ORDINANCE AMENDING CHAPTER 17
OF THE LAUREL MUNICIPAL CODE.
WHEREAS, Section 17.72.020 of the Laurel Municipal Code requires all amendments to
the text of the Laurel Zoning Ordinance to be initiated by the City Council on their own motion
or upon recommendation of the Zoning Commission; and
WHEREAS, Section 17.72.020 additionally provides that no amendment shall become
effective unless submitted to the Zoning Commission for review, public hearing, and
recommendation prior to the adoption of such amendment; and
WHEREAS, the Zoning Commission reviewed the proposed amendments to the Laurel
Zoning Ordinance and determined that the amendments are necessary to remain compliant with
the revised Montana Code; and
WHEREAS, the Zoning Commission recommends the City Council adopt the proposed
amendments since the amendments are in the best interests of the residents of the City of Laurel.
IT IS HEREBY ORDA1NED by the City Council of the City of Laurel, Montana, that the
LAUREL MUNICIPAL CODE is hereby amended as is set forth below.
Chapters 17. 08. 320, 17. 08. 455, 17. 08.535 and 17. 08.1000 are hereby deleted as follows:
17.08.320 Day care center.
"Day care center" means a place in which da3' care is provided to thirteen or more
children on a regular basis. (Ord. 993, 1991: prior code § 17.20.157)
17.08.455 Family Day Care Home.
A "family day care home" means a private residence in which da), care is provided to
three to six children fi.om separate families on a regular basis. Ord. 995, 1991)
17,08.535 Group Day Care Home,
A "group day care home" means a private residence ~n ~vhich da), caste is provided to
seven to twelve children on a regular basis. (Ord. 996, 1991)
17.08.1000 School, college or university,
"College or university" means a public or private institution for higher learning (beyond
grade v.velve) providing courses in instruction as approved by the Montana Depamnent of
Education or a national collegiate or university accreditation agency. (Prior code § 17.20/195)

The following New Sections are adopted and incorporated into the amended ordinance as
follows:
NEW SECTIONS:
17.08.285 College or University.
"College or University" means a Postsecondary School as defined herein.
17.08.875 Postsecondary School.
"Postsecondary School" means a community college, a unit of the Montana
University System, or a private university or college.
17.08.877 Preschool.
"Preschool" means a place or facility that provides, on a regular basis and as its
primary purpose, educational instruction designed for children five years of age or younger and
that: (a) serves no child under five years of age for more than three hours a da,/; and Co) serves no
child five years of age for more than six hours a day. See also, "Child Care Facilities" herein.
The following Sections are amended as follows:
17.08.980 School, Commercial.
"Commercial sSchool" means a building ~vhere instruction is given to pupils in arts,
crafts, or trades, and operated as a commercial enterprise as distinguished from mhools endowed
and/or supported by taxation, place or institution for the teaching of individuals, the curriculum
of which is composed of the work of any combination of kindergarten through grade 12, a
postsecondary school or a preschool. (Prior code § 17.20A85)
17.08.990 School~ elementary, junior or senior high, including public, private
and parochial. Commercial.
"Elemental3,, junior or senior high, including public private and parochial school" means
an institution of learning which offers instruction in the several branches of learning and study
required to be taught in the schools by the Montana State-Board of Education."Commereial
School" means a building where instruction is given to pupils in arts, crafts, or trades, and
operated as a commercial enter0rise as distinguished from schools endowed and/or supported by
taxation. (Prior code § 17.20.485)

This Ordinance becomes effective thirty (30) days after final passage by the City Council
and approval by the Mayor.
