Minutes of the Yellowstone County Air Pollution Control Board meeting held
February 10, 2004 at the Yellowstone County Air Pollution Office.
Members Present: Dr. Mark Waddington, Mr. Rich Schilf, Mr. Chades Brooks. Mr. John Cakes, and
Ms. Michelle Reed.
Other Present: Mr. Russell Boschee, and Mr, Stuart Hannah.
Chairman Waddington called the meeting to order at 7:30 p.m. Concerning the January 13~'
minutes, Mr. Schilf questioned what changes in the YCAPC Program the DEQ had approved. Mr.
Boschee explained what changes had been made. The phrase "since the DEQ has already
approved them" was stricken from the text. Chairman Waddfngton asked that "Mr. Kirkpatrick" be
inserted in place of "he" in a sentence to clarify. Ms. Reed asked the phrase "from the City-County
Health Department" be stricken from a sentence in the following paragraph. Ms. Reed moved to
table the minutes until the next meeting so the Board could review them further. Mr. Schilf
seconded, and the motion passed unanimously.
Concerning January's Industrial Compliance, Mr. Boschee said no industrial compliance was done
this month. He noted he would be busy with emission inventories for the industry sources over the
next month. He explained how the process works, what sources are under our jurisdiction, and
what criteria are used to determine which sources are under our jurisdiction. He noted our agency
might receive five new sources next year as determined by the DEQ Compliance Division.
Chairman Waddington noted the more sources our agency is responsible for; the more funding our
agency receives from the DEQ. Mr. Cakes asked if we had enough staff to conduct these
inventories. Mr. Boschee said they were his responsibility.
Concerning January's Administration, Mr, Boschee said the proposed 2003-2004 budget submitted
was approved on September 16, 2003. He said Chairman Waddington, Michele Reed and he
attended the midyear budget review with the County Commissioners. This budget was approved at
the midyear budget review. Chairman Waddington said the Interlocal Agreement is moving
forward, and our agency should wait until the new Interlocal agreement is signed before requesting
funds from the City of Billings. He noted that the County Commissioners agreed to fund our
program until the end of the fiscal year if the City of Billings funds are not available, Mr. Boschee
asked if the Board wanted to approve the proposed 2003-2004 budget. Chairman Waddington
noted the Board approved this budget on 9-16-03, so no further action was needed. The Board
discussed the 2003-2004 YCAPC Budget.
Mr. Boschee said the Timeline of Correspondence was requested by Chairman Waddington to
clarify the release of the "draft" Proposed Changes to the YCAPC Program V. Chairman
Waddington noted his request for this Timeline was for internal use only. Chairman Waddington
commented on the information requested by City Administrator Bauer, and he noted staff should
know what information could be released. The Board discussed what material is considered "draft"
and what material is considered public information. The Board discussed the legal requirements of
the Freedom of Information Act. Ms. Reed suggested the proper wording on the Agenda, and Mr.
Schilf said the minutes should reflect accurately the discussion. The Board discussed the proper
procedures for the release of agency information.
Mr. Boschee discussed the Draft Allocation of Agency Activities Report saying Chairman
Waddington and he worked out the percentages. The Board discussed this report, Mr. Schilf
questioned how the State DEQ designates the sites in the YCAPC-DEQ contract. Mr, Boschee
explained how the number of monitors and their location are determined. Ms. Reed said we should
emphasize the monitoring and expand on the activities required of staff for each monitoring site.
Mr. Brooks said the County Commissioners and the Billings City Council do not know what this
program entails, and he suggested making a request to the Billings City Council and the
Commissioners to be put on their Agenda to describe our agency's activities. The Board discussed
this suggestion and our agency's need to get the information out about our agency. Ms. Reed
suggested contacting City Administrator Bauer with more information than is currently in the report.
Mr. Boschee noted the County Commissioners and City Administrator Bauer received all the Board
material monthly. Chairman Waddington noted we need to justify staffing to the governing bodies
by accurately reflecting our agency's activities. The Board discussed accounting of staff time to
determine allocation of agency activities, and the Board made recommendations concerning this
matter.
Mr. Cakes asked if there was a size limit on a recreational burn. He noted Mr. Rusty Groshelle's
recreational fire should have resulted in a fine. Mr. Boschee explained the permitting process for
recreational burns, and he noted our agency does not have the authority to fine someone in this
situation. If there is a problem, our agency writes the individual a letter and suspends their permit.
The Board discussed this situation.
Returning to the Allocation of Agency Activities Report, Chairman Waddington noted the
percentages are purely coincidental that the percentage breakdown matches the previous
population breakdown. Mr. Schilf noted that the written detail needs more explanation. Ms. Reed
noted that the formula needs to show a breakdown. Mr. Boschee explained the percentage
breakdown for each activity. The Board discussed this report, and they made recommendations.
Mr. Boschee said he would rewrite the report with the recommendations in mind.
Mr. Boschee discussed the Draft Proposed Changes to the YCAPC Program V recommending the
Board of Health to be removed from Section VI and the City-County Health Department from
Section VII. He explained which sections had been added and which sections had been removed
and why. He reviewed the changes to Regulation 6 with the Board in response to previous Board
discussions. The Board discussed the changes made to Regulation 6 and our agency's policy
concerning recreational burns. Ms. Reed moved to table the Proposed Changes so Board
Members can review these changes and make recommendations. Mr. Cakes seconded, and the
motion passed unanimously.
Mr. Boschee noted French's Sandblasting and Painting's fine at the 420 N. 17th location was
rescinded. Mr. French was given the choice of building the fence or ceasing operation. Mr. French
chose ceasing operation, and he cleaned up the area later in the fall.
Mr. Boschee recommended changing the approval letters on the abatement plans for Cereal Food
Processors, Westfeeds, and Peavey Co. to include the use of recycled asphalt chips. Mr. Boschee
discussed the recent developments, which allowed for the use of recycled asphalt chips. He noted
all the businesses said they would use these chips if allowed. The Board discussed this
recommendation. Mr. Schilf moved to accept the use of recycled asphalt chips and to amend the
approval letter to reflect their use. Ms. Reed seconded, and the motion passed unanimously.
Mr. Boschee noted that Fox Distribution started its chipping project today. He noted he talked with
Mr. Leonard Fichtner, Fichtner Chevrolet Manager, concerning this project. Mr. Boschee said he
would update the Board on this project at the next meeting.
Concerning the Distribution of Agency Material, Mr. Boschee asked for a clarification of policy
concerning correspondence with the Board Members; he said it was his understanding that a
"draft" letter should be sent to the Board Members for approval, Upon distribution, the agency
letter should be emailed to Board Members. This correspondence to the Board Members should
be noted in a "cc" in the original letter. Chairman Waddington said that was the correct Board
policy. Mr. Boschee requested material on the Southside abatement plans be distributed to the
Ward I Councilwomen Gaghen and McDermott. The Board discussed this request. Ms. Reed said
correspondence should show all "cc" on who receives copies of the letter. Mr. Brooks noted City
Administrator Bauer needs to know what material City Council Members are receiving. The Board
discussed this distribution of material, and our agency's interaction with City Council Members. Mr.
Boschee stressed the need to form a partnership with the governing bodies and the general public.
The Board discussed the need to become more aggressive in our efforts to distribute information
about our agency to the governing bodies and the general public. Mr. Boschee noted that the
County Commissions, the Billings City Administrator, and the Mayer of Laurel receive the same
material the Board receives monthly.
Concerning January's meeting, Mr. Boschee said he met with Mr. Jim Kraft, Emergency and
General Services Director, concerning our open burning permit program. Mr. Boschee discussed
the need to keep Mr. Kraft involved in the process if the Board wants to make changes to the Open
Burning Permit Program.
Chairman Waddington adjourned the meeting at 9:10 P.M.

