Subject: Permit Modifications for the CHS Laurel Refinery.
Dear Mr. Nissen:
On November 10, 2003, you hand delivered a request for modification of the CHS Laurel Refinery hazardous
waste permit. CHS requested the addition ofAOC 11 to Module III, Appendix A. The Department bas
determined this is a Class 1 modification (40 CFR 270.42 as incorporated by reference in ARIVi 17.53.1201).
During our annual meeting on November 13, you stated that thc company name had been changed from Ccnex
Harvest States Cooperatives to CHS, Inc. A new Part A application and a permit modification will be necessary
to change the name in our records, as well as in the hazardous waste permit. The name change would be
considered a Class 1 modification.
In accordance with the rules concerning a Class I modification (§270.42(a)(ii) as incorporated by reference in
ARM 17.53.1201), CHS must send a notice of the modification to all persons on the facility mailing list
maintained by the Department. This notification must be made 90 calendar days after the change specified by
the modification has been made. A copy of the current mailing list for the refinery is attached to this letter.
CHS may also request an electronic copy.
CHS indicated by phone message to me today that it wishes to include both the AOC listing and the name
change in one pernfit modification. Therefore, the Department will postpone processing the modification for
Appendix A until it receives notification of the name change modification.
AR/vi 17.53.113 sets administrative fees for permit modifications. The fee for a Class 1 modification is
$200.00. The fee will be assessed when the Department receives the request for the name change.
