ORDINANCE AMENDING THE REQUIREMENTS
FOR HOME OCCUPATIONS
WHEREAS; the City of Laurel believes that the ordinances regulating the granting of
home occupational licenses needs to be amended;
IT IS HEREBY ORDAINED by the City Council for the City of Laurel, Montana, that
the LAUREL MUNICIPAL CODE is hereby amended to read as follows:
Section 1 Changes to following sections shall be as follow:
Section 17.52.030.A.3 No alteration of the r ...... v ......... ~, ..... ~ ................
thereof a~ a dwz!!ing dwelling unit or accessory buildings that change the character thereof as
residential. If the activity for which a Home Occupation is requested is conducted at the
residence, it shall be conducted wholly within the dwelling or an accessory building.

and storage.

the Planning Board for a home occupation on an application form provided by the City, This
written rcquc:t application shall be submitted to the planning board seven working days prior to
their regularly scheduled meeting. Planning staff shall review the application and either
approve or deny such application within seven working days if it is found to comply with this
section. If such application is denied or there is a question concerning the application by staff,
the application shall be scheduled for the next planning board meeting if such meeting is at least
seven working days away from the date of the denial or the question by staff

shall be forwarded to the city councilfor final resolution. The city council shall consider the
planning board's recommendation concerning the specific occupation designation and shall
approve or deny the request at their next regularly scheduled meeting.
Section 17.52.030.E Violation of the conditions and terms of the approval of the
granting ora home occupation by the applicant after the home occupation has been granted
shah be grounds for revocation of such approval and if in the City, revocation or non-renewal
of the city Business License.
Section 2:
This Ordinance shall become effective thirty (30) days after final passage by the
City Council and approved by the Mayor.

1. Changes to Home Occupation R~cluest Form:
A. Add Item 10 to form: "I have read and understand this application." with
area for required signature of applicant.
B. Attach a copy of the City ordinance resarding I-~ma Occupations to the
application.
C. Provide approval/disapproval, signature, date, and comment lines for
Publl~ Works, Fire, and Pl/mning Depamments.
2. Change 17.52.030A3 W read: "No altexation of the dwelling unit or accessory

7, Change the fu~t paragraph of 17.52.030D to read: "Any pe,son who_desires a
home oc~pation shall apply to the Planning Board for a home occupation on an
application form provided by the City." Planning ~h~ll review the applic, ation and
approve it withia seven working days if it is found to comply with thin. sect/on, sohedule it
for review--if thexe is a question--by the next planning board meeting if such meeting is at
least seven work/ag days from the time it is scheduled for such meeting, or deny the
application. If the application is dimied by ~taff,, it shall be scheduled for the next planning
board meeting if such meeting is at least seven working day~ away from the date of denial.
8. Change 17.52.030E to dearie the first sentence and mbstitute: Application* that
have been reviewed by the planning board and denied shall be forwarded to ~e city
council for final resolution.
9. Add 17.52.030F: Violation of the conditions and terms of approval of the granting
of a home occupation by the applicant after the home o~cupation has been granted shall be
punished az set forth in Section~ 17.76.050 and 1.36.010 of this code. Violation of the
condition$ and terms of approval for $l~rtting a home occupation shall also be grounds for
revoc.~tion or non,renewal of the City Busitm, sa License. Should an existing home
occupation fall into non-compliance with this aec~inn through subsequent revhions made
to this section, the holder of the home occupation perrnitte~ shall have one year to bring
the home occupation into compliance with the current provisions of this ~eCdon.