Pursuant to MCA 7-33-2205, the county governing body requires written permits for all open burning
within County jurisdiction and may establish fire seasons annually. Commissioners can suspend open
burning when conditions warrant.
Under the provision of MCA 50-63-103 YOU ARE LIABLE for any and all fire suppression costs and
damages resulting from an escaped and/or uncontrollable fire. You are liable for your fires despite the fact
you have been issued this permit. Under MCA 45-6-102, a person commits the offense of negligent arson
if he purposely places the property of another in danger of damage or destruction and can be fined $500.

It is the responsibility of each permit holder to contact their local Fire Department, listed below, the
City/County Dispatch Center (657-8200) or Laurel Dispatch Center on each day that burning is
anticipated and provide the following information:
a. Location of where burning will be conducted.
b. Material to be burned.
c. Call when fire is done.
This permit may be suspended or revoked at any time when conditions warrant, or when permit holder is in
non-compliance with the Open Burning Policy. The Fire Marshal/Fire Chief has the authority to discontinue any
open burn.

in the Yellowstone County Open Burning Regulations. This permit is not valid until signed. KEEP

81.327 for PM, any perso~ who owns or operates:
(a) any existing source of airborne particulate matter
shall apply reasonably available control technology (RACT);
(b) any new source of airborne particulate matter that has
a potential to emit less than 100 tons per year of particulate
matter shall apply best available control technology (BACT);
(c) any new source of airborne particulate matter that has
a potential to emit more than 100 tons per year of particulate
matter shall apply lowest achievable emission rate (LAER).
(5) The provisions of this rule shall not apply to
emissions of airborne particulate matter originating from any
activity or equipment associated with the use of agricultural
land or the planting, production, harvesting, or storage of
agricultural crops (this exemption does not apply to the
processing of agricultural products by a commercial business).
