mayor.
