Members Present: Dr. Mark Waddington, Mr. Charles B~ooks, Mr. John Oakes, Mr. Wade Steinmetz, and Ms. Michelle Reed, Others Present: Mr. Russell Boschee, Mr. Stuart Hannah Chairman Waddington called the meeting to order at 7:35 p.m. Mr. Oakes moved to accept the minutes of the April 13th meeting as written. Ms. Reed seconded, and the motion passed unanimously. Concerning April's Industrial Compliance, Mr. Boschee said he inspected the Coors Barley Processing Facility near Huntley, He noted this was a state-of-the-art facility with four baghouses. He said there was a baghouse for each process; fugitive emissions are held to a minimum. He said his tour of this facility was very informative. Concerning April's Administration, Mr. Boschee presented a preliminary budget to the Board. He noted the City-County Health Department would be preparing our agency's FY2005 Budget from the material presented to Yellowstone County Finance Director Scott Turner. Mr. Boschee noted our agency's FY2005 Budget Hearing will be June 17th following the City-County Health Department's Budget Hearing. Chairman Waddington asked when the FY2005 Budget would be finalized. Ms. Reed said early September with the Final FY2005 Yellowstone County Budget. Concerning Degenhart's Open Burning complaint, Mr. Boschee said Mr. Degenhart was using someone else's permit, burning after hours, and burning material not listed on the permit. The Billings Fire Department responded to, and extinguished the fire on Lake Elmo Road. The Billings Fire Department reported the open burn, and they wanted to know if this individual could be fined. Currently, I told them he could not be fined, but I would write a letter to Mr. Degenhart saying he needed an Open Burning Permit and needed to contact our office to find out about restrictions on Open Burning. Concerning the Odor Complaint on Minnesota, Mr. Boschee said they are storing chemicals at the old Midland Packing Plant, but they are not mixing chemicals. He noted there is a rental near the building, and periodically the tenant questions the operations nearby. Concerning the Petro Coke fugitive dust complaint, Mr. Boschee said they load out some coke from storage piles. He said he observed their loading of a truck, and he found fugitive emissions to be minimal. Concerning the Compliance actions at Peavey Co., West'feeds, and Cereal Food Processors, Mr. Boschee said these businesses have asked for an extension until June 30, 2004 to complete their abatement plans. He noted these business found the asphalt chips to be cost prohibitive, and the dust suppressant contractor said the best time to apply the magnesium chloride is in early June. Chairman Waddington asked if there was a dust problem currently. Mr. Boschee said due to the recent rains, there has been no fugitive dust problem in the area. Mr. Steinmetz moved to extend the time for the magnesium chloride application until June 30, 2004. Ms. Reed seconded, and the motion passed unanimously. Concerning the Fox Distribution Compliance Action, Mr. Boschee said this business has also asked for an extension until June 30, 2004 to complete their sawdust clean-up. Fox Lumber had anticipated farmers using this sawdust, but their interest never materialized. Fox Lumber is using a loader to put the sawdust back through their collection system, but this process will require more time. Mr. Oakes asked if this was the end of the problem or a continuing problem. Mr. Boschee said he believes this will be their last request. Mr. Oakes moved to give Fox Lumber until June 30, 2004 to get the sawdust removed, Mr. Steinmetz seconded, and the motion passed unanimously. Mr. Boschee discussed the DEQ Enforcement Division Response to Mr. Faust's letter concerning his hay grinding operation. The DEQ position remains it is a commercial operation, and it is not exempt under ARM 17.8-308 (5). Mr, Oakes noted these hay grinding machines operating in other states have stronger requirements for particulate. Mr. Steinmetz explained how the hay grinding is done and how the fugitive dust is controlled. The Board discussed the Doug Dreeszen fugitive dust complaint and its ramifications on other agricultural practices. Concerning the Interlocal Agreement, Mr. Boschee said it has been approved by Yellowstone County and the City of Billings. The City of Laurel is scheduled to approve it on June 1st and the City of Broadview on June 8 . Mr. Brooks asked about the status of the move to the Courthouse. Mr. Boschee said he talked with Mr. Grag Erpenback, Courthouse Building Superintendent about our agency's needs to the Law Library. He indicated the Law Library would be on the Commissioner's Agenda for June 8~h. Final plans for our relocation will be made shortly thereafter. Concerning YCAPC Program Revisions, Mr. Boschee said Mr. Stewart Kirkpatrick's, City-County Health Department Attorney, requested the YCAPC Program I, so he could make changes to facilitate the new Interlocal Agreement. Mr. Boschee sent the Board Members Mr. Kirkpatrick's emails concerning this matter with comments. Concerning the Timeline of Communications, Mr. Boschee reviewed his involvement with various governmental personnel in the recent weeks. Mr. Boschee noted these contacts were necessary to keep the process moving on our agency's move to the City-County Health Department. He noted there was a list of interested parties which must be contacted concerning changes to our agency regulations. Chairman Waddington asked for this list. Mr. Boschee said he would email the Board the list, and he would ema[I the application so that Board Members can be added to the list. Concerning April's meeting, Mr. Boschee discussed: (1) the DEQ meeting concerning the North Park PM 2.5 monitor, (2) the County Commissioners concerning dusty roads policy, (3) the Laurel Fire Department meeting concerning Open Burning Policy, (4) the County Commissioners Meeting concerning Online Open Burning Permit Renewals, and (5) the County Commissioners Meeting concerning Open Burning Enforcement Policy. Concerning April's Air Quality, Mr. Boschee noted our agency issued 387 open burning permits last month. He discussed the progress concerning online open burning permit renewals saying few have applied online. Mr. Boschee noted it will take some time before the word spreads about online renewals, and he anticipates releasing another Press Release next spring. Chairman Waddington adjourned the meeting at 8:35 PM.
